Before buying a newly launched crypto token, verify what the token gives you, who is responsible for it, what its contract and audit actually cover, and whether you could realistically resell it. Also assess the offering under the laws that apply where it is sold. These checks can expose unanswered questions and warning signs; they cannot prove that a token is safe or will rise in value.
1. What exactly are you buying?
Start with the token’s rights and purpose, not its name, ticker, advertised price, or promised utility. The SEC’s Investor Bulletin advises prospective buyers to review an offering’s business plan, white paper, roadmap, intended use of funds, and any limits on resale or refunds. Treat those materials as the issuer’s claims, not independent confirmation that the project can deliver.
Identify the token and network
- Find the official contract address and blockchain network using sources you can verify independently. A token name or symbol alone may not identify the asset you intend to buy.
- Check that the address and network match across the project’s official offering materials and other reliable records before interacting with a contract.
Understand the rights and economics
- Ask what holding the token entitles you to, if anything: access to a service, a claim against an issuer, a governance role, or only a hoped-for future use.
- Find out what the project says it will do with sale proceeds and whether the proposed use creates a credible reason for people to want the token. Intended utility is not proof of adoption or demand.
- Look for refund conditions, lockups, vesting schedules, and resale restrictions. A buyer may have no practical way to recover funds if the project fails or the token cannot be resold.
2. Who is making the claims, and what can you verify?
Identify the issuer, promoters, named affiliates, and each party’s stated role. Check whether their identities, experience, and past work can be corroborated through attributable, independent records. The CFTC warns that difficulty finding information about named affiliates is a red flag.
An anonymous or hard-to-verify team does not by itself prove fraud, but it limits your ability to assess who is accountable for the claims. A polished website, active social accounts, or endorsements do not establish that a product exists or that the people behind it can deliver what they promise.

3. What can the contract do, and what did an audit review?
The SEC Investor Bulletin recommends asking whether the blockchain is open and public, whether the code has been published, and whether there has been an independent cybersecurity audit. Look for evidence tied to the specific token contract and version—not merely a general security statement or an audit of a different product.
Read the scope, not just the audit badge
Check who performed the review, which contract or code version it covered, what was excluded, and whether identified issues were addressed. An audit is evidence about the reviewed scope; its existence does not guarantee that the token or its surrounding project is safe.

Check permissions in the contract
Where the contract code and documentation allow it, determine whether an owner or other role can mint more tokens, pause transfers, blacklist addresses, change transfer fees, or upgrade the contract. These are contract-specific questions: do not assume a permission exists—or is absent—without verifying the relevant code and roles.
4. Could you realistically sell the token?
Do not assume that a displayed price, a recent trade, or a statement that the token will be listed means you can sell your holdings at that price. The CFTC identifies liquidity as a factor affecting value, and the SEC advises buyers to ask whether and how a token can be resold. The DFSA has also warned that illiquid or flat markets can make trading or cashing out difficult.

- Confirm where the token is actually trading; distinguish a live market from a planned listing or an issuer’s claim.
- Look for observable liquidity and trading activity. A thin market may not support a sale of the size you hold without a substantial price change.
- Read any lockup, vesting, transfer, or resale restrictions in the offering terms.
- Consider whether a buyer would still be available if early holders began selling or promotional attention faded.
Liquidity can change, and a market price is not a promise that a particular buyer will be available when you want to exit.
5. Does the offer make legal and economic sense?
Legal treatment depends on the offering’s facts and the jurisdiction involved. In the United States, securities laws apply to securities, including crypto assets when they qualify as securities; not every token is automatically a security or automatically outside securities law.

The SEC’s crypto-asset educational page, updated in April 2026, describes investment-contract factors that include an investment of money in a common enterprise, a reasonable expectation of profits, and profits derived from the essential managerial efforts of others. If U.S. securities treatment matters to your decision, check whether the issuer’s claims about registration or an exemption can be verified in relevant records, and seek current legal advice. Rules and protections differ elsewhere; the DFSA’s statement dated 12 November 2021 concerns the DIFC framework and should not be treated as a universal or necessarily current rule for other jurisdictions.
Separately, test the project’s economic claims. A roadmap, proposed use, or promised benefit is not demonstrated adoption, and none establishes a guaranteed future token value.

6. Is the pitch relying on pressure, hype, or guarantees?
Slow down if a promoter insists you must buy immediately, presents social-media virality as proof of value, or promises high or guaranteed returns. The SEC has warned about hype-driven crypto promotions, including memecoin presales in which promoters sell before a price falls, and advises against making decisions based solely on social media. The CFTC says there is no guaranteed investment or trading strategy and advises particular caution around promises of future value.
- Verify the identity of a promoter and any urgent message through a separate, trusted channel rather than using contact details in the message itself.
- Do not send extra money to unlock a withdrawal or recover losses without independently verifying the demand. The SEC warns about false recovery and withdrawal-fee schemes.
- Be wary of claims that a token’s price can only go up or that a limited window removes the need to check the offering.
How to use the checks
Before committing funds, write down the token’s holder rights, the issuer’s verifiable identity, the contract and audit scope, resale limits, the actual trading venue, and any unresolved legal or economic questions. If a material claim cannot be independently checked, treat it as unknown rather than as a reason to trust the project. Do not invest money you cannot afford to lose; the CFTC’s guidance emphasizes thorough research and caution, not a formula for certifying a token.
