If a company told you about a data breach late, protect yourself first and work out the legal question second. Save the notice, find out what data was exposed, and go to the FTC’s IdentityTheft.gov/databreach for a recovery plan that fits that data. Freeze your credit or place a fraud alert if the exposed information could be used to open new accounts. After that, you can decide whether the delay is worth raising with the company or your state attorney general.

A late notice is not automatically an illegal one. Deadlines depend on your state or territory, the type of company, and the kind of information involved. This guide covers what to do now, how to judge the delay, and where to take a complaint.

Is a late breach notice a legal violation?

Not necessarily. There is no single nationwide consumer deadline. The FTC states that all states, the District of Columbia, Puerto Rico, and the Virgin Islands have enacted legislation requiring notification of security breaches involving personal information. It also says the requirements, including notice contents, vary and that businesses must check the laws that apply to them.

Four facts decide whether a delay was a problem in your case:

  • Where you live, since state or territorial law usually governs the notice you receive.
  • What kind of company sent the notice (a retailer, a bank, a health app, an employer).
  • What information was exposed.
  • The dates: when the company says it discovered the incident, and when it notified you.

Without those, nobody can say whether a particular delay broke a rule. A gap between discovery and notice can have legitimate reasons, such as a law-enforcement request. The “How long can a company wait?” section below shows how much the deadlines differ by sector.

What to do first: protect yourself while the legal question is open

The FTC’s consumer guidance opens with a plain instruction: “First, take a deep breath. Then, visit identitytheft.gov/databreach” (FTC consumer guidance transcript). That page walks you through steps based on the type of information exposed. According to the transcript, the steps can include:

  • Ordering your free credit reports and checking them for accounts you don’t recognize, especially when a Social Security number was exposed.
  • Placing a credit freeze or fraud alert.
  • Accepting relevant free services the breached organization offers.
  • Using IdentityTheft.gov to report identity theft and build a recovery plan if it happens.

These are conditional steps, not a checklist for every breach. A leaked streaming password calls for a different response than a leaked Social Security number.

Match your response to the data named in the notice

Data named in the notice Reasonable first moves Why it matters
Password or login credentials Change that password everywhere you reused it. Turn on multi-factor authentication where offered. Stolen credentials can be tried on other sites. This is general security practice, not a rule from the FTC pages cited here.
Payment card number Review statements. Contact the card issuer about replacing the card if the notice or your statements raise concern. Card misuse shows up in transactions, so close review is the main safeguard.
Social Security number or other identifiers Follow the IdentityTheft.gov/databreach steps. Check your credit reports, then consider a credit freeze or fraud alert. These identifiers can support new-account fraud, which is what freezes and alerts are designed to block.
Health or medical information Read the notice closely for what was taken, check any health-related statements or insurance communications, and use IdentityTheft.gov/databreach for guidance. Health data can overlap with identifiers. The notice’s description of what was taken should guide you.

If the notice is vague about the data involved, ask the company directly which data elements were exposed. The FTC treats the nature of the compromise and the information taken as central to how an organization should respond, so you are entitled to ask.

Preserve the facts about the delay

If you may later complain to the company, a regulator, or a lawyer, assemble the record now:

  • The notice itself. Save the letter, envelope with postmark if it came by mail, or the email with full headers visible if possible.
  • When you received it. Write down the date you first learned of the incident and how.
  • The company’s stated dates. Note the discovery date and the notification date given in the notice. Many notices include a timeline.
  • What data was involved. Copy the company’s own description of the exposed information.
  • What help was offered. Note any free monitoring or restoration service, its length, and the enrollment deadline.
  • Anything unusual afterward. Keep screenshots of unfamiliar accounts, inquiries, or charges, with dates.

Treat the notice’s timeline as the company’s account, not as established fact. If it conflicts with your own experience, such as fraud before the notice date, record that carefully and factually.

How long can a company wait to notify you?

There is no universal answer. These are the frameworks the FTC describes, and each covers only a defined group of entities.

Health Breach Notification Rule details

If the company that notified you is a covered personal health record entity, the FTC’s guidance adds several points:

  • Individual notice is due without unreasonable delay, with 60 calendar days after discovery as the outer limit.
  • For a breach affecting 500 or more people, notice to the FTC is due at the same time as notice to individuals. For fewer than 500, the FTC notice timing is different.
  • Media notice is also required in specified circumstances when at least 500 residents of a state, D.C., territory, or possession are affected.
  • A law-enforcement determination that notice would impede a criminal investigation or harm national security can permit a delay.

Do not assume these provisions apply to a retailer, employer, or other business outside the rule’s definition.

Why the Safeguards Rule figure confuses people

The 30-day number is a reporting duty to the FTC for qualifying security events at covered financial institutions. A bank or lender that met that duty could still be subject to separate state-law requirements for notifying you. Read the figure as a regulator-facing timeline, not as proof that you were owed a notice within 30 days.

Can you report a company for waiting too long?

You can raise a concern, but no single agency resolves every breach complaint, and filing one does not establish that a violation occurred. A sensible order:

  1. Contact the company through its official channel. Use the contact details in the notice or on the company’s verified website, not a link in an unsolicited message. Ask for the dates of discovery and notification, the data involved, and the reason for the timing. Keep a copy of your message and any reply.
  2. Look up your state or territorial attorney general. USAGov keeps a directory of state attorneys general. If you want to raise a state-level consumer concern about the delay, start there. Because state breach laws differ, the attorney general’s office is the natural place to ask how your jurisdiction handles notice timing.
  3. Report identity theft separately. If misuse has already happened, use IdentityTheft.gov. Reporting fraud and complaining about notice timing are different tasks, and the first should not wait for the second.

When you write to the company or an agency, stick to documented facts: the dates, the data, and what happened to you. Avoid calling the delay illegal unless a regulator or attorney has made that assessment.

Should you accept the company’s free monitoring?

Often it costs nothing to accept, but compare the offer against what was exposed. The FTC’s business guide suggests companies consider at least a year of free monitoring or other support, particularly when Social Security numbers or financial information were involved. Monitoring detects problems. It does not prevent identity theft.

Use these questions to judge any offer, whether free through the company or paid elsewhere:

  • Scope: Does the service watch for the kind of information that was exposed?
  • Alerts versus recovery help: Does it only send alerts, or does it also help you fix the damage?
  • Duration: How long does the free period last, and what is the enrollment deadline?
  • Data requested: What personal information does enrollment require? Be cautious if it asks for more than seems necessary.
  • Cost terms: Does it renew automatically at a charge, and is cancellation straightforward?

Start with the free tools: credit freezes, fraud alerts, free credit reports, and the FTC’s recovery resources. Paid monitoring is optional and only worth considering if it adds something those don’t.

When to get legal advice

Consider talking to a qualified attorney, or contacting the relevant regulator, if you have suffered a concrete financial loss, if you see evidence that fraud began before you were notified, or if the circumstances suggest a substantial violation. An attorney can check your state’s statute, the company’s sector, the dates, and the data against the rules that apply to you.
