Research a crypto presale by independently checking who is making the offer, what the written sale terms say, what the token is meant to do, and whether the project’s claims can be verified. Stop if the pitch promises guaranteed returns, pressures you to act immediately, hides key details, or asks for extra money to release supposed profits. These checks can help you avoid obvious warning signs, but they cannot prove a presale is safe or predict whether a token will retain value.
How to research a crypto presale
Treat every promotional claim as something to verify, not as evidence in itself. A polished website, enthusiastic testimonials, a newsletter mention, or a persuasive social-media post does not establish that a project is legitimate or likely to succeed.
1. Search the names involved
Search the project and promoter names, the token name, and distinctive phrases from the pitch alongside terms such as “review,” “scam,” “fraud,” and “complaint.” The FTC recommends searching for a company or person with these terms. Treat search results as leads: a complaint is not proof, and a clean-looking search result is not proof of safety. Compare what you find with original project materials, official records where relevant, and independent sources.
2. Identify the seller and check what can be verified
Establish who is actually making the offer and who is responsible for delivering what the project promises. Check whether the promoter’s identity and any claimed registration can be independently verified. The SEC and CFTC flag unlicensed sellers as a warning sign; SEC investor guidance also cautions about unregistered investments. Registration checks are only one part of due diligence: registration does not establish that an investment is sound or suitable.

3. Read the sale terms and project documents
Before sending funds, look for clear written information about what is being sold, how the sale works, what the proceeds are intended to support, and what risks and limitations apply. SEC investor guidance says difficulty obtaining paperwork is a warning sign. If important terms are missing, vague, or available only after you pay, do not fill the gaps with assumptions.
4. Test the token and delivery claims
Read what the project says the token does, what milestones or deliverables are promised, and what would need to happen for the project to succeed. Separate a claim about technical utility or a roadmap from a claim that buyers will profit. Ask what evidence supports each claim and who must do the work. A roadmap is a statement of intended plans, not evidence that the plans will be completed.

5. Pause when the pitch blocks careful review
Do not let countdowns, “limited allocation” claims, or pressure to commit quickly replace ordinary checks. The FTC identifies pressure and supposedly expiring offers as warning signs. The SEC and CFTC also caution about unsolicited pitches, hard-to-understand offers, and promises of high or guaranteed returns. If the promoter cannot explain the offer plainly, take time to understand it—or walk away.
6. Do not pay to unlock supposed profits
If a site displays gains or a balance but a promoter says you must first pay a “tax,” fee, or other charge to withdraw it, do not send more money. The SEC and CFTC describe invented advance costs to release fake profits as a fraud warning sign. A displayed balance or promised return does not show that funds are real or withdrawable.

Common crypto presale scam warning signs
Any one warning sign deserves scrutiny; several together are reason to stop rather than rush ahead. None, by itself, is a legal finding that a particular project is fraudulent.
- Guaranteed returns or “no risk” claims. The FTC states, “There are no guaranteed returns — and no investments without risks.” High or unusually consistent returns, whatever the market is doing, also warrant skepticism.
- Artificial urgency. A deadline, countdown, or supposed last chance can be used to keep buyers from checking the offer. Do not treat scarcity language as proof of demand or legitimacy.
- Unclear or overly complex explanations. Technical language alone does not prove fraud, but a pitch that cannot be explained plainly—especially alongside outsized return promises—is a serious warning sign.
- Unsolicited approaches or unverifiable identities. Be cautious when someone contacts you unexpectedly with an investment offer. The SEC and CFTC warn that fraudsters may use fake identities or misleading photos.
- Missing paperwork or secretive terms. Be wary if you cannot review written terms, or if the strategy, fees, or important details are kept secret or made unnecessarily difficult to understand.
- Withdrawal obstacles or surprise charges. Requests for more money to release supposed profits may be advance-fee fraud. Do not pay an unexpected fee on the assumption that it will unlock funds.
- Returns portrayed as consistently high. The SEC lists overly consistent returns among warning signs of Ponzi schemes using virtual currencies. A promised record of smooth gains is not proof of a reliable business.
What the law can—and cannot—tell you about a presale
There is no blanket rule that every crypto presale is either a security or not a security. In guidance dated April 22, 2026, and last reviewed or updated April 29, 2026, the SEC says federal securities laws apply to offers and sales of securities, including crypto assets when they are securities. The guidance explains that an asset that is not itself a security may still be offered and sold as part of an investment contract.

The SEC describes the investment-contract analysis through the Howey elements: an investment of money in a common enterprise, with a reasonable expectation of profits derived from the essential managerial efforts of others. How those elements apply depends on the facts, including what is represented or promised. A token’s label, technical description, or the mere fact that it is sold in a presale does not settle its legal status.

Why a careful check still cannot make a presale safe
Due diligence can help reveal unsupported claims and obvious fraud signals, but it cannot guarantee that a project will deliver, that a token will have future value or liquidity, or that lost funds can be recovered. The FTC reported that consumers told it they lost $4.6 billion to investment scams in 2023; that figure covers investment scams generally, not crypto presales alone.
In a May 2021 alert, the FTC reported that nearly 7,000 people had reported losses to bogus cryptocurrency investments totaling more than $80 million since October 2020. That is a historical snapshot, not a current annual estimate. Both figures underline why it is important to distinguish reported losses across broad categories from evidence about any individual presale.
