Washington Attorney General Bob Ferguson filed a state Consumer Protection Act lawsuit against T-Mobile on January 6, 2025, alleging that the company failed to adequately protect customer data exposed in its 2021 breach and did not give some Washington consumers complete, accurate notice. The state seeks civil penalties, restitution, and court-ordered cybersecurity and disclosure improvements.
What information did T-Mobile expose, and how many Washington residents were affected?
The Washington Attorney General’s office says the breach exposed information belonging to more than 79 million consumers nationwide, including 2,025,634 Washingtonians. Of those Washington consumers, 183,406 had Social Security numbers compromised.
Other exposed information included names, phone numbers, physical addresses, driver’s-license information, and other personal data. The information compromised was not identical for every affected person.
When did the breach happen?
The Attorney General’s account says the intrusion began in March 2021 and continued until August 12, 2021, when an outside source reported that customer data was being offered for sale on the dark web. T-Mobile’s SEC filing gives a more specific account: the company became aware of unauthorized access on August 12, its investigation traced access to about March 18, and it found that data was taken beginning around August 3.

These dates describe different stages of the incident: the period of unauthorized access, the period when data was taken, and when T-Mobile learned of the breach.
Why is Washington suing T-Mobile?
The complaint alleges that T-Mobile violated Washington’s Consumer Protection Act through inadequate security and deficient communications about the breach. Among the alleged security failures were not addressing known vulnerabilities and allowing weak or obvious credentials. The state also alleges that T-Mobile made misleading public assurances about security and that some breach notices were incomplete or downplayed the incident.

These are allegations in the state’s complaint, not findings that T-Mobile is liable.
What does the state want the court to order?
Washington seeks:
- Civil penalties for alleged Consumer Protection Act violations.
- Restitution for Washingtonians who were harmed.
- Injunctive relief requiring stronger cybersecurity policies and procedures, along with more transparent communications about cybersecurity incidents.
How is the Washington lawsuit different from the $350 million settlement?
