India’s Directorate General of Civil Aviation (DGCA) already has a statutory basis, but it remains administratively an attached office of the Ministry of Civil Aviation. A proposal described in a 3 October 2026 Hindustan Times editorial would create a more autonomous Civil Aviation Authority, with its own law, funding and hiring control. That could help address staffing and institutional constraints—but only if appointments, board membership and funding are designed to protect the regulator from the industry it oversees.

What does the DGCA do?

The DGCA regulates civil aviation safety and air transport in India. Its responsibilities include formulating and enforcing civil aviation rules, setting and overseeing airworthiness and safety standards, licensing and certification, and supervising operators. The Ministry of Civil Aviation says its remit covers air transport services operating to, from and within India, with standards aligned to International Civil Aviation Organization standards and recommended practices.

The DGCA’s official About Us page describes it as “an attached office of the Ministry of Civil Aviation.” The Ministry’s 2025–26 annual report also calls it a statutory authority under section 3 of the Bharatiya Vayuyan Adhiniyam, 2024. These descriptions address different things: the statute provides its legal basis, while “attached office” describes its administrative placement. Neither means the DGCA already has the separate governance, budget control or staffing arrangements proposed for a new authority.

Why is greater autonomy being proposed?

A Department-related Parliamentary Standing Committee on Transport, Tourism and Culture reported in March 2026 that the DGCA had 843 employees against 1,630 sanctioned posts—48.3% vacancies. That is the committee’s reported staffing snapshot, not a live headcount for every date since. The committee’s report summary also cited recurring defects in 377 of 754 audited aircraft and called for an independent high-level aviation safety committee. The figures signal oversight concerns; they do not establish that vacancies caused any particular defect or accident, and the reported defects need not have been equivalent in severity.

The committee’s release also referenced the Ahmedabad crash, approximately 100 safety lapses in a single year and 19 safety violation notices as context for its recommendation. Those are the committee’s stated figures and framing, not proof of a causal link between staffing levels and a specific event.

The Hindustan Times editorial argues that a ministry-attached regulator faces structural constraints and that a new authority could have more control over hiring, pay and resources. It describes a proposed Civil Aviation Authority with its own law, an Aviation Safety Fund, direct hiring authority and five-year leadership tenure. The editorial also reports that the fund might receive some support from a possible ₹15 levy on departing passengers. These are proposal details as reported by the editorial, not enacted arrangements; the sources available here do not establish that the authority or levy has been adopted.

What would meaningful independence require?

Changing the regulator’s name or legal form would not, by itself, settle whether it can act independently. The proposal should be assessed across several connected design choices:

  • Legal mandate: The law should define the authority’s safety and regulatory responsibilities clearly, including how its powers relate to the existing aviation framework.
  • Budget and hiring control: The authority needs the ability to recruit and retain qualified staff and fund its work predictably. The committee’s vacancy figure makes staffing an immediate capacity issue, not only a long-term governance question.
  • Leadership appointments and tenure: The appointment process should be transparent, with clear responsibility for selecting senior leaders. The editorial warns that opaque appointments could undermine independence; it reports a proposed five-year tenure but does not establish a final appointment design.
  • Board composition and conflicts: The editorial argues that airlines should not sit on the regulator’s governing board because they are regulated entities. It suggests industry input could instead be advisory. This is a proposed safeguard against conflicts, not evidence that a particular board has been captured.
  • Enforcement and accountability: The authority needs effective enforcement powers alongside public accountability and audit. Independence should mean freedom from improper influence, not freedom from scrutiny.

How should the regulator be funded?

The editorial questions a system in which penalty income funds the regulator that imposes those penalties: such a link could create an incentive problem, even if enforcement decisions were made properly. Its suggested safeguard is to direct penalties to the Consolidated Fund of India and fund the authority through levies and fees instead. It also describes a possible passenger levy for an Aviation Safety Fund. These are editorial recommendations and reported proposal details, not established policy.

Whatever funding model is chosen, the key test is whether it gives the regulator dependable resources without rewarding it for issuing more penalties or making it financially dependent on the companies it supervises.

Why separate accident investigation from regulation?

India’s aviation system already distinguishes some safety functions institutionally. The Ministry says the Aircraft Accident Investigation Bureau (AAIB) was established separately from the DGCA to provide independence between accident investigation and regulation. Under the AAIB’s stated mandate, it investigates occurrences classified as accidents; the DGCA handles certain incidents and serious incidents, and the AAIB may take on some of those cases. This separation illustrates one way to protect a function from conflicts, but it does not determine how the wider regulator should be governed.

What should happen before a new authority is created?

The editorial argues that legislation should not become a reason to postpone filling current vacancies. That is a practical distinction: staffing action can address immediate capacity needs, while lawmakers work through the more complex questions of funding, appointments, board composition and accountability. A new statute may provide a stronger framework, but its value will depend on the powers and safeguards it actually establishes.
