NVIDIA AI servers are complete computing systems built around GPUs and related components to run demanding artificial-intelligence workloads. U.S. export controls do not treat every NVIDIA product alike: depending on technical specifications, destination, end user and transaction, they can restrict or require a license for particular chips, boards and complete systems shipped to China. A U.S. rule effective January 15, 2026, allows case-by-case review for certain qualifying H200-class exports under conditions; it is not blanket permission to ship them.

What is an NVIDIA AI server?

An AI server is a computing system assembled to handle workloads such as training or running AI models. Its accelerators, memory, interconnects and other components work together inside a server or larger system. NVIDIA products can be sold as individual GPUs or accelerators, boards, or complete systems such as DGX. Export controls can apply to systems incorporating controlled components, not just to a chip sold on its own.

NVIDIA said restrictions affected A100 and H100 chips as well as DGX systems and other systems or boards incorporating them. That does not mean every NVIDIA GPU or server is subject to identical controls.

Why does the United States restrict some exports to China?

The U.S. Department of Commerce’s Bureau of Industry and Security (BIS) says the controls are intended to limit China’s ability to buy advanced computing chips and manufacture advanced chips that could provide military advantage. BIS also cites AI technologies used in military applications. This is the U.S. government’s stated national-security rationale.

In an April 4, 2024, release, BIS said the rules reinforce controls intended to restrict the People’s Republic of China’s ability to purchase advanced computing chips and manufacture advanced chips critical for military advantage. Alan Estevez, then Under Secretary of Commerce for Industry and Security, said: “It is imperative that we continually assess and update our regulations so that we can better protect U.S. national security and foreign policy interests.” BIS’s release

How do export controls determine which products are covered?

The model name alone is not enough to determine whether an export can proceed. Relevant technical characteristics include total processing performance, performance density, interconnect bandwidth and memory bandwidth. NVIDIA’s filings identify A100, A800, H100, H800, L4, L40, L40S, RTX 4090, GB200 NVL72 and B200 among products subject to licensing requirements for China and certain other destinations or parties. Applicable rules and classifications, destination, end user and transaction details all matter.

For any proposed shipment, assess the transaction across these dimensions:

  • Product form: accelerator, server board or complete system.
  • Technical specifications: whether the item meets applicable performance, bandwidth or density criteria.
  • Destination and route: China or Macau, another controlled destination, and whether the movement is an export or reexport.
  • Recipient and use: the end user, its parent and any end-use restrictions.
  • Authorization: whether a license or applicable exception covers the transaction and what conditions apply.

What changed for certain H200-class exports in 2026?

A BIS final rule effective January 15, 2026, changed the review policy for certain qualifying advanced-computing commodities exported from the United States to end users in China or Macau. Items such as NVIDIA H200 or AMD MI325X can qualify for case-by-case review if they are below the rule’s specified limits of total processing performance (TPP) 21,000 and total DRAM bandwidth 6,500 GB/s. These are eligibility thresholds for that review policy, not general specifications for NVIDIA products.

Case-by-case review means the application may be assessed; it does not guarantee approval. The rule sets conditions that include certifications about U.S. supply and foundry capacity, recipient security procedures, shipment limits and independent third-party testing in the United States. Aggregate shipments are capped at 50% of the relevant product shipped for U.S. end use. Other destinations and reexports are subject to separate policies. BIS’s 2026 final rule

What has happened with H200 licenses and shipments?

NVIDIA reported in its fiscal 2027 second-quarter filing that the United States began granting licenses in February 2026 for small H200 shipments to specific China-based customers. The company said PRC restrictions limited those sales and that it had completed only a fraction of permitted shipments. It also reported that shipments under the program required inspection in the United States and incurred a 25% tariff upon U.S. importation. What happens if a shipment lacks required authorization?

Exporting without a required license can lead to criminal investigation and prosecution. The Department of Justice described allegations involving 400 A100 GPUs exported to China, as well as attempted exports involving HPE supercomputers with H100 GPUs and separate H200 GPUs. DOJ said the defendants allegedly lacked required licenses and concealed the intended destination. How to interpret a product listing or a planned shipment

A product listing, a familiar model number or a reported license does not establish that a particular China-bound shipment is lawful. The answer depends on the exact item and configuration, the applicable rule, destination and route, end user and use, and any license conditions. A license issued for one customer or transaction should not be read as blanket approval for other exports.
