What was the Fallout: New York browser game?
Chris First introduced a browser-playable project called Fallout: New York on September 28, 2026, according to Insider Gaming’s October 2 report. It was a fan-made game, not an official Bethesda release.
Insider Gaming described the project as having quests, dialogue trees, V.A.T.S., and a working Pip-Boy. First characterized its construction this way: “Zero texture files. Zero sound files. Every building, weapon, face and sound is generated by code.” That is the creator’s description, not an independently verified technical audit.
Why did it go offline?
Insider Gaming reported that First posted on October 1 that “the suits got involved” and shared an image described as a cease-and-desist message from ZeniMax Media’s lawyers. The report reproduced language attributed to the notice about enforcing trademarks against unauthorized uses that could cause consumer confusion or harm the brands’ goodwill. The complete notice was not independently examined, so its wording and legal claims should be understood as reported, not authenticated.

PC Gamer’s October 2 coverage also said First reported receiving a message from ZeniMax and identified the fallout.nyc domain as an IP concern. Taken together, the reports attribute the intervention to intellectual-property and trademark concerns. They do not establish that a court found infringement or that the dispute reached a legal decision. Insider Gaming said the project’s page had been privatized by the time it published its article.

It is not the separate Fallout: New York mod project
The incident involves First’s browser game, not the volunteer Fallout: New York Mod Project. The separate project’s website describes a large-scale Fallout project set in the New York area, built with the Creation Kit, and explicitly says it is not affiliated with Bethesda Game Studios. The available reporting does not say that this mod project was shut down.

- Attributed but not independently verified: The details of the alleged legal notice, including the specific trademark and consumer-confusion language.
- Not established: A court decision, a final legal finding, a further statement from ZeniMax, or whether First plans to republish the game.
Bethesda Support’s general guidance on copyright complaints involving content on Bethesda.net says complaints should come from the rights holder or an authorized agent. That policy concerns Bethesda.net content and does not establish the process used in this case.
