In the United States, social-media moderation is mostly run by each platform under its own rules. Federal and state laws address specific subjects and can impose duties or liability, while the First Amendment generally limits government—not private companies—from controlling speech. A typical case moves from an automated signal or user report to policy review, an enforcement decision, and sometimes an appeal. There is no single nationwide moderation code or workflow.
Who decides what stays on a social-media platform?
Platforms set the day-to-day rules
Each service publishes terms of service, community standards and topic-specific policies. Rules may cover harassment, spam, violence, sexual material, child safety, misinformation and other categories. The same post can therefore be permitted on one service and removed on another. A platform can also restrict lawful speech under its own rules, subject to applicable law and any promises it has made to users.
Government rules create boundaries, not one universal standard
Federal statutes and court decisions govern particular categories of content and particular conduct. They do not supply one set of definitions that every platform must apply to every post. Requirements can differ by content type, service, jurisdiction and the facts of a case.
The usual moderation workflow
Platforms vary, but the following sequence describes the main stages. A service can skip a stage, combine stages or use a different remedy.

- Rules are identified. The service matches the report or detection signal to the relevant community-standard rule, terms-of-service provision or legal process.
- Potentially violating material is detected. A user report, automated classifier, trusted flagger, law-enforcement request or another signal can start a review.
- The content and context are assessed. Automated systems may make a preliminary decision or send material to trained reviewers. Human reviewers consider the post, surrounding context and the policy’s exceptions.
- An intervention is selected. The result can be no action, a warning, reduced distribution or functionality, an age restriction, a label, removal, a strike or an account-level penalty.
- Notice and appeal may follow. Where the service offers a notice or appeal, the user may receive a reason and a deadline. Some appeals receive additional human review; eligibility and remedies differ by policy.
Detection is not the same as removal
A report normally asks the platform to examine content; it does not automatically prove a violation. YouTube, for example, says reported material is reviewed against its guidelines. It also describes machine-learning systems informed by earlier human reviews, with potentially violating material generally sent to trained reviewers unless the system has a high degree of confidence. YouTube identifies narrow automated handling for some spam and known re-upload cases. Those are YouTube’s stated practices, not a guarantee about every service.
Context can change the result
Reviewers may distinguish a prohibited depiction from reporting about it. YouTube says its reviewers can consider educational, documentary, scientific or artistic context in applicable cases. A post can therefore remain online even when it discusses a subject that would be prohibited if presented in another way.
What Section 230 does—and does not—do
Section 230 of the Communications Act has separate provisions that are often conflated. Section 230(c)(1) generally prevents an interactive computer service from being treated as the publisher or speaker of information supplied by another person:
“No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.”

Section 230(c)(2)(A) separately addresses certain good-faith restrictions on material a provider considers objectionable, including material that is obscene, lewd, lascivious, filthy, excessively violent, harassing or otherwise objectionable, whether or not the material is constitutionally protected.
These provisions do not require a platform to remove a particular post, guarantee that a post will remain online or provide immunity in every dispute. The statute contains exceptions, and fact-specific limits can apply, including situations in which a service materially develops unlawful content. Whether Section 230 applies depends on the claim, the conduct and the statutory exception at issue.
Does the First Amendment apply to social-media companies?
The First Amendment restricts government action. A private platform is ordinarily not the government, so the amendment generally does not give a user a right to have a post hosted. Platforms also argue that selecting, arranging and displaying third-party material can involve editorial judgment.
In Moody v. NetChoice, the Supreme Court held that particular applications of Florida and Texas laws implicated platforms’ protected editorial choices. The decision turned on the laws and functions before the Court; it did not resolve every question about platform regulation or make every state provision invalid. State laws and related litigation therefore require a current, provision-specific analysis.

Subject-specific federal laws
Some federal laws address defined categories such as child sexual-abuse material and nonconsensual intimate imagery. Those obligations coexist with a platform’s own policies. A platform may remove material under its rules even when a particular statute does not compel removal, while a legal notice or statutory duty can require a separate process.
What a real platform process looks like: YouTube
YouTube publicly describes a mixed automated-and-human system:
- Users can flag videos, comments and other material.
- Reports are reviewed against Community Guidelines rather than removed automatically merely because someone reported them.
- Machine-learning systems help identify potentially violating material and can route cases to trained reviewers.
- Reviewers can remove content, apply an age restriction or leave it up when no violation is found.
- Many Community Guidelines actions include a notice and an appeal route. YouTube says appeals receive human review.
Privacy, copyright and certain legal removals can use different procedures. Do not assume that an appeal is available for every decision or that every platform uses a second, independent reviewer.
What companies report about automation and human review
The Government Accountability Office reported that the five social-media and gaming companies it interviewed described machine-learning scanning and employee review for content covered by domestic-violent-extremism policies. The interviews show that both methods are used in at least some companies, but the sample is not a census of platforms and does not measure how effective the systems are.

Meta’s announced U.S. policy change
On January 7, 2025, Meta announced that it would end its U.S. third-party fact-checking program and move toward a Community Notes model. The announcement also described a stronger emphasis on illegal and high-severity violations. This is Meta’s announced policy position and should not be treated as a description of every Meta service or as an industry-wide change.
Meta reported roughly a 50% reduction in enforcement mistakes on its U.S. platforms from the fourth quarter of 2024 to the first quarter of 2025. That is Meta’s own comparison, not an independent audit or a cross-platform benchmark. Meta also said that the prevalence of violating content remained largely unchanged for most problem areas over that period.

Moderation is broader than deletion. Depending on the policy and service, a platform may:
- leave the material online with no action;
- show a warning or label;
- reduce distribution or disable a feature such as recommendations, comments or monetization;
- apply an age gate;
- remove the post or media;
- issue a strike or other account warning; or
- suspend or terminate the account.
Recommendation and ranking systems are not identical to moderation. A service may reduce visibility as a policy enforcement measure, but ordinary ranking changes can also result from personalization, engagement signals or product design.

Can a user appeal a takedown?
Sometimes. Appeal rights depend on the platform, the policy and the type of removal. A notice may identify the rule, the action taken and the deadline or interface for requesting review. YouTube says many Community Guidelines appeals go to human review, but it lists exceptions and separate routes for matters such as privacy and copyright. Other services may provide a limited appeal, no appeal for certain urgent or legally compelled actions, or a different remedy such as restoring reach rather than restoring the post.
When an appeal is available, preserve the original notice, identify the precise rule cited and explain relevant context rather than simply repeating that the content is lawful. A platform-policy appeal and a legal challenge are different processes.
How to compare two platforms or evaluate a moderation decision
Use the same questions for each service, and record the reporting period when reviewing statistics.

How to read moderation transparency reports
Counts from different companies are not automatically comparable. Check the publisher, reporting period, metric definition, services included and categories omitted before drawing a conclusion.

YouTube says its Community Guidelines reporting includes flags, channel terminations, comment removals, appeals, reinstatements and a Violative View Rate. It says the report excludes legal removals and some privacy and copyright removals. Its change log records revised data and changed definitions, including a September 2026 report update. A figure should therefore be quoted with the report version and definition that produced it, not as a timeless platform-wide rate.
What the U.S. system means for users
A post can be lawful yet violate a platform rule. A post can also be allowed under a platform rule until a legal request, copyright claim, privacy complaint or new policy changes the applicable process. The practical question is always which rule was invoked, how the service detected the material, what review occurred, what remedy was imposed and whether a defined appeal route exists.
