If an AI assistant has exposed sensitive information, stop or restrict the route that is exposing it, notify the people responsible for the system, and preserve evidence. Then establish what information was exposed, who could access it, and what harm may follow. Whether anyone must be notified—and how quickly—depends on the facts, the data, the organization’s role, and the laws that apply.

First, treat the exposure as a potential data breach

A breach does not require a hacker. The UK Information Commissioner’s Office (ICO) defines a personal data breach to include accidental or unlawful disclosure of, or access to, personal data. In the United States, the Federal Trade Commission (FTC) says incidents covered by its Health Breach Notification Rule are not limited to cyber intrusions. A chatbot response, shared conversation, connected integration, or other accidental disclosure may therefore need to be assessed as a breach even if nobody deliberately broke into a system.

That does not establish that a particular law applies or that data was downloaded, misused, or seen by a specific person. Those are questions to investigate, not assumptions to make.

What to do immediately

1. Stop the exposure if you have authority

Restrict the feature, public link, sharing path, integration, or access that appears to be causing the disclosure. If you do not control the system, contact the AI provider through its incident channel and alert the organization’s security or privacy lead. Do not make changes that could destroy useful evidence or disrupt a response; coordinate with the responsible team where possible. The FTC’s business guide advises organizations to secure systems and fix vulnerabilities that may have caused a breach.

2. Preserve evidence without spreading the data

Record when and where the exposure occurred, what you observed, and how it was discovered. If safe and permitted, preserve relevant prompts or conversation identifiers, screenshots, recipient details, access or audit logs, and incident communications. Store evidence securely and limit access to people handling the response. Avoid reposting sensitive content to demonstrate the problem, and do not delete records before the response team has assessed preservation needs.

3. Escalate to the right people

  • If you are an individual user: report the incident to the assistant’s operator and, if the data belongs to an employer, client, or another person, notify the responsible organization promptly. Do not try to investigate by accessing accounts or systems you do not control.
  • If you are an employee: use your organization’s security, privacy, or incident-reporting channel. Tell the responsible team what happened and what data may be involved; do not independently contact affected people or regulators unless that is part of your role.
  • If you operate or develop the assistant: assign a response lead, involve security and privacy staff, and seek qualified legal advice where appropriate. The FTC recommends securing systems, reviewing access, and verifying what information and people were affected; complex incidents may warrant independent forensic expertise.

Work out what was exposed and who could see it

Build a factual account before drawing conclusions. Determine what categories of information appeared, whose information it was, where it was displayed or sent, how long the exposure lasted, and who may have had access. Review relevant access records and system logs with the people responsible for the service. Ask the operator about the system’s actual data flows, recipients, and available records rather than assuming how a particular assistant stores or shares information.

  • Separate confirmed facts from unresolved questions. For example, distinguish “the information appeared in a response” from “an outside person accessed or downloaded it.”
  • Record the time window and any known recipients or access events.
  • Identify whether the information includes account credentials, financial details, health information, government identifiers, or other data that could enable harm.
  • Document what evidence supports each conclusion and what remains unknown.

The FTC recommends reviewing access and verifying both the information involved and the people affected. Its guidance also advises organizations to work with forensic experts when needed.

Protect people based on the information involved

Protective steps should match the exposed data and the person’s likely risk. Tell affected people what happened, what information was involved, what the organization is doing, and where they can get help. Keep the message factual: do not claim that information was misused unless there is evidence, and do not imply that no harm is possible merely because misuse has not yet been found.

  • Social Security numbers: FTC guidance points to considering a fraud alert or credit freeze. The right choice depends on the person’s situation.
  • Health information: direct affected people to guidance and support relevant to the information exposed, and have the responsible organization assess whether health-specific notification rules apply.
  • Account credentials: use the service’s official account-security process to change affected credentials and review account activity, where applicable.

Notification duties depend on the law and the facts

There is no single deadline for every AI-related exposure. The route depends on jurisdiction, the organization’s role, the type of data, the risk to people, and the applicable law. An organization should involve its privacy officer or qualified counsel, check the relevant state and federal requirements in the United States, and document why it made its notification decision. Do not wait for every investigative detail if an applicable law requires an earlier notice.

UK personal-data cases

Under the ICO guidance cited here, a UK-regulated organization must notify the ICO within 72 hours where feasible if a personal data breach is likely to risk people’s rights and freedoms. If the risk to individuals is high, the guidance says to notify them without undue delay. The ICO says information can be supplied in phases if the applicable 72-hour deadline cannot be met in full, with reasons for the delay. These are conditional requirements, not a universal rule for every incident. The ICO also states that its guidance is under review following the Data (Use and Access) Act coming into force on 19 June 2025; confirm current requirements for the incident.

U.S. health-data cases

The FTC Health Breach Notification Rule may apply to covered vendors of personal health records and related entities. Its guidance addresses unauthorized disclosures as well as intrusions. For covered incidents, the FTC’s 2024 guidance describes a 60-calendar-day period for individual notices, subject to the rule’s “without unreasonable delay” standard. That timing is specific to covered notices under this rule; it should not be applied to other U.S. incidents or treated as the only possible notification duty.

Other U.S. and international cases

The FTC’s general business guide tells organizations to check applicable state and federal requirements. Other locations and sectors may have different rules. The cited U.S. and UK guidance is not a complete global legal survey, so organizations handling cross-border data should assess each relevant jurisdiction rather than borrowing one country’s deadline.

Fix the cause and monitor for recurrence

Once the immediate exposure is contained, investigate how it happened and test the corrective action. Review the assistant’s permissions, integrations, sharing settings, and data flows relevant to the incident; restrict access that is not needed; and verify that the fix works before restoring affected functionality. Continue monitoring for a repeat exposure and update response procedures based on what the incident shows.

NIST Special Publication 1800-29, published on February 23, 2024, frames organizational response as detecting, responding to, and recovering from data-confidentiality attacks. Its focus is organizational incident response, rather than a product-specific checklist for every AI assistant.
