Safest approach: ask the store for permission or a price feed, or manually check prices that are publicly visible where the store permits it. Do not use Shopify’s API or a Shopify account to automate competitor monitoring: Shopify’s terms expressly restrict automated access and collection. Public visibility alone does not settle whether large-scale collection is allowed.

What Shopify’s terms say about automated price collection

Shopify’s Terms of Service, last updated August 1, 2026, say: “You agree not to access the Services or monitor any material or information from the Services using any robot, spider, scraper, or other automated means.” This is a restriction in the terms for Shopify users. It should not be treated as proof that every person visiting any Shopify-powered storefront has accepted those terms in the same way.

The separate Shopify API License and Terms of Use are clearer for app and API access. They prohibit using the Shopify API for “any systematic or automated data collection activities,” including scraping, data mining, data extraction, and harvesting. They also limit API requests to data needed for an authorized application and its granted permissions. Do not build a competitor-price crawler on Shopify’s API or use a Shopify account to automate monitoring.

Choose a collection method that respects access and objections

Third-party monitoring service Ask how it obtains the data, what authorization it relies on, how it handles blocks and objections, and what contractual assurances it provides. Do not assume outsourcing makes collection compliant. Proceed only when the provider can explain and document its basis and behavior.
Automated collection through Shopify API or a Shopify account Shopify’s terms expressly restrict automated access and systematic API collection. Avoid using these routes to collect competitor prices.

Check the storefront’s terms and robots.txt

Review the target store’s own terms before collecting prices, and inspect its robots.txt for crawler instructions. Shopify explains that robots.txt rules are “directional and advisory” and that not all crawlers are guaranteed to follow them in its robots.txt guidance. A permissive robots.txt entry is not legal permission; a disallow instruction is a signal to respect, not an invitation to find another route.

The technical status of robots.txt does not decide contract, privacy, copyright, or computer-access questions. Consider the method, the store’s stated rules, the data being collected, and the jurisdiction that applies. If a store expressly objects or its terms prohibit your intended collection, stop and seek permission or legal advice.

Do not bypass blocks or collect behind access controls

If the storefront requires a login, presents a CAPTCHA or other challenge, blocks requests, imposes rate limits, or sends an objection, do not defeat the restriction. Do not use proxy rotation or other tactics to evade a block or rate limit. Ask for permission or stop. Shopify describes using web application firewall and DDoS protections against much automated traffic in its Terms of Service.

Keep collection limited to the price information you actually need. Avoid gathering personal information, which can raise additional privacy obligations. If you cannot establish that your access method and data use are permitted, get jurisdiction-specific legal advice before proceeding.

Why the hiQ case is not a scraping license

The Ninth Circuit’s 2022 hiQ decision addressed a particular dispute about public LinkedIn profiles, a cease-and-desist notice, and the federal Computer Fraud and Abuse Act (CFAA). It does not concern Shopify and does not give general permission to scrape public webpages. The decision does not resolve contract claims, state-law claims, privacy or data-protection duties, copyright, trespass, interference, or laws outside that circuit and context.

A practical decision checklist

  1. Define the data and purpose. Limit the task to public price information you need; do not add personal data or unrelated content.
  2. Identify the access route. Do not use Shopify’s API or a Shopify account for automated competitor collection. For a vendor, establish its source and authorization basis before relying on its service.
  3. Review the store’s rules. Read its posted terms and robots.txt. Treat objections and technical restrictions as reasons to stop, not problems to route around.
  4. Prefer permission for recurring monitoring. Request a feed or written authorization that specifies scope and frequency.
  5. Stop when permission is uncertain. Seek legal advice for the applicable jurisdiction and facts rather than assuming public availability or robots.txt resolves the issue.
