Do not judge a cloud storage provider’s sovereignty by its data-center location or label alone. Check who controls the provider, where data and operations are handled, who can access the data and its encryption keys, and whether you can verify access, deletion, and a workable exit. Require answers for the specific service, region, configuration, and contract you would use.

What does “sovereign cloud storage” mean in practice?

Sovereignty is not a single technical feature or a universal certification. It is a set of controls over the service, the data, and the decisions that affect them. A storage bucket may reside in one country while its provider is owned elsewhere, support is delivered from another jurisdiction, or backups and management systems cross borders. Each of those facts can matter to your risk assessment.

The European Commission’s Cloud Sovereignty Framework is a useful EU-oriented way to structure procurement questions. It groups its criteria into eight categories: strategic, legal and jurisdictional, data and AI, operational, supply chain, technological, security and compliance, and environmental sustainability. Those categories are a framework for evaluation, not proof that a provider is sovereign or a universal standard that every buyer must adopt.

What should you ask a provider before choosing it?

Ask for answers that apply to the exact storage service and configuration—not just the provider’s general cloud platform. Request supporting contract language, technical documentation, audit evidence, and named responsibilities wherever possible.

Area Questions to ask Evidence to request
Legal jurisdiction and control Which legal entity provides and controls the service? Who owns or controls that entity? Which jurisdictions may apply to the provider, its parent, or subcontractors? How are legal demands handled? Contracting entity and applicable-law terms; ownership and control information; a description of the legal-request process.
Data location and flows Where are primary objects, replicas, backups, metadata, and telemetry stored and processed? Can failover or disaster recovery move any of them outside the stated jurisdiction? Service-specific region and data-flow documentation covering storage, processing, backups, support, and recovery behavior.
Encryption keys and access Who can use, administer, or recover the encryption keys? Can provider personnel access plaintext? Which roles can perform privileged operations? Key-management architecture; access-control and role documentation; details of customer-controlled key options, if relevant.
Auditability and deletion Can you determine who accessed data, when, and from where? What happens to copies in replicas and backups when you delete data? Audit-log coverage and retention terms; deletion procedures; evidence available to verify removal.
Operations and support Where are support and operations performed, under which legal framework, and by which personnel? Who can change, restore, or disable the service? Support and operations locations; privileged-access controls; personnel constraints and escalation procedures.
Supply chain Which subcontractors, software components, and infrastructure suppliers are critical to delivery? How will you be notified of relevant changes? Current subprocessor and supplier disclosures; change-notification terms; applicable audit rights.
Portability and technology Can you export objects and metadata in documented formats? Are the APIs or protocols documented? What would migration require? Export formats and API documentation; exit-assistance terms and fees; a migration plan that accounts for dependencies.
Security and compliance Which controls and attestations cover this precise service and region? What is excluded, and what exceptions or findings remain? Current audit reports or certificates, including their scope, dates, exceptions, and any service or region exclusions.

How do you assess jurisdiction, location, and control?

Treat these as separate questions. The country where stored objects reside does not by itself tell you which laws may apply to the provider, its parent, or its subcontractors. Nor does it establish where support staff work, where operational decisions are made, or which personnel can access management systems.

The European Commission’s EUR-Lex staff document 52026SC0502 explains why technical security alone may not remove non-technical risks associated with third-country legal exposure or operations and decisions based elsewhere. That is policy analysis, not legal advice about a particular provider or contract. For a consequential workload, have your legal and security teams assess the actual entities, applicable-law terms, data flows, and access paths.

Ask the provider to distinguish storage location from processing, backups, telemetry, control-plane functions, support access, and disaster recovery. If a region or residency commitment leaves one of those areas unspecified, record that as an unanswered question rather than assuming it is covered.

Who can access the data—and who controls the keys?

Encryption is not enough as a label: clarify who can cause data to be decrypted and under what circumstances. Ask whether the customer controls the keys, whether the provider can recover them, and whether provider staff can access plaintext through service operations or support. Then check whether the key arrangement works with the provider’s backup, recovery, and support processes.

The European Commission’s Cloud Sovereignty Framework implementation guidance states this data-and-AI criterion: “Ensuring that only the customer, not the provider, has effective control over cryptographic access to their data.” Treat it as a control objective to verify against the service’s architecture and contract, not as a claim that every provider offers the same key model.

Also ask what access records you can see. Confirm which events are logged, whether logs identify the actor and time, how long they are retained, and whether the customer can export or review them. A promise that access is controlled is less useful if you cannot establish what happened.

How can you verify deletion and plan an exit?

Deletion and portability deserve specific procedures in the contract and in your operating plan. Ask what deletion means for live objects, replicas, backups, and metadata, and what evidence the provider can give you. If backups expire on a schedule rather than being immediately erased, establish the schedule and the status of data during that period.

Before committing, map a realistic exit: export the data and metadata, identify format or API dependencies, estimate transfer and egress requirements with the provider, and determine how long a full migration would take. Confirm any exit-assistance fees and whether the service supports a staged migration while remaining available. A documented export route is more meaningful than a general statement that your data is portable.

How should you use the EU Cloud Sovereignty Framework?

Use the framework as a structured procurement aid if its EU-oriented criteria fit your organization’s needs. The European Commission’s 1 June 2026 explainer describes an overall sovereignty score based on 48 criteria across eight categories and introduces Sovereignty Effectiveness Assurance Levels (SEAL). The categories can help identify gaps in a provider response; they do not replace your own workload requirements or service-specific due diligence.

For its April 2026 procurement of sovereign cloud for EU institutions, bodies, offices, and agencies, the Commission reported a contract worth EUR 180 million and said eligible providers needed to reach SEAL-2, described as a data sovereignty level. The Commission describes the scale from SEAL-0, indicating demonstrated lack of sovereignty, to SEAL-4, requiring a full EU supply chain from chips to software. That threshold belongs to the named procurement and framework context; it is not a general legal requirement or a recommendation for every buyer.

How do you turn the answers into a decision?

Start with the consequences of a sovereignty failure for your workload. A low-risk archive may call for different controls from sensitive records subject to strict jurisdictional or operational constraints. Write down which conditions are mandatory, which can be mitigated, and which are merely preferred before comparing providers.

  1. Define the boundary. Specify the data, users, regions, service features, recovery arrangements, and legal obligations in scope.
  2. Set non-negotiables. Identify requirements for jurisdiction, personnel access, key control, retention, audit evidence, and exit rights.
  3. Request service-specific proof. Compare contracts and technical evidence for the exact region and configuration. Mark unsupported or ambiguous answers as unresolved.
  4. Assess dependencies. Include parent entities, subcontractors, critical suppliers, support arrangements, and technology that may constrain operations or migration.
  5. Test the operational plan. Confirm that your team can review logs, manage keys, restore service, and export data using the access and tools actually included in the offer.
  6. Record residual risk. Have the appropriate legal, security, and procurement owners accept or reject the gaps; do not treat a provider’s marketing label as a substitute for that decision.

No provider-by-provider qualification follows from the framework alone. Make the decision against current, service-specific evidence and the risks your organization is required to control.
