The clearest near-term constraint identified by the U.S. International Trade Administration is access to additional electricity capacity. Iceland still offers renewable power, naturally cool conditions and a safe operating environment, while policymakers have been reported to be considering a dedicated data-center tax framework.
The practical answer is therefore conditional: tax rules may slow investment decisions if the proposed framework remains unclear, but the available evidence points to a combination of policy uncertainty and power availability—not a tax-caused halt.
What is actually known about a tax-related stall?
No project-level evidence establishes that Icelandic data centers have been delayed or canceled because of taxes. The reported policy response is a proposal for a clearer data-center taxation framework in Iceland’s 2026–2027 industrial-policy plan. Its enactment, detailed rules and effective date have not been verified here, so companies cannot treat it as an operative incentive regime.
That distinction matters. A proposal can reduce uncertainty if it becomes law, but until the legislation and administrative guidance are published, investors still have to model their liabilities under the rules currently in force.

Four factors that will determine whether expansion slows
Tax certainty
A specific framework could clarify how data-center income, property, energy use and related charges are treated. Until the proposal becomes enacted policy with published terms, the uncertainty itself is a planning risk. It can affect project finance, site selection and the timing of large capital commitments without proving that a project has been stopped.
Existing investment incentives
Iceland’s Act No. 41/2015 on incentives for initial investments expired at the end of June 2020. It is not an open program for new projects. Incentives that had already been granted remained valid for the period agreed with each project.

- derogations from certain taxes and charges;
- possible authorization to fix the income-tax rate for 10 years; and
- customs and excise exemptions for specified construction materials, machinery and equipment.
Those provisions describe the former regime, not current eligibility. A new data center cannot assume that the same benefits are available simply because an earlier project received them.
Electricity capacity
The U.S. International Trade Administration’s Iceland country guide identifies renewable energy, naturally cold conditions and a safe environment as location advantages. It also warns: “However, growth could become temporarily constrained by limited access to additional energy capacity.” The guide was last published on April 1, 2026.
Power availability is a separate issue from tax policy. Even a clear tax framework would not remove queueing, transmission or generation constraints that limit how quickly a new facility can connect and scale.

Investment trajectory
Statistics Iceland’s July 2025 outlook treated data-center construction as a major contributor to near-term investment growth, but these are forecasts rather than completed investment results.

What could change if the proposed tax framework is enacted?
A published framework could give developers a predictable answer to questions such as which taxes and charges apply, whether special treatment is available for qualifying facilities, and when obligations begin. It could also make projects easier to compare with competing locations.

Until an Icelandic law or official guidance confirms those points, the proposal should be treated as a policy direction rather than a benefit that can be booked into a financial model. The most important missing information is the final text and its effective date.

Does Iceland’s innovation tax relief cover data centers?
Some eligible innovation enterprises may deduct 35% of qualifying project expenses, or 25% for large companies, subject to statutory conditions. This is an innovation-enterprise measure, not an automatic subsidy for data centers. A facility would need to establish that its activities and costs meet the eligibility tests.
PwC has also published maximum qualifying-expense amounts for 2023 and 2024. Those historical caps should not be treated as current limits without updated confirmation, particularly for a project planned after those years.

- an announced project postponement or cancellation that names tax treatment as a cause;
- official guidance showing that a previously expected incentive is unavailable to new facilities;
- financing or permitting documents that make an unresolved tax rule a condition precedent; or
- investment data showing a decline specifically linked to tax changes rather than broader base effects, construction timing or power constraints.
None of those forms of direct tax-causation evidence is established in the available material.
The likely near-term outlook
Iceland’s data-center push is more likely to be shaped by how tax clarity and electricity access evolve together than by a single tax decision. A clear, enacted framework could reduce uncertainty, but it would not by itself solve limited energy capacity. Conversely, projects may continue under existing rules while waiting for clarity if they can secure power and make their economics work without the expired 2015 incentive regime.
On the evidence available, the defensible conclusion is that tax issues are a potential friction point—not a demonstrated cause of a sector-wide stall.
