Compare the actual systems and workflow, check the applicable rules and commitments, and require qualified human review.
What local AI and cloud AI mean for this comparison
Local AI means the model runs on equipment controlled by the organization, such as a workstation or its own server. Cloud AI means document content is processed through a service operated by an outside provider. These labels describe where processing happens, not every place data may be stored, logged, accessed, or backed up. A particular system’s data flow and terms matter more than its label.
The choice is also task-specific. Summarizing a public filing, extracting clauses from a client contract, and drafting a motion from confidential matter files present different sensitivity and review needs. Start by identifying both the document and the intended use rather than choosing an architecture in the abstract.
Is local AI safer for confidential legal documents?
Local processing can reduce the need to transmit document text to an external AI provider. That may be useful when a matter’s confidentiality requirements or organizational policy favor keeping data within controlled infrastructure. But local execution is not a privacy guarantee: people or software may still access the machine, and logs, backups, remote administration, endpoint compromise, or poor retention practices can expose information.

NIST Special Publication 800-122 (April 2010) offers foundational, context-based guidance for protecting personally identifiable information (PII). NIST’s AI security and resilience materials also frame confidentiality as a risk affecting both data and the systems that handle it. These are useful assessment principles, not certifications of a particular local deployment.
What to check in a local deployment
- Which users, administrators, applications, and support staff can reach the documents, prompts, outputs, and logs.
- Whether documents or prompts are written to logs, caches, crash reports, backups, or other storage, and how long each is retained.
- How devices and servers are secured, patched, monitored, and protected against unauthorized network or physical access.
- Whether model files, extensions, integrations, or updates introduce additional access or data-handling paths.
- How deletion works across primary storage, logs, and backups, and how access or security incidents are handled.
Keeping processing local can change the exposure, but it does not remove the need to manage access, retention, and system security.

What cloud AI requires you to verify
Cloud services introduce provider, contract, and service-control questions. NIST Special Publication 800-146 (May 2012) discusses cloud opportunities and risks broadly; it does not establish current terms, guarantees, or prices for today’s AI providers. Evaluate each service and plan using its applicable contract and technical documentation rather than assuming that all cloud services handle data alike.
Cloud-service diligence checklist
- Data use: Does the provider use prompts, documents, or outputs to train or improve models? Are the terms different for consumer and business offerings?
- Retention and deletion: How long are inputs and outputs kept, what is retained for abuse monitoring or troubleshooting, and what does deletion cover?
- Access: Which provider personnel or subprocessors can access data, under what conditions, and with what safeguards?
- Location: Where is data processed and stored, and can the provider commit to a geography relevant to the matter?
- Security and incidents: What access controls, audit information, and incident-notification commitments apply?
- Integration and accounts: What data is sent through connected apps, plugins, or document tools, and how are accounts and permissions managed?
NIST’s cloud guidance is a risk-management reference, not an endorsement or current review of any provider. Terms can vary by product, plan, and contract; confirm the exact service configuration in use.

Is cloud AI accurate enough for legal work?
The evidence available does not establish that local or cloud AI is categorically more accurate for legal documents. Accuracy depends on the particular model, task, source material, configuration, and workflow. A deployment label cannot substitute for testing whether a system correctly extracts, summarizes, or drafts the information needed in a specific legal context.
The ABA Section of Science & Technology Law’s June 10, 2019 submission recommends human review and source identification. It states: “Legal AI tools should always permit a human to be in the decision-making process (e.g., human-in-the-loop).” The submission also says: “At the least, the AI enables its work product to be reviewed and corrected by a human before producing a final work product.” This is a section comment, not binding law; it should not replace checking current professional-conduct rules or organizational requirements.

How to evaluate accuracy for a real workflow
- Choose representative tasks and permission-cleared documents that reflect the intended work, including difficult or ambiguous examples.
- Define what a correct result means for each task—for example, whether every extracted clause must be located accurately or each legal proposition must have a verifiable source.
- Have qualified reviewers check outputs against the underlying document and authoritative legal sources. Treat citations and quotations as unverified until checked.
- Record errors that could materially affect the work, such as omitted qualifications, invented citations, incorrect dates, or unsupported conclusions.
- Compare the complete workflow, including review and correction, rather than judging model text alone.
This is a practical evaluation method, not a claim that either architecture will meet a particular accuracy threshold. The cited sources provide risk and review principles, not a controlled local-versus-cloud benchmark for legal documents.

No comparable current cost figure is established for local and cloud legal-document workloads. Token charges or the purchase price of a machine alone will not show which option costs less overall. Include implementation, operation, security, and human review in the same calculation.

Estimate one-time setup separately from recurring costs, then compare both options for the same task volume, document sensitivity, review standard, and period. The table lists cost categories, not published prices or evidence that either option is cheaper.
How to choose for a particular matter
- Classify the material and task. Identify confidentiality, sensitivity, client commitments, and whether the work involves personal information or other protected data.
- Check applicable requirements. Confirm current professional-conduct obligations, privilege considerations, data-protection duties, client instructions, and organizational procurement rules for the relevant jurisdiction.
- Map the data flow. For each candidate system, determine what leaves the organization, where processing and storage occur, who can access it, and how logs, backups, and deletion work.
- Assess controls and terms. Compare endpoint, account, network, administrator, retention, training-use, geography, and incident safeguards for the actual deployment and contract.
- Test the work product. Use permission-cleared examples and qualified human reviewers to validate outputs against source documents and authoritative legal materials.
- Calculate total cost. Include setup, hardware or service charges, power, integration, maintenance, security, and review time on a like-for-like basis.
- Document the decision. Record the task, accepted risks, safeguards, review responsibility, and conditions that would trigger reassessment.
NIST’s AI Risk Management Framework (AI RMF) is voluntary. NIST says AI RMF 1.0 is being revised; its Generative AI Profile, published July 26, 2024, is a companion resource. Treat these as risk-management aids, not substitutes for laws, professional duties, or matter-specific advice. The source set also includes U.S. professional-association commentary and older NIST publications, so it does not resolve every jurisdiction’s rules or current provider terms.
