U.S. authorities and Taiwan prosecutors have described several recent investigations into alleged attempts to divert NVIDIA AI chips or servers containing advanced GPUs to China. The cases point to recurring tactics—including false paperwork, intermediaries, relabeling and third-country routing—but they do not establish that smuggling is increasing. The cited government releases and Associated Press report provide no comparable year-by-year counts, quantities or total values.
What the recent cases show
The public record describes multiple alleged diversion schemes involving individual GPUs as well as completed servers. Some matters remain allegations; in Operation Gatekeeper, Alan Hao Hsu and Hao Global LLC pleaded guilty. Those different procedural outcomes matter: an arrest, charge or indictment is not proof of guilt.

The figures in these cases describe different things: alleged goods in particular schemes, or assets seized in one investigation. They are not a tally of all diverted NVIDIA products, and they cannot be added together to produce a reliable estimate of total smuggling.
How the alleged diversion works
The Operation Gatekeeper allegations illustrate ways investigators say export restrictions may be evaded. DOJ described false shipping descriptions and recipient information, straw purchasers and intermediaries, and GPU relabeling in U.S. warehouses using the fictitious name “SANDKYAN.” In other matters, authorities allege that servers were routed through Southeast Asian countries before a planned or alleged onward shipment to China.

These are alleged methods in particular cases, not evidence that every export routed through those countries is unlawful. A route or paperwork irregularity can prompt scrutiny, but whether a transaction violates export law depends on the goods, parties, destination, timing and applicable rules.
Does this prove NVIDIA chip smuggling is getting worse?
No—not as a measurable trend. The cases establish that authorities have pursued several suspected diversion efforts and that the alleged conduct spans different products, routes and dates. But the DOJ releases and AP report cited here do not provide a consistent annual series of case counts, quantities or values. Nor do case-specific figures show whether undetected activity is rising or falling.

Enforcement announcements can make a problem more visible without showing that its underlying prevalence has changed. A defensible conclusion is that alleged diversion remains an active enforcement concern; the available figures do not prove it is getting worse.
Are NVIDIA H100 or H200 chips allowed to be exported to China?
There is no safe blanket answer based on the product name alone. Export-control requirements can depend on the chip or server specifications, destination, end user, intended use, transaction date and any required license. The applicable regulations and license decisions govern a particular shipment.

What the January 2026 policy announcement said
On January 13, 2026, the U.S. Department of Commerce’s Bureau of Industry and Security (BIS) said it would review license applications for NVIDIA H200, AMD MI325X and similar chips case by case if stated safeguards were met. BIS said the export must not reduce semiconductor capacity available to U.S. customers; the Chinese purchaser must have export-compliance procedures, including customer screening; and the product must undergo independent third-party testing in the United States to verify performance and security.
That was a dated, conditional review policy—not blanket authorization to export these products to China. BIS Under Secretary Jeffrey Kessler said, “Export controls should evolve with changes in technology, while protecting national security.” The announcement does not by itself resolve whether a specific product or transaction is eligible for a license.

Why the January 2025 measures are a separate point
On January 15, 2025, BIS announced expanded due-diligence and reporting requirements for foundries and packaging companies handling certain advanced chips, along with additions to the Entity List. The agency framed those measures as addressing circumvention and diversion risk. They are policy context, not a complete legal determination for every chip, destination or transaction; the rules in force for the particular export control the answer.

The cited announcements concern alleged actions by buyers, intermediaries and other participants in export transactions. They do not accuse NVIDIA itself of smuggling. The distinction is important: allegations about diversion of NVIDIA-branded technology should not be presented as evidence that the manufacturer arranged or carried out the alleged exports.

DOJ Assistant Attorney General for National Security John A. Eisenberg characterized the October 2026 case this way: “The National Security Division will protect the American advantage in the chips that power this technology, a product of our unparalleled innovation and hard work, from illegal diversion by our economic and military adversaries.” That is the department’s stated enforcement position, not an independent measure of the scale or trajectory of diversion.

How to read new announcements
- Check the procedural status. A guilty plea is an admission by the pleading defendant; a charge or indictment is an allegation that must be proved. In Operation Gatekeeper, Hsu and Hao Global pleaded guilty, while DOJ described charges against Yuan and Gong as allegations and stated they are presumed innocent. Lui’s October 2026 matter is an indictment.
- Separate the shipment figure from the wider case. A value attributed to one alleged order, the alleged value across a scheme, and assets seized in an investigation are different measures.
- Look for a comparable baseline. To substantiate “getting worse,” a report would need comparable totals across periods—for example, consistently defined annual case counts or quantities. The announcements described here do not supply that series.
- Read policy by date and condition. Licensing rules and agency policies can change. A conditional case-by-case review does not mean every application will be approved.
