First clear the rights; only then prepare the stream. A continuous public YouTube broadcast of Malayalam film clips uses protected film footage and often separately controlled music or other audio. Owning a copy, finding clips online, giving attribution, or keeping each clip short does not by itself authorize that use. Get permission covering the actual livestream—or establish that a specific legal exception applies—before you upload or broadcast anything.
Start with rights, not the encoder
India’s Copyright Act lists cinematograph films and sound recordings among protected works. The Act defines a cinematograph film to include a visual recording and its accompanying sound recording, and defines communication to the public broadly to include making a work available to be seen or heard by the public through diffusion. A public livestream is therefore a rights-sensitive use; whether a particular use is lawful depends on its facts and applicable law. Read the official Act’s definitions and protected-work provisions.
Do not treat a short excerpt, a disclaimer, attribution, noncommercial intent, or possession of a DVD or digital file as a substitute for permission. There is no general five-second or ten-second safe harbor established by the cited materials. If you plan a commercial or ongoing entertainment stream and are considering an exception, get legal advice on the specific use.

Make a list of each film and version, the clip’s in/out timecodes, the picture, dialogue, music, and the source file. Identify who can authorize each element. Film footage and an embedded song or other underlying work may be controlled by different rights holders, so permission from one party may not cover the full clip.

Get a license that matches the broadcast
Ask the film or relevant rights holder for written permission expressly covering the clips and soundtrack, live online communication, India and any other intended territories, the license period, monetization, and whether the stream will be archived or replayed. Include promotional excerpts if you intend to publish them. Keep the signed permission and rights-holder contact details with the source media. The cited official sources establish protected categories and platform enforcement; they do not identify the owner of any particular Malayalam film.
If you are relying on an exception
Section 52 of the Act includes fair dealing for criticism or review and for reporting current events or current affairs. That does not mean an entertainment stream of movie scenes automatically qualifies. Identify the exact purpose and facts supporting the exception before publishing; do not assume that a clip count or duration makes the stream permissible. See the official Section 52 text.

Clear YouTube’s copyright process
YouTube says, “All live streams are scanned for matches to third-party content, including copyrighted content in the form of another live broadcast.” It may warn you, substitute a placeholder, interrupt the stream, or terminate it if third-party content remains. A license does not necessarily prevent interruption: YouTube says the rights owner may need to allowlist your channel in Content ID for the stream to proceed without that interruption. Keep the license and allowlisting confirmation available.
- During setup and broadcast: Watch YouTube Studio and Live Control Room for warnings. If YouTube identifies third-party material, do not keep transmitting it while the issue is unresolved; follow the platform’s instructions and contact the rights owner as needed.
A Content ID claim, a stream interruption, or another channel’s apparent survival is not a court ruling on Indian copyright law and does not establish that your use is authorized.

Prepare the channel and encoder
Check eligibility and allow time for activation
YouTube requires a verified channel with no live-stream restrictions in the preceding 90 days. First-time live-stream activation can take up to 24 hours. Check eligibility before scheduling the broadcast, not on launch day. YouTube’s live-stream eligibility and tips page describes these requirements.
Create the encoder stream and protect the key
- In YouTube Studio, select Create > Go Live, then create or schedule an encoder stream.
- Copy the server/stream URL and stream key from YouTube into your encoder’s corresponding fields. Treat the stream key like a password; reset it if it is exposed or compromised.
- Choose the output resolution, frame rate, bitrate, and keyframe settings in the encoder using YouTube’s current recommendations for your intended format and available upload capacity. The correct values depend on the stream format and connection; do not guess a bitrate or keyframe interval. Check YouTube’s current stream preparation and network guidance alongside the encoder’s settings.
- Send the signal and wait for the preview in Live Control Room. Confirm that the authorized clip and its audio are correct, then start the encoder and go live.
- To end the broadcast, stop the encoder and end the stream in Live Control Room. YouTube says streams under 12 hours are automatically archived, so confirm that archive and replay rights are included in your permission before leaving that feature enabled.
Rehearse the complete workflow
YouTube recommends setting up the encoder at least two hours before the event and starting it at least 15 minutes before the scheduled start. Check the preview, confirm the local archive file is growing, open the watch page on your channel and a mobile device, and monitor audio and video quality throughout. For a continuous broadcast, decide who will monitor the stream, how you will respond to an outage, what lawful clip order and transitions you will use, and when the stream should end. If clips repeat, check that every repeat remains within the license terms. Check upload capacity and backup plans
Measure outbound upload bandwidth at the actual streaming location, preferably when the connection is busy. YouTube recommends keeping total stream bitrate below available upload bandwidth with 20% headroom; upload capacity, not download speed, is the relevant measure. If you have a backup feed, include its bitrate in the capacity calculation. Test the network, encoder, preview, archive, and watch-page access before launch. For an important broadcast, test failover rather than assuming a backup will work.

Keep rights, copyright enforcement, and monetization separate
Answer these as three independent questions:
- Rights: Do you have authorization for the footage, audio, territories, live use, duration, and archive or replay?
- Platform enforcement: Will YouTube allow the transmission to continue without a match-related warning, interruption, or termination? A license may still require Content ID allowlisting.
- Monetization: Is the channel and stream eligible under YouTube Partner Program policies? YouTube says eligible Partner Program channels can monetize live streams, but its separate reused-content review covers clips and live streams. Permission alone does not guarantee monetization. See YouTube’s channel monetization policies.
Troubleshoot before and during the stream
- Live streaming is unavailable: Verify the channel and check for restrictions in the preceding 90 days. If activation is new, allow up to 24 hours.
- YouTube shows a third-party-content warning or interrupts the stream: Stop or replace the identified material while you resolve the issue. Check the license scope and ask the rights owner whether the channel has been allowlisted in Content ID.
- The preview is missing or incorrect: Recheck the server/stream URL and key in the encoder, confirm the correct authorized source and audio, then wait for Live Control Room to receive the feed before starting.
- The stream buffers or loses quality: Measure upload capacity at the streaming location, reduce total bitrate or improve the connection as needed, and preserve YouTube’s recommended 20% headroom. Include any backup feed when calculating total capacity.
- The archive is missing or not authorized: Check whether the stream was under 12 hours and whether archiving was enabled as expected. Separately confirm that your license permits the archive and replay; technical availability is not permission.
