A federal court entered the judgment by default on September 15, 2026, after the defendants failed to participate in the case. The judgment concerns Fundsz, an unincorporated entity promoted as a digital-asset and precious-metals trading operation.
What was the Fundsz crypto scam?
Fundsz solicited contributions for purported trading in digital assets and precious metals. In its July 2023 complaint, the CFTC alleged that the operation used false investment claims to attract participants. The court’s 2026 judgment against Early and Kingrey found that they promoted fictional returns and misrepresented the operation’s trading and risks.
According to the judgment, Early and Kingrey served on Fundsz’s advisory board and moderated the Telegram group used to communicate with participants. They promoted purported average weekly returns above 3%, claimed Fundsz used a proprietary algorithm, and understated investment risks. They also cited seven years of timely and accurate payments even though Fundsz had existed for a shorter period, and promised withdrawals with interest after 180 days. The court found the reported returns were fictional and that Fundsz did no trading in many weeks. It found that the defendants knew their statements were false or acted with reckless disregard, without investigating their truth. The CFTC’s September 30, 2026 release summarizes the outcome; the court’s September 15, 2026 judgment sets out the findings.
What the original complaint alleged
The CFTC’s August 2023 announcement said its complaint alleged that Fundsz advertised returns above 3% each week and claimed a one-time $2,500 contribution could grow to $1 million in 48 months without further deposits. The agency also said the complaint alleged Fundsz did not trade customer funds and reported fictional weekly returns. Those were allegations in the original complaint; the 2026 default judgment’s findings addressed Early and Kingrey. How much did Fundsz participants lose?
The judgment states that Fundsz had more than 10,000 participants and that 9,138 participants lost a total of $15,732,455.40. These are figures in the court’s September 15, 2026 judgment. The restitution order against Early and Kingrey is $15,732,455, rounded down from the loss figure stated by the court.
The CFTC’s 2023 complaint announcement had described more than 14,000 participants. That earlier allegation and the later judgment’s figures come from different documents and should not be treated as the same count.

What did the court order?
The default judgment against Early and Kingrey totals $31,484,910. It includes restitution and a civil monetary penalty, and permanently bars both from further violations charged in the case, registration, and trading.

The CFTC also reported separate consent orders concerning Rachel Larralde, personal representative of Rene Larralde’s estate, and Juan Pablo Valcarce. The estate representative was ordered to relinquish rights in a residence Rene Larralde bought with investor funds, along with more than $2.7 million in other assets, to the court-appointed receiver. Valcarce was permanently enjoined and received permanent registration and trading bans. The agency says these orders resolved all remaining claims in the action. Why was the judgment entered by default?
A default judgment is not the same as a judgment entered after a contested trial. In this case, the court struck Early and Kingrey’s answers after they failed to participate, make initial disclosures, and respond to discovery. The court then reviewed the well-pleaded allegations and evidence. It explained that a default admits well-pleaded facts, but not legal conclusions, and entered judgment on the claims it found supported.

The judgment orders restitution, but that does not establish that participants have already received money or will recover the full amount. The CFTC warns that defendants may not have enough funds or assets to repay victims. The CFTC’s published announcement does not state how much, if anything, has been distributed under these orders.
