Spain’s Interior Ministry contracted Huawei storage for data linked to judicially authorised interceptions in the country’s SITEL system. The European Commission has not said the system was breached. Its warning is narrower but consequential: the contract could make a critical, sensitive government function dependent on a supplier the Commission regards as high risk, increasing the potential for foreign interference.

What the Spanish contract covers

A European Parliament written question published on 23 July 2025 described a Spanish Ministry of the Interior contract with Huawei involving servers used to store information associated with judicial interceptions in the SITEL system. The questioner presented the arrangement as a security concern; a parliamentary question is not, by itself, an official finding.

The Commission’s formal response, issued on 17 September 2025 by Executive Vice-President Henna Virkkunen, addressed the contract as a supply-chain and dependency issue in a sensitive government function. The response did not report unauthorised access, a data leak or a compromise of SITEL.

What the European Commission actually warned

Virkkunen wrote: “The contract concluded by the Spanish Ministry of the Interior with Huawei can potentially create a dependency on a high-risk supplier in a critical and sensitive sector that would increase the risk of foreign interference.” The qualifiers matter. The Commission identified a potential risk, not evidence that Huawei accessed interception data or that foreign interference occurred.

The concern has two parts:

  • Dependency: a government may become reliant on one supplier for storage, maintenance, updates or other parts of an important system.
  • Potential leverage: if the supplier is considered high risk, that dependency could increase opportunities for foreign influence or interference.

The Commission’s answer also said the planned revision of the Cybersecurity Act would examine ICT supply-chain security more broadly. That signals a policy direction, not an enacted rule or a final legal decision about this contract.

How the 5G guidance fits—and where it does not

The Commission’s formal Huawei and ZTE risk assessment was developed in the context of 5G networks. In its 15 June 2023 communication on implementing the EU 5G cybersecurity Toolbox, the Commission said Huawei and ZTE presented materially higher risks than other 5G suppliers. It said member-state restrictions or exclusions could therefore be justified and compliant with the Toolbox, and urged countries to implement the recommended measures.

That communication concerns telecommunications network equipment. The Spanish case concerns storage associated with a sensitive law-enforcement capability. The Commission’s 2025 answer applies the underlying dependency and supply-chain logic to that different ICT setting; it does not turn the 5G Toolbox into an automatic ban on every Huawei product in every sector.

Readers should therefore separate two propositions:

Neither proposition establishes that this Spanish system was compromised.

The EU security fault line

The episode exposes a conflict between national procurement discretion and shared European security. Member states generally make their own purchasing decisions, while a vulnerability in a system handling sensitive information can have consequences beyond one country—for example, if national law-enforcement data supports cooperation with EU agencies or cross-border investigations.

That creates four policy choices that do not always point in the same direction:

Question Choice at issue
Scope Apply controls mainly to 5G network equipment, or extend them to storage and other ICT used in sensitive sectors.
Risk treatment Restrict or exclude a supplier, or permit use subject to technical, contractual and organisational mitigations.
Decision level Leave procurement primarily to each member state, or coordinate EU-wide supply-chain policy.
Evidence standard Act on assessed or potential supplier risk, or wait for evidence of an actual compromise.

The Commission’s answer supports discussing the first side of each tension—especially dependency and potential interference—but does not announce a Union-wide prohibition covering this contract.

What Parliament asked about EU databases and agencies

A separate 2025 parliamentary question raised concerns about the security of EU databases and possible implications for cooperation with Europol and Eurojust in the context of Spain’s Huawei agreement. Those are questions raised for scrutiny, not proof that an EU database was affected or that intelligence-sharing arrangements were disrupted.

The official material available for this episode does not establish a breach, foreign access to interception records, or an interruption of EU law-enforcement cooperation. Treating those outcomes as facts would go beyond the evidence.

Why the 2026 LIBE discussion matters

A European Parliament LIBE Committee event held on 23 February 2026 discussed foreign interference, critical infrastructure, coordinated EU de-risking and a proposed Cybersecurity Act. The event record also notes the possibility that a vulnerability in one member state could affect security across the Union.

This is evidence of an ongoing policy debate, not a binding measure and not a finding that Spain’s contract caused harm. It shows why the Huawei episode is being treated as more than a single purchasing decision: EU institutions are considering whether national supply-chain choices can create shared exposure in interconnected systems.

What is established—and what is not

  • Established: the Spanish Interior Ministry contract involves Huawei storage associated with judicially authorised interceptions in SITEL, as described in the parliamentary question and Commission answer.
  • Established: the Commission says the arrangement can potentially create dependency on a high-risk supplier in a critical, sensitive sector and increase foreign-interference risk.
  • Established: the Commission’s Huawei/ZTE risk language in its 2023 communication is framed around 5G networks.
  • Not established: that Huawei accessed interception data, that SITEL was breached, or that EU databases, Europol or Eurojust cooperation were disrupted.
  • Not established: that the proposed Cybersecurity Act has been enacted or that it already requires Spain to cancel the contract.
