For filings with the Georgia State Board of Workers’ Compensation, generative AI use must be disclosed, and the filer must personally review the entire document and verify every citation. AI-created or AI-modified evidence must also be disclosed when submitted. The Board’s standing order took effect August 26, 2026.
What the Georgia Board’s AI order covers
The Board’s “Directive of the Board regarding use of Artificial Intelligence and Certification of Citations in Filings” applies to briefs, motions and other written submissions filed with the Board. It took effect immediately on August 26, 2026, according to Brandon H. Wilson’s September 17, 2026 article for Hall Booth Smith, which links to the standing order PDF.
Wilson describes covered use as relying on generative AI to draft, summarize, edit, verify or analyze legal or factual content in a filing. Ordinary spell-check and grammar features embedded in word processors are excluded from that definition. The distinction is about the function used: generative assistance with the substance of a filing is covered, while routine embedded proofreading is not.
What to certify when filing
Attorneys and unrepresented parties must include the certification that matches how the document was prepared. The order’s certification language is reproduced in Wilson’s article; the quotations below are attributed to the order as reproduced there.

If generative AI assisted with the filing
The certification says:
This document was prepared with the assistance of one or more AI tools. I certify under penalty of perjury that, despite reliance on an AI tool, I have independently reviewed the entire document to confirm accuracy, use of relevant and applicable law, and assertion of relevant and applicable legal theories.
I further certify under penalty of perjury that every citation to law, case, statute, rule, or the record in this document has been verified by me and is accurate and exists as cited and is reasonably believed by me to stand for the proposition cited.

This is a personal responsibility, not a check that can be delegated to the AI system. A generated case summary is not enough: check the underlying authority, confirm that the cited law or record material exists as cited, and ensure it reasonably supports the proposition in the filing.
If no AI tool or platform prepared any part

Choose the certification that truthfully describes the document. The AI-assisted statement also requires independent review of the whole filing and personal verification of citations.

AI-generated or AI-modified evidence has a separate disclosure rule
Evidence created or modified using AI must be disclosed when submitted, according to Wilson’s account of the order. Examples of AI-connected evidence include reconstruction videos and expert-analysis tools. The key issue is whether AI was used to create or alter the evidence, not whether the filing’s text was AI-assisted.
Wilson contrasts disclosed AI-generated evidence with deepfake videos, fabricated receipts and manipulated photos presented as though they were AI-free. The article describes acknowledged AI-generated evidence as permissible, but says undisclosed AI-connected evidence presented as unaltered is prohibited.
Potential consequences—and what is not established
Wilson reports that the order allows civil penalties of $100 to $1,000 per violation and that unacknowledged AI-generated evidence could also prompt referral to the Board’s Criminal Investigation Division. The article says mistake, lack of expertise or time constraints are not accepted as good-faith excuses.
The cited article does not identify an adjudicated penalty or establish that sanctions have already been imposed under this order. The reported range and possible referral describe potential consequences, not a documented enforcement outcome.
A practical filing check
- Identify covered AI use. Determine whether generative AI drafted, summarized, edited, verified or analyzed legal or factual content in the filing. Routine embedded spell-check or grammar features are excluded as described by Wilson.
- Select the truthful certification. Include the AI-assisted certification if AI helped prepare any part; use the no-AI certification only if no part was prepared using AI tools or platforms.
- Review the complete document yourself. Check accuracy, relevant law and legal theories rather than relying on an AI tool’s assurance.
- Verify every citation. Confirm each authority and record citation exists as cited and reasonably supports the proposition for which it is used.
- Disclose AI-connected evidence. If evidence was created or modified using AI, identify that use when submitting the evidence.
