There is no single authority over every aspect of an aircraft in international airspace. If “international airspace” means airspace over the high seas, no state has territorial sovereignty there. But flight rules still apply, the aircraft’s state of registration has nationality-based responsibilities, and different states may have criminal jurisdiction over conduct onboard. Which authority matters depends on the aircraft’s location and status, the legal issue, and the treaties that apply.
What does “international airspace” mean?
People commonly use “international airspace” to mean airspace over the high seas. It is a useful shorthand, but it is not a complete answer to who can act in a particular situation. Airspace above a state’s territory—including its land and adjacent territorial waters—is governed by a different rule: the state has complete and exclusive sovereignty over it.
The Chicago Convention states that each contracting state has “complete and exclusive sovereignty over the airspace above its territory.” The Convention defines a state’s territory as its land areas and adjacent territorial waters. Chicago Convention, Articles 1–2

Who sets and enforces flight rules over the high seas?
Under Article 12 of the Chicago Convention, “Over the high seas, the rules in force shall be those established under this Convention.” Contracting states also undertake to ensure that aircraft bearing their nationality marks comply with applicable flight and maneuver rules wherever they fly, and to ensure prosecution of people who violate applicable rules. Chicago Convention, Article 12
This is a treaty framework for flight rules, not a declaration that one state has territorial sovereignty over the high seas. Nor does it make ICAO a global air traffic authority. ICAO’s materials describe responsibilities that member states carry out, including air traffic services in the airspace concerned and the timely publication of aeronautical information. In a 2025 statement, ICAO said that the decision whether a civil aircraft will fly over a particular geographic zone is the responsibility of the stakeholders involved. ICAO, “Statement on State Sovereignty over Airspace and Safety Assessments,” December 1, 2025

What authority comes from the aircraft’s registration?
Registration gives an aircraft a nationality: under Article 17 of the Chicago Convention, an aircraft has the nationality of the state in which it is registered. Article 18 does not permit valid registration in more than one state at the same time, although an aircraft’s registration may change. Chicago Convention, Articles 17–18
The state of registration therefore has an ongoing role in relation to the aircraft and its compliance with applicable rules. That role is important over the high seas, where no state has territorial sovereignty, but it does not make the registering state the exclusive authority for every legal question. Where the aircraft is flying, what happened onboard, and which treaty rules apply can all matter.

Which state has criminal jurisdiction over an onboard offence?
For offences and acts within its scope, the Tokyo Convention makes the aircraft’s state of registration competent to exercise jurisdiction. The Convention entered into force on December 4, 1969. The 2014 Montréal Protocol adds jurisdictional bases in specified circumstances: a state where the aircraft lands when the alleged offender is still onboard, and the state of the operator in a defined dry-lease situation. These are additional bases, not a blanket transfer of authority to either state. Tokyo Convention and Montréal Protocol text ICAO treaty status information
The answer for a particular incident depends on whether the relevant states are parties to the applicable instrument and whether its conditions are met. Domestic law and other jurisdictional bases may also be relevant. The treaty framework does not establish that the state of registration is the only state that can act.

Does the answer change for a state aircraft?
Yes. The Chicago Convention’s civil aviation rules do not apply to state aircraft. It identifies aircraft used in military, customs, and police services as state aircraft. An incident involving such an aircraft requires separate analysis rather than assuming that the civil-aircraft framework answers the question. Chicago Convention, Article 3

A practical way to identify the relevant authority
- Locate the aircraft. Determine whether it is over a state’s land or territorial waters, or over the high seas. Territorial sovereignty applies above a state’s territory; high-seas flight rules are addressed by Article 12.
- Identify the legal issue. Flight-rule compliance, air traffic services, safety information, and a criminal act onboard are distinct questions and may involve different responsibilities.
- Check aircraft status and registration. Establish whether the aircraft is civil or a state aircraft and identify the state where it is registered.
- For an onboard offence, check treaty applicability and circumstances. Confirm the relevant states’ participation in the Tokyo Convention and Montréal Protocol, and whether the landing-state or operator-state conditions are met.
- Consider the applicable national law and other jurisdictional grounds. The general treaty framework is not by itself a determination of authority over a specific incident.
