Keep a dated record of your work, pay, mileage, expenses, and supporting documents—and preserve the original platform records. That evidence can help establish a timeline and calculate amounts for a wage or misclassification claim, but it does not by itself prove that you were an employee or that a particular expense is recoverable. The rules depend on your location, dates, platform, and claim type.

What records should you keep?

Build a record that connects the work you did, the money you received, and the costs you incurred. Keep the source documents as well as a ledger that lets you reconcile them.

  • Work and time: dates, work periods, start and end times, trip activity, and the method used to record time. Record trip activity separately from any broader work period you claim; a trip history may not show all the time you say you spent working.
  • Pay: gross fares or other gross payments, tips, bonuses, platform fees or deductions, payment dates, and the amounts that actually reached you.
  • Expenses: receipts or statements showing the date, amount, and purpose of each genuinely incurred cost. For vehicle use, keep a mileage log and available trip records.
  • Platform records and communications: preserve trip histories, weekly or annual summaries, pay statements, account notices, route or mileage records, and messages about pay, work requirements, or expenses.
  • Payment and tax records: save bank deposits and tax forms so you can compare them with platform summaries and your own ledger.

The U.S. Department of Labor (DOL) advises workers who may be misclassified or off payroll to keep their own records of hours or days worked, payment amounts and methods, and payment dates. IRS materials identify mileage logs and receipts as useful records for car and travel expenses. Neither a platform summary nor a tax form necessarily captures every fact relevant to a wage claim.

How to build a usable work-and-expense ledger

Use one chronological spreadsheet or paper ledger across platforms, with a separate line for each work period or expense. Keep the entries factual and traceable to a source document.

Ledger field What to record
Date and platform Work or expense date and the rideshare platform involved.
Work period and trip activity Start and end times, trips or other work activity, and how the time was recorded. Identify any later estimate as a reconstruction, not a contemporaneous entry.
Miles Date, beginning and ending odometer readings or miles driven, purpose, and related trip information when available.
Pay Gross fare or payment, tips, bonuses, fees or deductions, payment date, and actual amount received.
Expense Category, amount, date, work purpose, and a note explaining any allocation between work and personal use.
Evidence and notes Filename or location of the supporting record and a brief factual note about the work purpose or an unresolved discrepancy.

Preserve original exports, receipts, and statements without editing them. Keep a separate working copy for calculations and a simple index that identifies what each file is. Store copies securely and share only documents relevant to the claim.

How to document mileage and vehicle costs

For each mileage entry, record the date, beginning and ending odometer readings or miles, and the trip or work purpose. Keep platform trip information that corroborates the entry when it is available. IRS materials identify mileage logs and receipts as useful supporting records; a logbook can organize information, but it does not replace platform exports or receipts and does not establish a right to reimbursement.

Keep receipts or statements for costs such as fuel, maintenance, tolls, parking, phone service, or vehicle rental only when you actually incurred them. Note the work-related purpose and, where a cost also served personal use, how you calculated any work allocation. Do not label an entirely personal cost as a business expense without support. Whether any documented cost is recoverable in a wage claim depends on the governing law and facts; documentation alone does not answer that question.

How to reconcile platform pay, tax forms, and deposits

Compare your ledger with platform summaries, bank deposits, and tax forms, and note why figures differ. Possible items to explain include gross versus net amounts, fees, bonuses, cash tips, payment timing, and activity across multiple platforms.

A Form 1099-K reports gross payment transactions; it is not, by itself, a statement of take-home pay or a decision about worker status. IRS guidance says to review it alongside tax records to determine amounts received and expenses that may be deductible. Tax reporting as a contractor, including receipt of a 1099 form, does not decide whether someone is an employee for wage-law purposes.

What to do when records are missing

Mark missing dates or documents as gaps rather than silently filling them in. If you later reconstruct a work period or amount, identify when you made the reconstruction, what source you used, and what remains uncertain. Keep the original source and the reconstructed calculation separately.

For example, if a platform trip history supports passenger-trip times but does not record other time you say you were working, preserve the trip history and separately describe how you estimated the additional period. Do not present an estimate as a contemporaneous record. DOL recommends that workers who may be misclassified or off payroll create their own records of days or hours, amounts and methods of payment, and payment dates.

Does documenting expenses prove misclassification or a right to wages?

No. Records can help show what happened and support a calculation, but worker status and any right to payment or expense recovery require a legal analysis of the relationship and the applicable law. Federal Fair Labor Standards Act (FLSA) protections depend on employee status and coverage. State and local laws may apply different classification tests or reimbursement rules, so the applicable jurisdiction and claim forum matter.

DOL’s January 2024 announcement described a six-factor “economic reality” analysis: opportunity for profit or loss, worker investment, permanence of the relationship, control, whether the work is integral to the potential employer’s business, and skill and initiative. The announced rule took effect March 11, 2024. On May 1, 2025, DOL said Wage and Hour Division investigators would not apply that 2024 rule in current enforcement matters while the Department reviewed it and litigation proceeded; the Department said investigators would use longstanding principles and a reinstated virtual-marketplace opinion letter. That letter addressed the facts of a particular virtual marketplace company, not rideshare drivers as a whole.

DOL’s rulemaking page reports a proposal dated February 26, 2026, with an April 28, 2026 comment deadline. The information available here does not establish what happened after that deadline, so it cannot establish the proposal’s later status or the outcome of related litigation. Do not treat the proposal as a final rule or infer a result for a particular driver from it.

Before you file or make a demand

The filing route, applicable test, deadlines, and recoverable expense categories cannot be determined from a general federal checklist. Identify the state or locality, platform, dates at issue, and whether you are pursuing a wage claim, tax question, reimbursement demand, or classification dispute. Then check the rules and instructions of the relevant agency or forum, or consult a qualified employment professional. Keep your evidence organized by date so it can be reviewed against the requirements that apply to your specific matter.
