To check whether you can use an open-weight model commercially, inspect the exact model repository and revision you plan to deploy, read its full license, and check for separate usage policies or agreements. Then match those terms to what you will actually do—such as hosting inference, fine-tuning, or redistributing weights—and save a record of the terms you reviewed. “Open-weight” means the weights are accessible; it does not, by itself, grant commercial-use permission.
1. Pin down the exact model and version
Start with the artifact you intend to use, not just the model family or a search result. Record the model owner, repository, model name, and exact revision or release. Repositories and their terms can change, so check the copy you will actually deploy.
2. Locate the full license
On Hugging Face, check the license field in the model card’s README metadata and follow its link. The field may identify a standard license or name and link to a custom one; the repository may instead include a LICENSE file. Hugging Face’s documentation explains the model-card metadata and notes that licenses may also apply to associated project materials: Hugging Face repository licensing documentation.
The Hub catalog contains different license categories, including noncommercial Creative Commons, research-use, OpenRAIL, and model-specific terms. Treat a catalog label or repository tag as a pointer to the terms, not as the complete answer. Read the linked license or file itself. See the Hub license documentation and catalog guidance.

3. Check what the terms allow and require
Read the operative text and identify who grants rights, what materials it covers, which activities it permits, and what conditions apply. Check these points against your plan:
- Commercial use: Does the text expressly permit it, restrict it, or require separate permission?
- Modification and fine-tuning: May you adapt the weights, and what terms apply to a fine-tuned model?
- Hosting and redistribution: Are hosted inference, sharing weights, or distributing derivatives treated differently?
- Attribution and notices: Must you preserve copyright notices, provide attribution, or pass terms to recipients?
- Use restrictions and thresholds: Are there prohibited uses, revenue or scale thresholds, territorial limits, or other conditions?
- Coverage: Does the license cover the weights and the other materials you plan to use?
These are review prompts, not universal requirements: the exact answer depends on the specific model’s terms.

4. Look for policies and agreements beyond the license
Review the model card, the model owner’s official site, any download or access flow, and linked policy pages. Check for acceptable-use policies, gated-download terms, or separate agreements. A license that grants broad rights does not necessarily cancel contractual conditions that apply alongside it.
Example: OpenAI gpt-oss
OpenAI’s gpt-oss FAQ says Apache 2.0 allows broad use, modification, and redistribution, including commercial use, subject to the gpt-oss usage policy: OpenAI’s gpt-oss FAQ. OpenAI’s model card, dated August 5, 2025, also identifies Apache 2.0 and the usage policy for gpt-oss-120b and gpt-oss-20b: gpt-oss model card. This illustrates why both documents matter; it is not a rule for other models, and policies can change.

5. Check components you will use
A model repository may include or point to code, datasets, a tokenizer, adapters, or other assets with their own terms. Review the licenses for the components involved in your deployment rather than assuming the model’s license covers everything. Hugging Face specifically advises users to seek out and respect licenses for project code or data: Hugging Face repository licensing documentation.
6. Match each planned activity to a permission
Write down the deployment you are evaluating and check each activity against the relevant grant and conditions. For example, internal evaluation, a paid hosted service, redistribution of model weights, and distribution of a fine-tuned model are distinct activities; do not assume permission for one automatically covers the others.

If you are comparing candidate models, assess them on the same points: commercial-use limits, modification rights, hosting and redistribution conditions, attribution and downstream obligations, separate policies, component coverage, and the clarity and stability of their terms.

Save the model identifier and revision, the date you checked it, the model-card metadata, the license text or stable link, and any linked usage policies. Add a short note explaining how the terms relate to your intended use. This is prudent recordkeeping, not a universal retention requirement stated by the sources. Recheck if you change model versions or the deployment design.

8. Escalate unresolved questions
Seek qualified legal advice if the license is missing, contradictory, custom, or unclear about a material part of your use, or if the business consequences are significant. Whether a particular model’s terms permit a particular deployment can depend on the full documents, facts, and applicable jurisdiction.
