Information you type into a consumer AI tool is a separate disclosure from information you share with your clinician or through a provider’s patient portal. Don’t assume an AI chatbot or health app is private or covered by HIPAA: check the service’s current privacy notice and settings, then share only what is needed. This guide focuses on U.S. consumers; it is general information, not legal advice.
Know who receives your health information
HIPAA does not automatically cover every app or AI tool that handles health information. The U.S. Department of Health and Human Services (HHS) says HIPAA protects protected health information held or transmitted by covered entities—such as health plans, most healthcare providers, and clearinghouses—and their business associates. In most cases, information entered into a personal-use app is not protected by HIPAA unless the app is provided by a covered entity or its business associate. That does not mean no rules apply. The Federal Trade Commission (FTC) says the FTC Act can apply to companies that collect, use, or share health information even when they are not required to comply with HIPAA. Certain personal health record businesses, related entities, and service providers may also be subject to the FTC Health Breach Notification Rule. Whether a particular law applies depends on the service and its relationships and practices; don’t infer a service’s legal status from a general privacy claim or badge. Health clues can be indirect
A prompt does not need to include a diagnosis to reveal something sensitive. The FTC notes that browsing, location, or purchase information can convey—or help someone infer—health information. Consider what an app or connected service could learn from your prompt and related activity, not only the words you deliberately enter.

Check the service before entering anything
Read the service’s current privacy notice and inspect its available settings before sharing health details. The FTC’s mobile-health-app guidance recommends understanding how information is collected, used, disclosed, and retained. For an AI tool, look specifically for:
- What information the service collects, including information from connected apps or devices.
- Whether prompts or uploaded files may be shared with third parties, and with whom.
- How long prompts and files are retained, and whether you can delete them.
- Whether your information may be used to train or improve models.
- What controls or consent choices are available, and whether the service is offered through a HIPAA-covered provider or has another relevant legal relationship.
Do not treat a privacy statement as proof that every detail is protected by HIPAA. The FTC’s Mobile Health App Developers: FTC Best Practices offers broader guidance for app developers, but it does not verify the current practices or settings of any particular AI provider. Share the minimum needed to ask your question
Before you submit a prompt, remove details that do not help answer it. HHS advises limiting information sent or stored through personal devices, while FTC guidance emphasizes understanding data use, disclosure, and retention. Applying that advice to a chatbot means describing the issue without uploading more of your record than necessary.
- Omit your name, address, phone number, email, account numbers, and other direct identifiers unless they are genuinely needed.
- Leave out exact dates or distinctive personal details when a general time frame will do.
- Summarize a relevant note or result instead of attaching a full chart, report, or discharge document.
- Do not include another person’s health information without a clear need and appropriate authorization.
This is a way to reduce what you disclose, not a guarantee of anonymity. Context can still identify someone, and HHS cautions that privacy steps can reduce—but not eliminate—a mobile device’s digital footprint.

Protect the device and the setting
HHS recommends practical safeguards when communicating about health information: use a private place and a trusted device, keep software current, and use password-protected home Wi-Fi. Avoid public Wi-Fi and shared devices for sensitive health information, and verify who you are communicating with. Review app permissions and avoid unnecessary apps; withhold location access unless it is needed. Device menus vary by operating-system version, so use your device’s current privacy settings rather than relying on an old menu path. A privacy screen filter may reduce the chance that someone nearby can read your screen in a shared space. It does not change what an app collects, retains, or shares after you submit information.

Use your provider’s channel for clinical care
A consumer chatbot is not a substitute for communicating with your healthcare provider through a clinical channel. HHS recommends using a patient portal to send and receive messages safely. If you need to discuss symptoms, treatment, or records with your care team, use the provider’s portal or another channel the provider directs you to—not a consumer AI tool as a stand-in for that channel.
What the breach-notification deadline does—and does not—mean
In an April 2024 announcement, the FTC said that for breaches involving 500 or more individuals, covered entities must notify the FTC at the same time they notify affected individuals, without unreasonable delay and no later than 60 calendar days after discovering the breach.
