As of October 3, 2026, the two trials arising from the October 2021 Lakhimpur Kheri violence were at markedly different stages. Hindustan Times reported that all 87 witnesses in FIR 220/2021 had testified and final arguments were about to begin. FIR 219/2021, concerning the convoy deaths, still faced unresolved witness-examination issues and renewed Supreme Court scrutiny of the prosecution and complaints about the trial judge. Neither trial had concluded in the sources available for this update.
What the two Lakhimpur Kheri cases concern
On October 3, 2021, a vehicle convoy incident in Tikunia, Lakhimpur Kheri, killed four protesting farmers and a journalist. Violence that followed killed three more people. The two FIRs arising from the events concern different allegations and groups of accused; progress in one does not determine the result of the other.
- FIR 219/2021: Filed in connection with the convoy deaths, it names Ashish Mishra and others as accused.
- FIR 220/2021: Filed after a complaint by BJP leader Sumit Jaiswal, it concerns allegations against farmers following the violence.
How far had each trial progressed?
The latest figures available come from different dates and sources, and the witness counts should not be treated as a single continuous tally. The Supreme Court’s December 2025 order records the status reported to it at that time; the later figures below are from Hindustan Times on October 3, 2026.

The December 2025 figures for FIR 220/2021 refer to 35 proposed witnesses, while the 2026 news report gives a total of 87 witnesses. The sources do not explain the difference, so those counts should be read as separate dated snapshots rather than reconciled into one total.

Earlier snapshot for FIR 219/2021
A separate Supreme Court order dated October 9, 2025 recorded a different stage in FIR 219/2021: 23 prosecution witnesses examined, nine discharged, two unserved, and others summoned. These October and December figures are separate court-recorded snapshots; they should not be combined into one cumulative count.
Why the Supreme Court returned to FIR 219/2021
In its October 3, 2026 account, Hindustan Times reported that the Supreme Court directed Uttar Pradesh to replace public prosecutor PB Mishra with a senior prosecutor experienced in trials, within two weeks. The report said the direction followed concerns raised about witnesses being given up. The Court was quoted as asking: “What is unusual is that on a given date when the witnesses are called, why should the public prosecutor give up those witnesses. They are eyewitnesses. This may not be a very fair prosecution if the PP (public prosecutor) gives up on witnesses.”

The same report said the Court sought a report from the Allahabad High Court Chief Justice about complaints concerning the presiding judge. The Indian Express had reported on September 23, 2026 that the Court directed the Chief Justice to examine victim-family concerns and report on action taken, while directing the State to identify a senior, experienced prosecutor. These are reported court directions; the accounts do not establish that the judge or prosecutor committed misconduct.
Hindustan Times also recounted, through victims’ counsel Prashant Bhushan, the prosecutor’s alleged statement: “Sir, I do not want to examine all these witnesses”. That is an attributed courtroom account, not a transcript in the sources cited here. Allegations raised by advocates about witness intimidation, medical exemption, intimidation of relatives and prosecutorial conduct likewise remain allegations, not findings of fact.

A separate investigation into an alleged threat
The Supreme Court’s October 9, 2025 order recorded that FIR 658/2025 had been registered after a complaint alleging threats to a witness. The Court said the investigation was ongoing and asked for a further status report. In its December 11, 2025 order, it noted that relevant witness statements had been recorded and that a forensic report concerning the alleged threat was awaited. The orders do not establish that a threat occurred.
What the record says about the trial court’s workload
In the December 11, 2025 order, the State’s senior additional advocate general told the Supreme Court that 789 trials were pending before the same presiding officer. That was counsel’s submission recorded by the Court on that date, not an independently audited or current caseload figure.

What the contrast means—and what it does not
On the October 2026 account, FIR 220/2021 was the closer of the two cases to a decision point: its witnesses had testified and final arguments were expected to start. FIR 219/2021 remained in a more contested procedural position, with witness attendance and examination at issue and reported Supreme Court directions concerning the prosecutor and complaints about the judge. Final arguments are not a verdict, and neither the different pace nor the allegations raised in court establish guilt or misconduct.
The figures in this update are case-specific. The Supreme Court’s orders dated October 9 and December 11, 2025 establish what was recorded at those points; the later witness and hearing developments are attributed to Hindustan Times and, for the September court directions, The Indian Express. The 2025 orders predate the October 2026 reports and do not independently verify those later accounts.
