Owning an audio file does not automatically give you permission to clone the person whose voice it contains, and getting permission to use a voice clone does not automatically give you copyright in the generated recording. Treat voice permission, rights in source material, copyright in the new work, and any disclosure duties as separate checks before publishing or monetizing a synthetic performance.

Four separate rights questions to answer

A voice-cloning project can involve several different people and rights: the person whose vocal identity is being replicated, the owner or controller of the source recording, the author of any script or other material, and the creator of the final production. One person may hold more than one of those roles, but a permission or ownership claim covering one role does not necessarily settle the others.

  • Voice permission: Is the person whose voice is being replicated—or someone authorized to act for them—agreeing to this use?
  • Source material: Do you have the right to use the recording and any script, music, or other material supplied to the system?
  • Copyright in the result: Does the finished work contain enough human-authored expression to qualify for copyright protection?
  • Transparency: Do rules that apply to your role, location, tool, and context require marking or disclosure?

These checks are related, but they are not substitutes for one another. In particular, labeling an audio clip as synthetic does not itself authorize the use of someone’s voice.

Get permission for the specific voice use

As a practical baseline, obtain written permission before creating or releasing a recognizable voice replica. Specify what the person is agreeing to rather than relying on a broad statement such as “AI use” or “marketing.” This is risk-control guidance, not a claim that every jurisdiction requires each term listed below.

What a useful permission record covers

  • The person and the voice recordings or other voice material covered.
  • The project, intended media, and purpose, including whether the use is commercial.
  • Where the material may be used and for how long.
  • Permitted edits, new versions, and derivative uses.
  • Compensation, if any, and whether another party may sublicense or reuse the replica.
  • How permission or the project can end, and what happens to the source recordings and replica afterward.

Confirm that the person signing has authority to grant the rights involved. A performer may be represented by a union, agent, estate, or other rights holder; authority can depend on the agreement and circumstances.

What the SAG-AFTRA example does—and does not—mean

SAG-AFTRA’s Sound Recordings Code FAQ describes a specific negotiated standard for covered sound-recording agreements: consent before release, separately in writing from the royalty agreement or performer contract, in clear and conspicuous language, with reasonably specific details of the intended use. For a deceased artist where consent was not obtained during life, the FAQ says consent must come from the representative or estate. These terms apply in the covered agreement context; they are not a universal statutory rule for every creator or project.

A separate negotiated model appeared in SAG-AFTRA’s August 14, 2024 announcement about Narrativ, a platform for licensing performers’ digital voice replicas for digital audio ads. The announcement described informed consent, compensation, individual control, and additional safeguards. It is an example of a licensing approach, not proof of current service availability or that its terms cover every user. Verify any platform’s present terms and the protections that apply to your project.

Separate voice identity from copyright in recordings and outputs

The U.S. Copyright Office treats digital replicas as a distinct policy issue from copyrightability of AI outputs. Its overview says Part 1, on digital replicas, was issued July 31, 2024, and recommended federal legislation. That recommendation does not establish a single comprehensive federal rule for every unauthorized voice replica, nor does it resolve all state-law questions. The cited sources are not a state-by-state survey of publicity rights.

Do not assume that owning or licensing a recording automatically gives you permission to synthesize the speaker’s vocal identity. Conversely, permission to use a person’s voice does not by itself give you rights to someone else’s recording, script, music, or other source material. Check the recording rights, the voice permission, and the AI tool’s terms separately.

When an AI-assisted output may have copyright protection

In its January 29, 2025 summary of Part 2, the U.S. Copyright Office said an output can be protected when a human author determines sufficient expressive elements. Its examples include human-authored work perceptible in the output, creative human arrangement, or human modifications. Merely providing prompts is not enough. AI assistance, or inclusion of AI-generated material within a larger human-created work, does not automatically prevent copyright in that larger work.

For a particular project, identify what a person actually contributed: for example, original scriptwriting, selection and arrangement of material, or expressive editing. Do not assume that the person who typed a prompt necessarily owns copyright in all generated expression, or that an output is automatically free for anyone to use. Copyright authorship also does not answer whether using a real person’s voice was authorized.

The Copyright Office overview lists Part 3, on AI training, as released in pre-publication form on May 9, 2025, with the final report still forthcoming on that page. That status is tied to the overview’s reported snapshot; it should not be treated as a complete answer to questions about training material or as a substitute for checking current law and tool terms.

Check disclosure rules separately from permission

Disclosure and marking requirements depend on jurisdiction, the actor’s role, and the type of system or content. The rules below illustrate why a creator should not treat transparency compliance as a blanket voice-cloning license.

The page says its text is based on the consolidated Act as of July 27, 2026. It does not mean every creator must label every synthetic clip, or that a label authorizes use of a person’s voice.
EU obligations for general-purpose AI models Providers subject to the AI Act’s general-purpose AI model obligations. European Commission guidance says providers must establish a copyright policy respecting EU copyright and rights reservations and publish a sufficiently detailed summary of training content. It says the obligations applied from August 2, 2025, with full compliance enforcement from August 2, 2026. These provider obligations are not a blanket permission rule for end users to clone a voice.
California SB 942, the California AI Transparency Act Covered providers, including a publicly accessible provider with over one million monthly visitors or users, subject to the statute’s terms. The law requires a no-cost AI detection tool and covered providers to offer manifest disclosure options and include latent disclosure in covered AI-generated audio and other media, subject to technical feasibility and other terms. It states that it became operative January 1, 2026. It is a covered-provider transparency law, not a general voice-cloning consent law.

For the EU, confirm which actor you are—system provider, deployer, or another party—and check the current consolidated text, applicable exceptions, and guidance before deciding whether a particular clip needs a disclosure. For California, establish whether the law applies to your role and provider rather than assuming its duties apply identically to every individual creator. The dates and scope above reflect the cited Commission materials and statute; legal text and guidance can change.

Reduce impersonation and provenance risks

Technical controls can reduce risk, but none guarantees that a voice clone will be authentic, detectable, or lawful. The Federal Trade Commission describes three intervention points: prevention or authentication before cloning, real-time detection or monitoring, and post-use evaluation. It discusses measures such as watermarking and authentication while emphasizing implementation challenges and the absence of a single solution.

  • Protect source recordings and limit access to the people and systems that need them.
  • Keep written permission, relevant contracts, and records of where source audio and generated versions are used.
  • Use authenticated channels for sensitive approvals; a voice message alone may not prove who authorized a project.
  • Preserve provenance information and use available marking or disclosure tools where required or needed to avoid misleading an audience.
  • Review how a platform retains source recordings, permits reuse, and handles deletion or termination before uploading voice material.

These steps are safeguards, not proof that a clone is authorized or a guarantee that a detector or watermark will work in every setting. The FTC states that existing laws still apply to AI-enabled voice cloning; it identifies no general AI exemption from laws already on the books.

A pre-release checklist for creators

  1. Identify the voice and source material. Record who is being replicated, who controls the source recording, and what other protected material the project uses.
  2. Confirm authority and scope. Obtain specific written permission from the person or authorized representative and check applicable union, agent, estate, and contract terms.
  3. Review the tool agreement. Check what the service may retain, reuse, sublicense, or generate from uploaded audio, and whether those terms fit the permission granted.
  4. Document human creative contributions. Keep scripts, edits, arrangements, and other records that show the human-authored expression in the finished work.
  5. Determine disclosure duties. Assess the relevant jurisdiction, your role, the type of content, and applicable exceptions; do not infer that disclosure cures missing permission.
  6. Plan for distribution and termination. Check that intended media, territory, duration, edits, and any reuse match the permission, and know how the project and source material will be handled when rights end.
