Keep the records that let you trace each client’s money from the trust-account register to the client ledger and bank activity, along with the supporting deposit and payment documents and completed reconciliations. How long to retain them depends on the rule governing the account: the official state examples below range from five to six years, with different events starting the clock. Check the applicable rule before setting a destruction date.

Which records support an IOLTA reconciliation?

A reconciliation should connect the account’s overall activity, each client’s balance, and the bank’s records. A bank statement alone cannot show that funds were correctly allocated among clients.

The State Bar of California describes a three-way reconciliation that compares the trust account journal, individual client ledgers (and a bank-charge ledger if applicable), and bank statements with cancelled checks. North Carolina Rule 1.15-3 describes comparing the general ledger, the combined subsidiary-ledger balances, and the adjusted bank balance. The terminology differs, but both approaches require records that can be cross-checked.

  • Transaction register or account journal: a chronological record of deposits, payments, transfers, and other account activity.
  • Individual client ledgers: records showing the activity and balance attributable to each client. Keep an account-charge ledger when applicable under the governing rule.
  • Bank records: statements and cancelled checks, or equivalent transaction records that document payments and deposits.
  • Supporting documents: deposit and disbursement records needed to substantiate entries, as required by the local rule and your recordkeeping process.
  • Completed reconciliation reports: retain the actual reports, including required dates, signatures, or other certifications.

How often should you reconcile?

Frequency is jurisdiction-specific. California’s handbook says trust accounts, including IOLTA and non-IOLTA accounts, must be reconciled monthly. Massachusetts Rule 1.15 requires reconciliation reports regularly and at least every 60 days. These are examples, not a nationwide schedule; follow the rule that applies to your account.

How long should IOLTA records be retained?

There is no single retention period established for all U.S. IOLTA accounts. The following official state examples show why the duration and the event that starts the clock both matter.

The periods in this table are jurisdiction-specific rule requirements, not a fifty-state survey. In California, the State Bar’s training material says the five-year period applies after all related funds are disbursed and directs attorneys under investigation to preserve records until the investigation concludes. Other rules may use different triggers or impose additional obligations.

How to set a retention schedule safely

  1. Identify the governing authority. Determine which state or court rules govern the account; do not assume that the office location alone resolves the question.
  2. Read the current rule text. Confirm the records covered, reconciliation frequency, retention duration, and the exact event that starts the retention clock.
  3. Include preservation holds. Do not destroy records while an investigation, audit, court order, or other legal hold requires them to be kept. California’s State Bar training material specifically requires retention through the conclusion of a State Bar investigation.
  4. Document the schedule. Track the relevant termination, distribution, or disbursement event for each matter when the rule uses one, and record the resulting eligible destruction date.
  5. Check digital-record requirements. Confirm whether the jurisdiction requires a record to be printable, reproducible, signed, dated, or periodically exported before relying on electronic-only storage.

Can you keep IOLTA records electronically?

Electronic retention requirements are not uniform. Wisconsin’s rule text illustrates a format-specific approach: it says computer-kept records must be reproducible as printed hard copy and describes printing IOLTA transaction registers, subsidiary ledgers, and reconciliation reports every 30 days, with printed copies retained for at least six years. The cited search result reflects an older rule version, so verify the current Wisconsin text before relying on those requirements.

Do not treat that example as a national digital-record standard. Before adopting electronic-only storage, check the current governing rule for required formats, printouts, signatures, and retention. Any system used should let you retrieve the underlying transaction records, client ledgers, bank support, and reconciliation reports for the full required period.

What to confirm before destroying records

  • The state or court rule that governs the account.
  • Which source records and reconciliation reports that rule covers.
  • The required reconciliation cadence and any signature or dating requirements.
  • The exact retention trigger, including whether it is tied to disbursement, distribution, or termination of a relationship.
  • Whether an investigation, audit, court order, or other preservation obligation extends the period.
  • Whether electronic copies meet local reproducibility or printing requirements.

Because the examples differ in both duration and trigger, do not apply a five- or six-year period to an account without first checking the current rule that governs it.
