No Switch console is required to use a Steam Deck. Whether a particular Switch emulator and the way you obtain or use game files are lawful is a separate, fact-specific question. In the United States, consider three issues separately: the emulator software, the source of the game files, and whether using the setup circumvents technological protections. This is general information, not legal advice; laws differ by country.
Is Switch emulation on Steam Deck legal?
There is no single answer that applies to every emulator, game file, and user. An emulator is software that runs software on a different device, but the emulator itself is only one part of the legal picture. The source of game files and any circumvention of technological protections can raise separate issues.
Emulator software and game files are separate questions
Nintendo of America’s support FAQ says some unauthorized emulators circumvent security measures and are unlawful. Nintendo also separately addresses unauthorized game copies. Its FAQ states: “The uploading and downloading of pirate copies of Nintendo games is illegal.” That is Nintendo’s stated position; the FAQ is not a neutral court ruling that resolves every possible emulator or use.
U.S. anti-circumvention law has a general rule and limited exemptions
The U.S. Copyright Office explains that section 1201 of the Digital Millennium Copyright Act generally prohibits circumventing technological measures used to prevent unauthorized access to copyrighted works, including video games and computer software. The law also provides for limited, temporary exemptions for specific classes of noninfringing uses through a triennial rulemaking process. The existence of that process does not make every personal backup or method of obtaining game files exempt; whether a particular use qualifies depends on the facts and applicable law.

What the Yuzu judgment did—and did not—decide
On March 4, 2024, a U.S. district court entered a final judgment and permanent injunction against Tropic Haze LLC, the defendant associated with Yuzu. The judgment restricted the defendant and specified associated parties from trafficking in Yuzu and covered circumvention software and materials, including materials involving unauthorized cryptographic keys and covered emulation of Nintendo games.
That was a case-specific judgment and injunction. It should not be read as a court ruling that every emulator, or every act of emulation by an individual user, is unlawful.

Do you need a Switch console to use a Steam Deck?
No. Valve describes Steam Deck as a handheld gaming computer running SteamOS. You do not need a Switch simply to own or use the Deck. That does not establish that a particular Switch emulator is available, works with a particular game, or is lawful to use.
A Switch console is an optional route for people who want Nintendo’s official hardware, games, platform features, and services. Buying one does not by itself settle whether copying, decrypting, or otherwise obtaining game files for use elsewhere is lawful.

Why your country matters
The legal explanation here is U.S.-focused and draws on the U.S. Copyright Office’s section 1201 overview, Nintendo of America’s support FAQ, and the March 2024 U.S. judgment in Nintendo of America Inc. v. Tropic Haze LLC. Those sources do not establish how another country treats emulators, personal backups, or circumvention. For a decision about your own conduct, check the law in your jurisdiction or consult a qualified lawyer.
