Shadow AI is a practical workplace term for employees using generative AI tools for work outside their organization’s approved tools or rules. It creates a governance gap: staff may submit internal documents, customer information, or other sensitive material to an external service without knowing how that provider handles it. That does not mean every prompt is made public or used to train a model; the service’s terms, retention practices, and actual data handling determine the exposure.
What is shadow AI?
Shadow AI describes work-related use of generative AI that an organization has not approved or does not oversee. The phrase is a practical workplace label, not a formal definition established by NIST or the Federal Trade Commission.
It can include asking a public chatbot to summarize a confidential report, pasting customer details into a writing assistant, or connecting an unreviewed AI service to workplace files. The central issue is not that AI is inherently unsafe. It is that the organization may not know what tools are being used, what information is being submitted, or what terms govern that information.
Can using ChatGPT at work leak company data?
It can expose company data to a third-party service if someone submits it in a prompt, uploads it, or grants an integration access to it. For example, a worker might paste an internal planning document or customer information to get a summary or draft. The FTC identifies internal documents and users’ data as examples of sensitive or confidential information customers may reveal to model-as-a-service providers (FTC, January 2024).

“Leak” should not be taken to mean that every submission becomes public or that every AI provider trains on prompts. The relevant questions are what the provider collects, how long it retains data, whether it uses data for model training or other purposes, who can access it, and what contractual commitments apply. Those details can differ by service, account type, configuration, and contract, so check the terms for the specific tool in use.
The FTC says an AI company may be liable under laws it enforces if it fails to honor privacy commitments, including promises about using customer data for training or model updates. That is not a universal legal conclusion for every country, contract, or situation; applicable duties depend on jurisdiction, industry, information, and the facts.

Why unapproved use creates a governance problem
Without an approved route and clear rules, employees may make inconsistent decisions about what is safe to share. An organization may also lack visibility into third-party integrations, retention settings, or the commitments a provider has made. NIST’s voluntary Generative AI Profile identifies potential intellectual-property, privacy, and information-security risks from third-party integrations and recommends acceptable-use policies and guidance (NIST AI 600-1, published July 26, 2024).
Shadow AI can also be a signal that workers need a supported way to do useful tasks. A blanket prohibition without practical approved options can leave staff unclear about what is allowed and where to turn. NIST’s 2026 draft guide illustrates a narrow organizational use—AI support for cybersecurity framework analysis and reporting—but explicitly is not general AI best-practices or cybersecurity guidance (NIST SP 1353, initial public draft published August 19, 2026).

How organizations can reduce shadow AI risk
1. Set plain-language rules
State which AI tools are approved, which categories of information must not be entered, and how employees can ask for guidance or report a new use case. Make the rules specific enough that staff can distinguish public material from confidential business information, customer data, and personal information. NIST recommends acceptable-use policies and guidance as ways to reduce risks from misuse or inappropriate repurposing.
2. Give staff a safe, approved route
Identify approved services and configurations for common work tasks, and explain how to request access or review for a new tool. This balances controls with the practical need to get work done; it is better than leaving employees to guess whether a consumer-facing service is acceptable.

3. Inventory services and integrations
Ask teams what AI services and connected features they use, including browser tools, plugins, and services linked to workplace files. For each third party, review data collection and use, retention, access controls, and provider commitments. NIST’s profile calls for transparency and risk management for third-party data inputs and points to procurement and vendor due diligence.
4. Classify sensitive information
Label or otherwise classify sensitive data where practical so employees and technical controls can recognize it. NIST SP 1800-39 addresses discovery and labeling of unstructured data, which can be difficult to locate and manage. It is an initial public draft, published February 12, 2026, rather than a final guide (NIST SP 1800-39).

5. Compare provider safeguards before approval
When selecting a service, compare how it handles submitted data, retention, model training or other reuse, access controls, auditability, and the clarity of its commitments. This is a practical way to apply NIST’s third-party risk guidance alongside the FTC’s warning that privacy commitments should be honored; it is not a formal NIST checklist. Record which settings and contract terms support the organization’s decision.

- Check whether the specific tool and account are approved for work use.
- Identify whether the text, file, or connected data includes confidential business information, customer data, personal information, or other restricted material.
- Read the applicable service terms and organization guidance for retention, training or reuse, and access; do not assume protections based on the tool’s name alone.
- If approval or data handling is unclear, do not submit the information. Ask the designated security, privacy, or IT contact for an approved option.
Which laws apply to shadow AI?
There is no single answer for every workplace. Legal obligations can depend on the jurisdiction, industry, type of information, provider terms, and the employer’s contracts and commitments. The FTC’s guidance describes laws it enforces and the consequences of failing to honor privacy commitments; it should not be generalized to all legal systems or circumstances. Organizations evaluating a specific deployment should seek legal review scoped to those facts.
