A UGC business creates videos, photos, or other content that brands can publish on their own channels or use in advertising. You can start by choosing a format or niche, making a small portfolio of sample work, and approaching brands with a clear offer. Your follower count may matter less for production-only UGC than for sponsored posts to your own audience; the deliverables, usage rights, deadlines, payment, and disclosure obligations still need to be clear.

What is a UGC business?

A user-generated content (UGC) business provides brands with content made by a creator. The brand may post the finished asset on its own social accounts or use it in advertising. In a production-only arrangement, the brand is paying for usable content, not necessarily access to the creator’s audience. That makes portfolio quality, suitability for the brief, and the agreed rights central considerations.

“UGC” can also describe a creator’s sponsored post on their own account. These arrangements are not interchangeable: the posting obligation, audience access, advertising permissions, and disclosure responsibilities can differ. TikTok for Business identifies branded content and Spark Ads as commercial UGC formats, and notes that creators can grant advertising authorization. Its resource does not set standard deal terms or rates: TikTok for Business’s UGC resource.

A single job can combine these types. List each obligation separately instead of assuming that a content fee automatically includes posting or unlimited advertising use.

How do you start a UGC business?

1. Choose a manageable format or niche

Pick a format you can make consistently, such as short product demonstrations, tutorials, or testimonial-style videos, and a subject area that suits your interests and experience. Treat this as a starting focus, not a promise that brands in the niche will hire you. A brand needs to be able to see what you can deliver and how it might use it.

2. Make a small portfolio of samples

Create sample content that demonstrates your intended style and deliverable. Identify it clearly as sample work; do not imply a brand commissioned it, approved it, or that you personally used a product if you did not. If you do make an endorsement, FTC guidance says endorsers should not claim experience with products they have not tried.

A portfolio can explain the format, intended audience or use, and what you would deliver. You do not need to make a numerical earnings claim or present a follower count as the main proof of production ability. If a client asks for examples involving its product, agree on whether the work is a paid job, a sample, or a collaboration before making claims about the relationship.

3. Define what you are offering

Describe deliverables in concrete terms: for example, the type and number of assets, format, length or orientation if relevant, deadline, and included revision rounds. Say whether you will post anything on your own account. State the proposed usage separately, including organic posting, paid advertising, platforms, duration, and any exclusivity. These details let both sides judge the scope before work begins.

4. Find suitable brands and make a specific approach

Look for brands whose products and audience fit the content you can actually make. Send a concise introduction, a relevant portfolio link, and a clear proposal for the deliverable. Ask what the brand needs, where it plans to use the content, and when it needs it. Do not promise reach or results you cannot substantiate. A brand may be interested in production, posting, or both; confirm which before agreeing to a fee or schedule.

5. Confirm terms before production

Put the agreed scope in writing, including deliverables, deadline, revisions, payment timing, permitted use, advertising permission, exclusivity, cancellation, and any personal-account posting. Written terms help prevent a mismatch between a creator who quoted for making an asset and a brand that expects to use it in paid ads or receive additional versions. This is practical planning, not a universal contract form; the government guidance cited here does not establish a UGC-specific contract standard. For legal questions about rights or enforceability, seek advice for your jurisdiction.

How should you price UGC work?

There is no authoritative, representative UGC rate benchmark in the sources cited here, so a single “standard” beginner rate or typical earnings figure would be misleading. Build a quote from the actual work and permission requested, then decide whether the scope fits your costs and capacity.

  1. Define the deliverable. List the content type, quantity, format, and delivery date.
  2. Estimate production effort. Account for planning, filming or creation, editing, and communication.
  3. Set the revision scope. State how many rounds are included and how changes beyond that will be handled.
  4. Specify usage rights. Distinguish organic brand posting from paid ads; name the channels and duration, and address exclusivity and advertising authorization.
  5. Price additional work separately. Consider whether alternate versions or raw footage are requested and whether they are included.
  6. Write down payment timing. Confirm when payment is due and what happens if the project is cancelled or its scope changes.

Do not treat isolated community posts as a representative rate card. A quote is a scope-and-cost decision for a particular project, not evidence of what all creators earn.

What should a UGC agreement cover?

Before creating the work, record the points below in a written agreement or an equally clear written confirmation. The specific legal effect of a rights clause can vary by jurisdiction; the list is a planning checklist, not a substitute for legal advice.

  • Deliverables: number and type of assets, formats, and delivery method.
  • Schedule: milestones, feedback deadline, and final delivery date.
  • Revisions: included rounds and how requests outside the agreed scope will be addressed.
  • Fee and payment: amount, due dates, and payment timing.
  • Usage: the channels, duration, and manner in which the brand may use the finished work.
  • Paid advertising: whether ads are permitted, what authorization is needed, how long it lasts, and whether the creator’s account or identity is used.
  • Exclusivity: whether the creator is restricted from working with competitors and, if so, the defined scope and period.
  • Cancellation and changes: what happens if either party cancels or asks for work beyond the original brief.
  • Posting: whether the creator must publish on a personal account, or only deliver content to the brand.
  • Disclosure: who is responsible for required disclosures when content is published and where they will appear.

Do not assume that payment alone settles who can use the finished work, for how long, or in which advertising formats. Make those permissions explicit.

What disclosures and platform rules apply?

FTC guidance for U.S. endorsements

For U.S. readers, the Federal Trade Commission says endorsements should be truthful and not misleading. An endorser should not claim experience with a product they have not tried, and material connections to a brand should be disclosed. The FTC describes its Endorsement Guides as guidance rather than regulations themselves, and says noncompliance may lead it to investigate conduct under the FTC Act. Its guidance puts the core point simply: One key is to make a good disclosure of your relationship to the brand. See the FTC’s Endorsements, Influencers, and Reviews guidance.

Payment, free or discounted products, and other perks can be material connections. When you publish an endorsement, put a clear disclosure with it where it is hard to miss; do not hide it in a profile, behind a “more” link, or among hashtags. TikTok’s disclosure setting

TikTok says creators must turn on its content disclosure setting when a post promotes a brand, product, or service, including promotion of their own business. TikTok says a post may be removed or restricted if the required disclosure is missing. Check TikTok’s current instructions for promoting a brand, product, or service when publishing, because platform controls can change.

When a brand wants to run content as an ad, confirm the advertising authorization and its duration rather than assuming that ordinary delivery or a sponsored-post disclosure grants the required permission. TikTok’s commercial-content formats and authorization controls are described in its UGC resource.

Outside the United States

FTC guidance is U.S.-focused, and U.S. state and local rules may also matter. Other countries have their own requirements. For example, the UK Competition and Markets Authority publishes guidance for brands on social media endorsements, updated 28 August 2025. That source is directed at brands; creators should check the rules and platform terms applicable where they live, work, and publish rather than treating U.S. guidance as universal.

What taxes and records should U.S. creators consider?

The IRS treats creative or professional services as possible gig work. Its guidance says gig income must be reported even if the work is part-time or temporary, or no Form 1099 was received. Keep records of income and receipts for expenses. Certain independent contractors may need to make quarterly estimated tax payments. The IRS says net self-employment earnings of $400 or more require filing a return for gig work; that threshold is a filing rule in the IRS’s gig-work guidance, not a recommended income target or a complete tax calculation. The IRS’s Topic 554 describes self-employment tax as Social Security and Medicare taxes. It states rates of 12.4% for Social Security and 2.9% for Medicare, while noting an annual Social Security wage base and possible additional Medicare tax. Those rates do not, by themselves, calculate a creator’s full tax bill; tax rules and applicable limits can change. See IRS Topic no. 554, Self-employment tax. This section covers U.S. federal guidance only. State and local obligations depend on where you live and work, and creators outside the United States need tax guidance for their own jurisdiction.
