Read the entire declaration and ask the retailer to explain what product it covers, what each restriction means, and whether signing is a condition of sale. Do not sign a statement you believe is false or do not understand. If you plan to take, sell, or transfer the GPU across a border, check current U.S. export-control requirements for the exact item, destination, end user, and transaction before proceeding.
What has been reported about the GPU declaration
Tom’s Hardware reported that a customer at Micro Center’s Tustin, California, store was asked to show photo ID and sign an “Advanced Computing Product Purchaser Declaration” while buying a PowerSpec workstation with an RTX 5090. The report reproduces form language saying Micro Center would not sell the product to a purchaser who intended to export, reexport, resell, transfer, or otherwise cause it to leave the United States. That account describes one transaction. It does not establish that every Micro Center store uses the same process, that the declaration applies to every GPU, or that federal law requires this specific consumer-facing form. The available reporting also does not establish whether the form is enforceable or what penalty might follow from violating it. The full document and the buyer’s circumstances matter.
What to ask before signing
Ask the store to identify the covered product and explain the declaration’s terms in plain language. In particular, clarify whether it restricts only export, or also resale, transfers to another person, installation location, end user, or buying on someone else’s behalf. Ask whether the declaration is a condition of sale and what happens if you decline. Request a copy of the complete form and keep it with your receipt and any written explanation.

Do not guess at an answer or sign a promise that does not match your plans. If the store cannot clarify language that matters to your decision, pause the transaction. The available information does not establish a universal right to complete a sale without signing.

How a store declaration differs from federal export controls
The U.S. Department of Commerce’s Bureau of Industry and Security (BIS) says the Export Administration Regulations (EAR) govern exports and reexports of covered U.S.-origin and other items subject to the regulations. Whether a license or other authorization is required depends on the item and transaction, including product classification, destination, parties, and circumstances. Some restrictions can apply even to widely traded consumer products. See BIS guidance on the scope of the EAR and its Commerce Control List and Country Chart guidance.
A purchase inside the United States and a later export or reexport are separate events to assess. Signing a retailer’s form does not, by itself, establish what federal law requires for every buyer or GPU. Likewise, a consumer product name such as “RTX 5090” is not enough to determine its export classification or license status. BIS describes classification assistance for items and additional controls that may apply to particular destinations or circumstances.

BIS guidance also addresses transaction documentation and red flags that can indicate a required authorization may be missing. Those materials concern regulated export contexts; they do not interpret a particular retailer’s contract. Review the current rules and the complete facts rather than relying on a general claim about all GPUs. BIS has announced changes to licensing review policy for certain semiconductor exports to China, another reason destination-specific rules can change; that announcement does not establish the requirements for every retail GPU or buyer. - Identify the actual transaction. Determine who will possess and use the GPU, where it will go, and whether the plan involves shipment, travel, resale, onward transfer, or installation outside the United States.
- Check the exact item and destination. Review current BIS requirements for the item’s classification, destination, parties, and intended end use. Do not infer a classification or authorization requirement from the consumer product name alone.
- Resolve uncertainty before acting. If the destination, end user, or authorization status is unclear, pause and consult current BIS guidance or a qualified export-control professional. Requirements and licensing policies can change.
- Keep accurate records. Retain the declaration, receipt, written explanations, and relevant transaction documentation. BIS emphasizes accurate documentation and attention to red flags in applicable export transactions.
A retailer’s form may set terms for its sale, while the EAR may impose separate obligations depending on the transaction. The form does not substitute for checking those rules, and general BIS guidance does not decide whether a specific declaration is enforceable. The full declaration is not publicly established in the cited reporting, so ask the retailer for the version you are being asked to sign.
