There is no single answer for every AI writing tool. A provider’s terms can allocate rights between the company and its users, but those terms do not determine whether U.S. copyright law protects a particular AI-generated passage. Under the U.S. Copyright Office’s stated position, a human must determine sufficient expressive elements for AI-assisted material to qualify for copyright protection; merely prompting a system is not enough by itself. The answer depends on the service, account, current terms, and how a person contributed to the final work.

Who owns what I write in an AI writing tool?

“Ownership” can mean two different things. First, a service’s contract may say who keeps rights in submitted material and who receives rights the provider may have in generated output. Second, copyright law independently determines whether the material is protected by copyright at all.

Those answers can diverge. A tool may promise that you own its output as between you and the provider, subject to applicable law, while copyright law may not protect expression determined entirely by a machine. And even if some output is protected, ownership language does not guarantee that it is unique, free of third-party rights, or safe to publish without review.

This article explains the U.S. baseline and two specific provider examples. It is not a universal comparison of writing tools: check the product, account type, region, current terms, and any employer or client agreement that applies to your work.

Does the AI own my writing?

For a named tool, look to its terms for the relationship between the provider and the user. The terms may say that you retain rights in what you submit, that you own generated output, or that the provider assigns to you any rights it may have in that output. Such language describes the parties’ contractual arrangement; it does not by itself establish that a generated passage qualifies for copyright.

In the U.S., copyright generally protects original works of authorship fixed in a tangible medium. It does not protect facts, ideas, systems, or methods of operation as such, though it may protect the way those things are expressed. The U.S. Copyright Office’s January 29, 2025 summary of its AI report says AI output may receive copyright protection only when a human author has determined sufficient expressive elements. Human-authored material that remains perceptible in the output, or creative arrangement or modification of generated material, can matter. Merely providing prompts is not enough by itself. AI assistance—or including AI-generated material in a larger human-authored work—does not automatically prevent protection for the human-authored contribution. As Register of Copyrights Shira Perlmutter put it in the Office’s announcement: “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection.” The Office distinguishes that from extending protection to material whose expressive elements are determined by a machine.

If the terms say I own the output, can I copyright it?

Not necessarily. A promise or assignment of rights in a provider’s output does not override the U.S. Copyright Office’s position on human authorship. If copyright protection matters, focus on what human creativity is reflected in the final work, not just the tool’s ownership clause.

  • Prompting alone: The Office says merely providing prompts does not, by itself, make the resulting output copyrightable.
  • Human contribution: Human-authored expression that is perceptible in the result, or a sufficiently creative human arrangement or modification, may support protection for that human contribution.
  • Recordkeeping: Preserve source material you wrote and keep records of substantial creative edits or arrangement. This can help document your work, but it is not a guarantee of copyright protection or registration.

The Office’s January 2025 announcement described its review of more than 10,000 responsive comments. That number reflects the scale of the Office’s process, not the frequency of AI use, disputes, or successful copyright claims. The announcement said Part 3 of its report, addressing legal implications of training models on copyrighted works, was forthcoming at that time; it does not settle that issue or later developments. What do specific AI writing tool terms say?

These examples illustrate why you need the terms for your own product, plan, and location. They are not a same-date, comprehensive comparison of all consumer and business services.

OpenAI Terms of Use revision dated October 23, 2024, for the rest of the world As between the user and OpenAI, and to the extent permitted by applicable law, users retain rights in input and own output; OpenAI assigns any rights it may have in output. The terms caution that output may not be unique and other users may receive similar output. They say content may be used to provide, maintain, develop, and improve services, and provide a way to opt out of model training. Check the current terms for your region and account.
Anthropic commercial terms for Claude API customers and Claude through Amazon Bedrock Anthropic’s December 19, 2023 announcement described commercial terms taking effect January 1, 2024 for Claude API customers and January 2, 2024 for Claude through Amazon Bedrock. The cited Bedrock terms say the customer owns outputs, subject to applicable law. The Bedrock terms say Anthropic may not train models on customer content from those services. The announcement also described a defense for certain copyright-infringement claims arising from authorized use under those commercial terms. This is not evidence about all consumer plans or a guarantee that every output is copyrightable.

Can the company use my draft to train its AI?

Do not infer data use from an ownership clause. Rights in input and output, use of content to operate or improve a service, model training, and retention controls are separate questions. The OpenAI terms cited above describe uses of content to provide, maintain, develop, and improve services and link to a model-training opt-out. The cited Anthropic commercial Bedrock terms say Anthropic may not train models on customer content from those services. These statements apply to different contexts and should not be treated as equivalent promises across every product or plan.

Before submitting unpublished, confidential, client, or workplace material, check the current terms and data controls for the account you will use. If the account is managed by your employer, review the organization’s access and administration rules too. An employer or client agreement may impose requirements beyond the tool provider’s terms.

How to check ownership before using an AI writing tool

  1. Identify the exact service and account. Confirm the product, plan, region, and whether you are using an individual or organization-managed account.
  2. Read the current terms for both input and output. Look for retained rights in submitted content, output ownership or assignment, and limits such as “to the extent permitted by applicable law.”
  3. Check data handling separately. Find the rules for service operation, improvement, model training, retention, and any available opt-out or organization-level control.
  4. Review work-related agreements. Check employer policies and client contracts before putting their material into a tool or publishing its output.
  5. Make and document human contributions. Review the generated text, add your own expression and substantive revisions where appropriate, and preserve your source drafts and records of creative edits if copyright matters.
  6. Review before publication. Check factual claims, possible similarity to other material, and third-party content. Provider terms do not make output automatically accurate or clear of rights concerns.

OpenAI’s cited terms warn that output may be inaccurate and should not be the sole source of factual information. The cited Anthropic commercial materials likewise place responsibility on customers to review output. Treat generated text as a draft, not as verified fact.
