Possibly—but a Creative Commons label by itself does not prove that an Indian creator can rebroadcast a lecture recording continuously on YouTube. Check the exact licence and version, confirm the licensor had authority over both the lecture and its recording, clear any third-party material inside it, and make sure the planned use follows the licence. YouTube may still interrupt a stream if its systems detect content that matches a rights holder’s material.

This is general information, not a ruling on a particular recording or legal advice. Without the recording, licence text, and rights-holder details, its use cannot be determined.

Check these five things before you stream

  1. Identify the exact licence. Record its name, version, source URL, and any additional terms. Read the licence’s legal code rather than relying on a label or uploader’s summary.
  2. Verify who granted it. Confirm that the person or organisation offering the licence had authority over the lecture and the audiovisual recording—not merely access to a copy of the video.
  3. Check every embedded contribution. Slides, music, images, video clips, and other contributions may have separate owners and terms. A licence on the lecture recording does not necessarily clear those elements.
  4. Match the licence to your use. Consider whether the stream will be monetised and whether you will edit, translate, add overlays, or add audio. Confirm those choices are allowed by the actual licence.
  5. Plan for YouTube’s rights systems. Keep evidence of permission, and contact the rights owner about Content ID allowlisting if a licensed recording may match their material.

What the Creative Commons terms can mean for a continuous relay

Creative Commons licences differ. CC BY permits reuse subject to attribution. NonCommercial (NC) variants restrict commercial use, and NoDerivatives (ND) variants restrict sharing adaptations. ShareAlike (SA) variants impose conditions on adaptations. Whether a particular continuous relay, monetised stream, or production edit is permitted depends on the exact licence and the facts; do not assume all CC licences allow all versions of the use.

YouTube says CC-licensed material may be monetised when the licence grants commercial rights. For CC material, YouTube instructs creators to include the title, author, source URL, and licence information in the video or its description; credit may also appear as on-screen text or voiceover. Attribution is a licence condition where required, but it is not a substitute for permission.

YouTube’s livestream terms require the streamer to have the rights needed to exploit the live content on Google services worldwide: Livestream terms and conditions.

Why a lecture recording can involve several rights holders

Indian copyright law recognises copyright in original literary, dramatic, musical, and artistic works, as well as cinematograph films and sound recordings. Relevant rights can include reproduction, public performance or communication to the public, and adaptation. A lecture stream may therefore involve separate rights in the speech, its audiovisual recording, sound recordings, and incorporated works.

The Copyright Office’s Chapter IV text says that, for an address or speech delivered in public, the person who delivered it is the first owner of copyright in it. That points to the lecturer as a likely rights holder for the speech; it does not by itself establish who owns or can license the recording, or rights in included music, slides, and other material. Section 17 also identifies the author as first owner, subject to the Act’s exceptions. See the Government of India’s Copyright Act, 1957, Chapter IV and Chapter III.

Section 52 contains limited educational provisions, including certain uses by teachers or pupils in the course of instruction and specified uses by educational institutions for audiences connected with the institution. Those provisions do not create a general permission for an independent creator to relay a lecture publicly around the clock. Educational subject matter alone does not clear a public stream. What can happen if YouTube detects a match

YouTube scans livestreams for third-party content. If its systems identify a match, the stream may display a placeholder and warn the creator to stop using the content. If the content remains, YouTube may temporarily interrupt or terminate the stream. A Content ID claim may also be made after the stream ends if it is archived. YouTube advises creators who have licensed third-party content to ask the owner to add their channel to the Content ID allowlist. See YouTube’s guidance on live streams and copyrighted content.

A licence and attribution do not guarantee that a stream will avoid an automated match. YouTube also explains that giving credit alone does not grant rights, describing a use as educational does not clear it, and altering content does not automatically authorise its use. Prepare a rights record before going live

  1. Open the original source and save the licence name, version, URL, and any extra terms.
  2. Establish who uploaded or licensed the recording and whether the lecturer, institution, videographer, and relevant performers granted the rights needed for your use.
  3. Review the recording for music, images, slides, clips, and other third-party material. Obtain separate permission or remove material that is not covered.
  4. Decide whether you will monetise or alter the recording. Check that each use fits the licence, or obtain separate written permission.
  5. Attribute the work with its title, author, source URL, and licence information, as YouTube instructs.
  6. For a continuous stream, ask the rights owner about Content ID allowlisting if the material is licensed and could trigger a match. Keep the licence and permission evidence available.
  7. If the rights chain or licence terms remain unclear, request written permission specifically covering continuous public streaming, monetisation, territory, and any planned edits.
