Florida’s Office of Insurance Regulation (OIR) suspended Atlantic Coast Life Insurance Company’s authority to operate in Florida effective Oct. 1, 2026. The order halts new and renewal Florida business, but OIR says the company must continue servicing policies already in force in the state. It does not automatically cancel those policies or determine the coverage or timing of any individual claim.
Did Florida suspend Atlantic Coast Life?
Yes. On Oct. 1, 2026, Florida OIR issued an Immediate Final Order suspending Atlantic Coast Life’s Florida certificate of authority (COA), effective immediately. OIR said it found the insurer impaired and cited rehabilitation proceedings initiated by the South Carolina Department of Insurance, Atlantic Coast’s domestic regulator, which had petitioned a court to place Atlantic Coast and a subsidiary into receivership for rehabilitation. Florida OIR’s Oct. 1 notice identifies Florida Statute 624.418 as authority for immediate suspension in specified circumstances, including an impairment or insolvency finding, or delinquency proceedings initiated by another state’s insurance supervisor. It also refers to the agent notice provision in section 624.420.
OIR said the order was issued “to protect current and prospective policyholders.” The suspension applies to Atlantic Coast’s authority to do business in Florida; the notice does not establish that the company’s authority elsewhere has been suspended.
Can Atlantic Coast Life still sell or renew policies in Florida?
No. Under the Florida notice, Atlantic Coast must stop acting or holding itself out as an insurer in Florida and stop soliciting or accepting new or renewal Florida business. The order’s effect on new business is distinct from its treatment of policies that were already in force.

Are existing Atlantic Coast Life policies canceled?
The Florida notice does not say that existing Florida policies are automatically canceled. It says Atlantic Coast must continue servicing all Florida in-force policies and honor its liability for losses and unearned premiums for as long as those liabilities continue to exist. It also requires continued statutory filings until the company certifies, and OIR confirms, that Florida claims, liabilities, and obligations have been paid or settled.
That servicing requirement is not a promise about how quickly a particular claim will be paid, nor does it decide whether a specific loss is covered. Check the policy terms and follow current instructions from the company and regulators for account-specific questions.

What does “impaired surplus” mean in this case?
Surplus is an insurer’s financial cushion—assets over liabilities under applicable accounting rules. “Impaired surplus” reflects a regulator’s assessment that the insurer falls short of required financial standards. In this case, reported surplus and impaired surplus are different measures: Florida’s limits on investments in subsidiaries and affiliates affected the regulator’s impairment calculation.

How many Florida policies are affected?
Insurance Journal reported that OIR figures showed 6,001 annuity policies, 986 life policies, and 19 accident and health policies in Florida as of August 2026. It also reported nearly $13 million in Florida premiums collected year to date in the order’s reporting. Contract counts do not necessarily represent distinct people, and they do not establish what any individual may recover through a guaranty association.

What should Atlantic Coast Life policyholders do now?
- Keep your policy and related statements accessible, and review the contract’s terms and contact details.
- Use current regulator or company instructions for questions about a claim, premium, beneficiary, annuity, or other policy-specific matter.
- Do not infer from Florida’s suspension alone that you should cancel, surrender, replace, or stop paying a policy. The notice does not direct policyholders to take those steps.
- Check for later notices or court orders before relying on this status. Florida’s action and South Carolina’s rehabilitation proceedings are update-sensitive.
What Atlantic Coast Life and regulators have said
Atlantic Coast is domiciled in South Carolina and became authorized to do business in Florida in 2006, according to Insurance Journal. The publication reported that its Florida business was focused mostly on annuities and that the company is part of Advantage Capital Holdings (A-Cap).
In a statement reproduced by Insurance Journal, Atlantic Coast said it disagreed with Florida OIR’s action and intended to work to resolve the matter, while focusing on policyholder obligations and capital-raise and restructuring initiatives. That is the company’s position, not an independent assessment of its ability to meet obligations or complete those initiatives.

The status can change through later regulatory or court action. The available account establishes the Oct. 1 Florida suspension and reports South Carolina’s rehabilitation petition; it does not establish what the South Carolina court subsequently ordered or whether later policyholder instructions were issued.
