None should be mistaken for another: the allegations are not criminal findings, and university discipline is not a criminal conviction.
What does Jane Doe allege happened?
In a civil lawsuit filed in September 2026, a woman identified in court documents as Jane Doe alleges that she was drugged and sexually assaulted in October 2024 at the Chi Phi fraternity house at Cornell University. Reuters reported that the suit names seven former fraternity members, the fraternity, Cornell, a local bar, and her sorority. The claims are allegations, not findings by a court or a criminal jury.
Her account of the night
According to the complaint, Doe was 20 and went to the house on October 19 after drinking earlier. She alleges that she was given alcohol, marijuana, and ketamine, became incapacitated, and was assaulted by seven men.
A CBS account of her police interview and school records describes a more specific chronology: Doe said an initial sexual encounter with two men was acceptable to her, but that she became uncomfortable as events changed and more men entered the room. She described thinking that if she passed out after taking ketamine, the men could be charged with rape. The lawsuit says she lost consciousness at about 5:45 a.m. These details are attributed accounts of the evening, not independent findings about what occurred.

Why were no criminal charges filed in 2024?
Report to Cornell police
Doe reported the incident to Cornell police on November 8, 2024. Reporting on the interview transcript says she told investigators, “I can say with 100% confidence I was raped.” Reuters reported that this sentence did not appear in the shorter sworn statement later sent to Tompkins County District Attorney Matthew Van Houten’s office.
The district attorney’s decision
The DA did not file charges in 2024. The Associated Press reported that Van Houten relied on a statement prepared by campus police and signed by Doe; he did not receive the full interview transcript or speak with her directly. He said the statement did not include her assertion that she was certain she had been sexually assaulted, or allegations that she had been drugged against her will or forced into sex acts. Van Houten defended his decision not to seek additional evidence. His explanation and the later reporting about the interview transcript describe different parts of how the decision was made; neither is itself a court ruling on the allegations.

What did Cornell’s disciplinary process decide?
Cornell conducted a university investigation separate from the criminal process and suspended Chi Phi and some students after the report. The Associated Press reported that the inquiry included 50 interviews with 32 witnesses, 12 days of hearings, and a 99-page panel report. The university said some students were expelled or suspended but has not disclosed individual outcomes, citing privacy laws. The Chi Phi chapter remains barred from campus.
At a university hearing in May 2025, Doe described the experience as: “I felt like bait. I felt like lions around me. It just was a totally debilitating place to be in,” according to the AP. Cornell’s findings and sanctions belong to its campus process; they do not establish criminal guilt.

What is the status of the criminal investigation?
After renewed attention to the case, the Tompkins County DA reopened the criminal investigation. Reuters reported on October 2, 2026, that Gov. Kathy Hochul had appointed New York Attorney General Letitia James as special prosecutor. Reuters reported that no criminal charges had been filed as of that date. An investigation being reopened and a special prosecutor being appointed do not mean charges have been filed.

Cornell said it supported reopening the criminal investigation and cited the discipline imposed through its own process. Hochul also called for an outside review of Cornell’s handling of the matter and campus culture, saying, “No student should ever be left wondering whether the institutions meant to protect them will listen and act,” as reported by the AP. The available reporting does not establish the review’s full scope, timetable, or findings.

How should the different proceedings be understood?
- Civil lawsuit: Doe is seeking a civil legal remedy from the defendants she named. The complaint presents her allegations; filing it does not prove them.
- Criminal investigation: Investigators and prosecutors assess whether criminal charges are warranted. Reopening an investigation is not the same as filing charges, and a charge would not itself be a conviction.
- Cornell discipline: The university can impose campus sanctions under its own process. Those sanctions are not criminal judgments.
- Outside review: The governor’s call for a review concerns Cornell’s institutional handling and campus culture; its mandate and outcome have not been established in the reporting cited here.
