For packaged foods regulated by the U.S. FDA, read the complete ingredient list, then check any nearby Contains statement and any separate advisory warning such as “may contain milk.” Check the exact package every time you buy it. If the label does not resolve your concern, do not buy the snack until you have asked the manufacturer or distributor named on the package.

Read the full ingredient list first

Find the ingredient statement and read every item. An allergen’s food-source name may appear as part of an ingredient’s common name, in parentheses after an ingredient, or in a separate Contains statement. For example, FDA label examples include “buttermilk,” “whey (milk),” “lecithin (soy),” and “flour (wheat).” A highlighted box or front-of-package claim is not a substitute for checking the full list.

FDA’s consumer guidance says the food-source name must be declared at least once in the ingredient list or in a qualifying Contains statement. Read both when present; the Contains statement does not make the ingredient list unnecessary. See the FDA’s label-reading guidance.

Check the Contains statement and advisory wording separately

Contains identifies allergens used as ingredients

A Contains statement is generally placed immediately after or next to the ingredient list and identifies major allergens used as ingredients. Check that the named allergen is one you need to avoid, and still read the ingredients for other relevant details.

May-contain warnings address possible unintended presence

Wording such as “may contain milk” or “produced in a facility that also uses milk” is a voluntary advisory about possible unintended allergen presence, including cross-contact. It is different from a Contains declaration for an allergen used as an ingredient. FDA says these warnings are voluntary, should be truthful and not misleading, and do not replace preventive manufacturing practices. Because manufacturers do not all use them, the absence of an advisory warning is not a guarantee that cross-contact is impossible. The warning also does not give a quantified amount or establish an individual safe threshold. FDA explains these distinctions in its food allergy guidance and industry guidance.

Required major-allergen declarations apply to these allergens and ingredients containing their proteins, subject to the rules’ scope and exceptions. Sesame became the ninth major food allergen on January 1, 2023. FDA notes that some products already in distribution or stock may not have a sesame declaration, so contact the manufacturer if you are uncertain. Details are in the FDA’s allergen overview.

Repeat the check for every purchase

  1. Locate the ingredient statement. Read every ingredient, not just the front label or a highlighted allergen box.
  2. Look for the food-source name. Check common ingredient names and parenthetical disclosures, then look for a nearby Contains statement.
  3. Read advisory wording independently. Note any “may contain” or facility statement naming the allergen; do not treat its absence as proof that cross-contact cannot occur.
  4. Check the package in your hand. Ingredients and formulations can change, so a product you have bought before may not have the same label now.
  5. Resolve uncertainty before buying. If the label does not answer your question, leave the snack and ask the manufacturer or distributor listed on its package what it contains.

Do not rely on a “free” claim alone

A front-label claim such as “dairy-free” or “milk-free” does not replace reading the complete current label. FDA guidance says there is no specific regulation defining “free” for every major allergen; the agency expects voluntary allergen-free claims to be truthful and not misleading. Read the ingredients and relevant statements, and contact the manufacturer if the label leaves you uncertain.

FDA has also reported a specific investigation in which milk levels ranged from 600 to 3,100 parts per million in certain dark-chocolate products discussed in its 2023 consumer update. That finding concerns those products, not packaged snacks generally; it is not a general estimate or a threshold for deciding whether a snack is safe. See FDA’s dark-chocolate update.

Know when ordinary packaged-food rules may not apply

This guidance concerns U.S. foods regulated by FDA. Some foods are regulated by other federal agencies, and FDA describes food put into a container after a customer orders it at the point of purchase as outside the cited packaged-food labeling requirement. For unpackaged or made-to-order food, ask the store staff or responsible business directly about ingredients and allergen handling. The FDA outlines the scope and exceptions in its food allergy guidance.
