What happened in the Penske Media Google lawsuit?
Penske Media Corporation and affiliated publishing entities sued Google LLC and Alphabet Inc. in the U.S. District Court for the District of Columbia on September 12, 2025. Their complaint asserted federal antitrust claims and unjust enrichment. It alleged that Google used publisher material in AI Overviews and other generative AI products while changes to Search reduced visits that publishers depend on for advertising, subscriptions, and affiliate revenue.
On September 30, 2026, Judge Amit P. Mehta granted Google’s motion to dismiss Penske Media’s amended complaint. The court also dismissed a related federal action brought by Chegg and declined supplemental jurisdiction over the state unjust-enrichment claims. The opinion summarized its disposition with the sentence: “The court will grant the motions.”

Penske linked lower Search referrals to affiliate revenue
Penske alleged that its portfolio-wide organic affiliate revenue had fallen by more than a third from its peak by the end of 2024, attributing the decline to fewer referrals from Google Search. That is Penske’s company-specific allegation; the dismissal did not establish that Google caused the decline.
The complaint also cited estimates from Ahrefs and Bain & Company about click-through and searches without an external click. Those estimates were quoted within Penske’s filing, rather than independently assessed in the court’s decision, so they should not be treated as findings about Penske or all publishers.

Why did the court dismiss the complaint?
The alleged exchange of content for referrals
Penske’s theory treated publishers’ content and Google’s referrals as a reciprocal exchange. The court concluded that the complaints did not plausibly allege an agreement with the essential terms required for that theory. On the pleadings before it, the court found voluntary, cost-free crawling a more plausible account than the claimed agreement.
The claim that Search and AI Overviews were tied products
The court also held that the complaint did not plausibly allege Google Search and AI Overviews as separate products for the tying theory. It viewed AI Overviews as one type of result within the broader Search experience. The plaintiffs’ own description, the court reasoned, suggested that users sought information generally rather than demanding search links separately from AI-generated answers.

The decision dismissed the pleaded federal claims at the district-court stage and declined to keep the state unjust-enrichment claim under supplemental jurisdiction. It did not follow a trial weighing evidence about traffic, revenue, or causation. Nor did the court rule that AI Overviews have no effect on publisher visits or that Google’s conduct is lawful in every respect.
Are Google AI Overviews reducing publisher traffic?
Traffic volume and the commercial value of the visits that remain are separate questions. A publisher can receive fewer clicks while the value of each referred visitor changes in either direction; measuring visits alone does not establish subscriptions, affiliate conversions, or advertising revenue.

In UK publisher-conduct material, the Competition and Markets Authority (CMA) recorded publishers’ reports of significant drops in organic traffic and their concern that fewer visits can mean fewer advertising and subscription opportunities. The CMA also recorded Google’s position that referrals from search generative AI features may be higher quality and more likely to lead to valuable outcomes. Publishers told the regulator they could not accurately assess whether those referrals were more valuable than conventional Search referrals. This UK regulatory discussion is context, not proof of the facts in Penske’s U.S. lawsuit.
A preregistered 2026 field experiment by Stephanie T. Wang, Jeffrey Gleason, Yakov Bart, Christo Wilson, and Danaé Metaxa assigned 1,100 participants to Google Search conditions. The authors reported that hiding AI Overviews and AI Mode increased clicks to publishers, while an AI Mode-only condition reduced publisher clicks and eroded user experience and trust in information found on Google. The result is evidence about the participants and conditions studied, not a universal estimate of traffic loss for every publisher or query.
