In the United States, using an AI music tool does not automatically make you the copyright owner of everything it generates. Copyright generally follows human authorship: a prompt alone usually is not enough, but original lyrics or musical expression you contributed—and sufficiently creative human edits or arrangement—may be protected. The answer depends on what a person actually created, which work is at issue, and who owns the rights.

Who owns a song made with AI?

There may be more than one answer, because “a song” can mean both the musical work and a particular sound recording. Copyright analysis also separates human-authored expression from material whose expressive elements were determined by a machine. The U.S. Copyright Office says these questions require case-by-case analysis, not a blanket rule that all AI-assisted music is protected or that none of it is.

For the musical work, a person may claim rights in original lyrics or music they authored that is perceptible in the result. For the recording, rights may relate to human performance or production contributions embodied in that particular recording. A person who prompted a system may have no copyright in the generated expression simply because they initiated the generation. Contracts, assignments, employment, and other ownership arrangements can also affect who holds rights in qualifying human-authored material.

The Copyright Office’s AI initiative page reports that it received more than 10,000 public comments by December 2023. That figure is a count of comments to the agency, not a count of AI songs, songwriters, registrations, or infringement cases.

Can I copyright a song I made with AI?

You may be able to protect the human-authored parts of an AI-assisted song, but that does not necessarily mean you can claim copyright over every sound in the output. The Copyright Office’s January 2025 report says copyright can cover human expression perceptible in an AI output and sufficiently creative human modifications or selection, coordination, and arrangement. Protection is limited to qualifying human-authored expression; machine-determined material does not become human-authored merely because it appears alongside it.

In the Office’s Part 2 report on copyrightability, the Office assessed generally available technology and concluded that prompts alone do not provide sufficient human control over the expressive elements of an output. A prompt conveys instructions or an idea, but the key question is who determined the expression actually present in the result. More detailed prompting does not, by itself, settle that question.

Register of Copyrights and Copyright Office Director Shira Perlmutter put the distinction this way in the Office’s January 29, 2025 announcement: “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection. Extending protection to material whose expressive elements are determined by a machine, however, would undermine rather than further the constitutional goals of copyright.”

Can I copyright AI-generated music if I wrote the prompt?

Usually, a prompt by itself is not enough under the Copyright Office’s assessment of generally available systems. The prompt may describe what you want, but copyright authorship turns on human control over expressive choices that are actually present in the output. That distinction matters whether a prompt is short or elaborate: directing a system toward an idea is not necessarily the same as composing the resulting melody, harmony, rhythm, or other expression.

Your contribution may be different if you wrote lyrics or musical material that remains perceptible in the finished work, or if you later made creative changes to the generated output. The Office does not prescribe a formula based on a particular number of edits or prompt iterations. Whether the contribution is sufficiently creative and attributable to a human depends on the facts of the work.

Are the song and the recording protected separately?

Yes. A musical work and a sound recording are different works, and one release can involve separate authors and owners for each.

Work What it covers Typical author contributions identified by the Copyright Office
Musical work The underlying music—such as melody, rhythm, and/or harmony—and accompanying lyrics. Composers, lyricists, and songwriters.
Sound recording A particular fixed performance or production of sounds. Performers and/or producers whose authorship is embodied in the recording.

The Copyright Office explains these distinctions in its registration guidance. A singer’s performance credit does not automatically make that singer the composer, and a producer credit does not automatically establish authorship of the musical work. The same person can contribute to both works, but the roles and rights should be considered separately.

Who should I credit on an AI song?

Credit people for the contributions they actually made to the relevant work. Do not list an AI system as a human songwriter or imply that every contributor to the recording wrote the composition. Ownership and credit are related but not identical: a person may transfer rights, an employer or commissioning party may hold rights under an applicable arrangement, and credit practices do not by themselves determine copyright ownership.

  • Lyrics: Identify the person who wrote original lyrics that are part of the musical work.
  • Composition and arrangement: Identify people who composed or materially revised melody, rhythm, harmony, or arrangement.
  • Performance: Credit the people whose performances are embodied in the recording.
  • Production: Credit people whose production authorship—such as creative sound selection, editing, mixing, or other production choices—is embodied in the recording.
  • AI assistance: Describe software-generated contributions accurately where disclosure is appropriate, without presenting the tool as a human author.
  • Rights ownership: Check whether an employer, commissioning party, publisher, label, or other assignee received rights.

There is no universal U.S. AI-specific credit rule established by the Copyright Office materials cited here. Attribution and integrity are recognized as moral-rights interests, but that does not mean federal law always requires a particular “AI-generated” label. A distributor or service may have its own metadata or disclosure rules; check its current requirements rather than assuming they are the same across platforms.

How does registration work when a song includes AI-generated material?

The Copyright Office advises applicants to identify authors of the musical work separately from authors of the sound recording. A registration does not turn an AI system into an author or prove that every element in a deposited recording is protected. If the work includes generated material, describe the human-authored contribution and any qualifying human modification or arrangement accurately; the copyright claim extends only to protectable human authorship.

If one applicant seeks registration of both the musical work and sound recording, the appropriate treatment depends on whether the authors contributed to both works or the claimant owns the relevant rights. When different people authored or own the two works, separate applications may be needed. The Copyright Office’s registration materials provide the applicable application guidance; consult them for the form and claim details relevant to your submission.

What copyright does not settle

A copyrightability analysis answers only part of the practical question. It does not determine what a particular music-generation service promises in its contract, whether a distributor will accept a track, whether the track infringes someone else’s rights, or how another country treats AI-generated expression. Those issues depend on applicable terms, facts, and territory. The Copyright Office’s AI initiative page lists its work on AI; its Part 2 report addresses U.S. copyrightability, not the terms of any named service.

A song that imitates a real singer’s voice raises a separate issue concerning identity and digital replicas, distinct from authorship of the composition or recording. The Copyright Office’s Part 1 announcement on digital replicas recommended federal legislation addressing realistic but false digital depictions. That announcement does not establish the current status of any later law, so check current law before relying on it for a voice-imitation question.

What is the current status of the Copyright Office’s AI reports?

As of October 4, 2026, the Copyright Office’s public AI page reports that Part 2, on copyrightability, was published January 29, 2025, and that a pre-publication Part 3, on generative AI training, was released May 9, 2025. The page described a final version of Part 3 as forthcoming. Part 3 concerns training, rather than the basic authorship question addressed here; consult the Office’s current page for its latest publication status.
