For a U.S. reader, the sources available here do not establish a blanket ban on privately cloning your own voice. But making a clone is not the same as having unrestricted permission to share it, use it commercially, or license it to replace paid work. The result can depend on state law, your agreements, how recordings are collected and stored, and what the voice clone is used for.
Creating a clone is different from using it
The legal questions change as a project moves from recording and model creation to public release or commercial use. Permission to create a model from your own voice does not automatically settle the terms for distributing the model, generated audio, or a license for a particular project. A provider’s terms can also impose contractual duties separate from laws protecting voice or likeness.

These are issue-spotting distinctions, not a complete legal test. The cited state examples below do not amount to a fifty-state survey.
State law can protect voices and regulate particular agreements
Tennessee
Tennessee’s General Assembly describes the ELVIS Act as creating civil liability for specified knowing unauthorized uses of a person’s voice, publication or transmission of an unauthorized voice or likeness, and certain tools whose primary purpose is unauthorized production of an identifiable person’s voice or likeness. The official bill summary for HB 2091 concerns unauthorized use; it is not a blanket ban on someone authorizing a clone of their own voice. Governor Bill Lee announced that he signed the act on March 21, 2024, in an official announcement.

New York
New York General Obligations Law § 5-302 covers certain agreements involving a digital replica used in place of work the individual otherwise would have performed in person. The statute defines a digital replica as a digital simulation of a person’s voice or likeness so close that a layperson cannot readily distinguish it from the authentic voice or likeness. Under specified conditions, an agreement provision can be void and unenforceable if the intended use is not reasonably specific and the individual was not represented by counsel or a qualifying labor organization. This applies to particular agreements, not every personal voice-cloning transaction. See the New York statute.
Illinois
Illinois’s Digital Voice and Likeness Protection Act addresses unauthorized replicas. Public Act 104-0282 amends agreement provisions for certain new performances fixed on or after January 1, 2026. Its application depends on the statutory conditions and the person’s circumstances; consult the current code for a specific situation.

Federal policy does not settle every question
The U.S. Copyright Office’s 2024 report, Copyright and Artificial Intelligence, Part 1: Digital Replicas, analyzes state-law approaches and recommends federal legislation. On preemption of state laws, the Office wrote: “Although there are reasonable arguments for each approach, the Office recommends against preempting state laws for several reasons.” Read the Copyright Office report. The cited materials do not establish a complete current account of federal statutory law, so they cannot support a categorical claim that one federal rule fully permits or prohibits all self-cloning.
The Federal Trade Commission says existing consumer-protection laws apply to AI-enabled voice-cloning misuse and discusses fraud and biometric-data risks in its voice-cloning challenge materials. The sources do not establish one uniform classification for all voice recordings across every state.

Before uploading recordings to a voice app
Check the provider’s current terms and privacy information before sharing samples. The legal answer and your practical risk are not determined by the act of recording alone.
- Training: Can the provider use your samples to train or improve models?
- Access: Who can listen to, retrieve, or otherwise access your recordings and model?
- Retention and deletion: How long are samples and generated audio kept, and what happens when you request deletion?
- Output rights: What rights does the provider claim over generated audio, and what uses does it permit you?
- Sharing: Can other users access your model or create audio with it?
- Contract terms: Do the terms restrict commercial use, transfer, publication, or use in a particular context?
These points are provider-specific; no particular service’s terms are assessed here. Do not assume that owning the voice means you control every copy of the recordings, model, or outputs held by a service.

Performers and workers should scrutinize replica licenses
If your voice is part of paid work, read any agreement that permits a digital replica rather than treating it as an ordinary personal experiment. The relevant details include the specific intended use, duration, context, compensation, and whether future uses require renewal or further consent. New York’s statute sets conditions for certain replica agreements, while Illinois has provisions for particular performances; the rules are not interchangeable.
SAG-AFTRA describes consent and intended-use protections in certain covered member agreements. Those protections arise in specific union settings and do not automatically apply to nonmembers or every work contract. See SAG-AFTRA’s digital-replicas resource. If you are negotiating a real performance license or planning a commercial launch, consult an attorney in the relevant jurisdiction.

How to assess your own situation
- Identify the use: Decide whether the clone will stay private, be shared publicly, support a personal or assistive purpose, appear in advertising, or substitute for paid work.
- Check the relevant law: Identify the state or states that may apply, including where you live, where the provider operates, and where the use occurs. The examples above are not comprehensive.
- Read the agreements: Review the voice service’s terms and any employment, contractor, or union agreement before uploading or authorizing use.
- Limit the grant: For professional uses, make sure the written permission specifies the intended context, duration, compensation, and conditions for additional or future uses.
- Get jurisdiction-specific advice where needed: A lawyer can assess a planned commercial use or contract against current law and the actual facts.
