No. A 24/7 YouTube stream of Indian film songs or commercial karaoke tracks is not copyright-safe just because it runs continuously, uses a karaoke backing track, or plays music you bought. You generally need permission for the relevant sound recording and the underlying musical or literary work, with terms that cover the live stream and any archive. YouTube may still interrupt a licensed stream if the rights owner has not allowlisted your channel through Content ID.
What YouTube can do when it detects music in a live stream
YouTube Help’s “Copyright issues with live streams” says all live streams are scanned for matches to third-party content, including another copyrighted live broadcast. If it detects a match, YouTube may replace the stream with a placeholder image and warn you to stop using the content. If the material remains, the stream may be temporarily interrupted or terminated. A copyright or Community Guidelines strike can also end a live stream.
These actions are platform enforcement, not a ruling on who owns a song or whether your use is lawful. YouTube says it does not decide copyright ownership. A stream that stays up is not proof of permission, and an interruption alone does not resolve the rights question.
Why a film song can require more than one permission
India’s Copyright Act, 1957 recognizes distinct protected works, including musical and literary works, cinematograph films, and sound recordings. Section 14 includes rights to reproduce and communicate certain works to the public; the Act also says copyright in a film or sound recording does not affect separate copyright in the work used to make it. India Code’s text therefore supports treating the song’s underlying composition and lyrics separately from the particular recording.

For a film song, check rights in both the underlying work and the exact sound recording you plan to play. The relevant permission depends on the song, recording, ownership and licence terms. A recording licence does not automatically establish that the composition or lyrics are cleared, or vice versa. A public live stream may also involve communication-to-the-public rights.
Original covers, karaoke tracks and film recordings are not interchangeable

YouTube’s monetization guidance is not a complete legal analysis or a general licence. Buying a karaoke file or owning a song does not by itself establish permission for public streaming, archiving or monetization.

A licence does not guarantee an uninterrupted broadcast
YouTube Help tells creators who have licensed third-party content to ask the rights owner to add their channel to the Content ID allowlist. YouTube warns that a stream can still be interrupted when the creator has a licence, including when the stream is limited to territories where the creator says they have the necessary rights, if the channel is not allowlisted. Confirm the licence scope and the owner’s process for allowlisting before scheduling the stream; do not assume a licence alone will prevent automated matching.
If you archive the broadcast, YouTube says Content ID claims on archived livestreams are made after the live stream ends. Depending on the rights holder’s settings and geography, a claim can block the video, monetize it for the rights holder (sometimes sharing revenue), or track viewership. Review YouTube Studio during and after the stream for warnings, interruptions, claims or strikes, and keep the permissions and correspondence that relate to your use.

Does Indian law’s section 31D let an individual stream film songs?
Section 31D of the Copyright Act describes a statutory licence for a “broadcasting organisation” to communicate previously published literary or musical works and sound recordings by broadcast or performance, subject to statutory requirements such as notice and royalties. The statutory text alone does not establish that an individual creator’s YouTube livestream qualifies or that the necessary procedures have been met. Do not assume section 31D automatically covers a personal or channel-operated 24/7 stream; seek advice from a qualified Indian copyright lawyer about the specific facts.
Are fair dealing, free access or non-monetization enough?
No blanket exception for a continuous public music stream is established by the sources here. Section 52 lists specified exceptions, including fair dealing for private or personal use, criticism or review, and reporting current events or current affairs. A stream being free, short, noncommercial, or labelled “fair use” does not by itself show that an exception applies.

YouTube’s copyright guidance also cautions that a creator’s belief that an exception applies does not stop a claim; only a court can determine whether an exception applies in a particular dispute. YouTube says commercial use requires the rights needed for the visual and audio elements. Permission, an applicable exception, public-domain status or licence terms may be relevant routes, but none guarantees that Content ID will not make a claim or that a live broadcast will not be interrupted.

- Make a track list. Record each song and the exact recording or karaoke track you intend to use.
- Identify the rights and get written terms. Confirm permission for the relevant sound recording and underlying musical or literary works. The terms should expressly cover YouTube livestreaming and, if enabled, the archive or VOD; also confirm monetization, territory, duration and any repeat or continuous-stream limits.
- Confirm Content ID handling. Ask each relevant rights owner or administrator whether your channel needs to be allowlisted, and verify that allowlisting is active before going live.
- Keep the records. Preserve licences, permissions and correspondence, and monitor YouTube Studio during the broadcast and after it ends.
- Get India-specific legal advice when relying on a statutory route or exception. In particular, do not treat section 31D as automatically applying to an individual creator’s internet livestream.
What Creator Music and live matching do—and do not—solve
YouTube’s Creator Music help page says the service is available to creators in the US YouTube Partner Program, with expansion outside the US pending, and that revenue-sharing tracks cannot be used in live streams. It is therefore not a general solution for an Indian 24/7 livestream. If you are eligible, check current availability and each track’s usage details in YouTube Studio; do not assume a listing clears a livestream when its terms do not permit that use.

YouTube’s special live Content ID matching is for selected partners using Studio Content Manager, requires a proven rights-management record and time-sensitive live content, and requires worldwide rights and exclusive ownership of the content in the stream. It is a rights-management tool for qualifying rights owners, not a way for a creator to get permission to play film songs.
