There is no single consent rule for every business text. For covered advertising or telemarketing texts to wireless numbers sent using an automatic telephone dialing system or an artificial or prerecorded voice, federal rules require prior express written consent. Other requirements depend on what the message says, how it is sent, and which jurisdictions apply.
When does a business need written consent to send a text?
Under the federal TCPA/FCC framework, covered advertising or telemarketing texts to wireless numbers require prior express written consent when they are sent using an automatic telephone dialing system or an artificial or prerecorded voice. The requirement depends on both the message and the sending method; it should not be treated as a rule that every text from every business requires the same consent.
The FCC regulation defines prior express written consent as a written agreement bearing the recipient’s signature that clearly and conspicuously authorizes no more than one identified seller to send or cause the covered messages using the specified technology. A digital or electronic signature may qualify where recognized under applicable law. See 47 CFR § 64.1200 in the 2025 Code of Federal Regulations.

How can customers opt out of business texts?
For covered calls and texts, a consumer may revoke consent by any reasonable method that clearly communicates a desire to stop receiving messages. The FCC regulation names reply keywords such as “stop,” “quit,” “end,” “revoke,” “opt out,” “cancel,” and “unsubscribe.” It also recognizes designated web or telephone methods as reasonable ways to revoke consent. The rule is broader than a particular keyword: a business should not ignore a clear opt-out just because the customer used different wording.
Under 47 CFR § 64.1200(a)(10)(i), in the 2025 edition, revocation requests made in any reasonable manner must be honored within a reasonable time, not exceeding ten business days from receipt. Ten business days is the outer limit in the rule, not a recommended waiting period. A practical suppression process should act promptly and carry the request across the campaigns, systems, and vendors that send messages for the business.

What should an opt-out process do?
- Capture the request. Record the number, the request received, and when it arrived, including requests made through reasonable channels other than a reply keyword.
- Suppress future covered messages promptly. Make sure the suppression applies wherever the business sends messages, including through vendors or separate campaign systems.
- Keep an audit history. Retain enough information to show when a request was received and how suppression was applied. The regulation sets the revocation deadline; it does not verify the features of any particular software.
Can a business send a confirmation after an opt-out?
A sender may send one non-promotional message confirming that it received the opt-out. It must only confirm the request and must be the only additional message after the opt-out; it cannot include marketing or promotional content. The FCC’s 2024 order, FCC 24-24, adopted the revocation language, and the FCC’s February 15, 2024 announcement describes the one-time confirmation allowance.

CAN-SPAM governs commercial email, not SMS. Its email-specific checklist includes accurate header information, non-deceptive subject lines, a valid postal address, and an opt-out method. Those requirements should not be presented as the rules for text messages. The Federal Trade Commission’s CAN-SPAM compliance guide addresses commercial email; its guidance on CAN-SPAM questions points text marketers to FCC rules and the TCPA for wireless messages.

Can state laws add requirements?
Yes. Federal law generally preserves more restrictive state requirements in the relevant area. The U.S. Code, Title 47, Chapter 5, addresses this relationship. State requirements are not uniform, and a campaign may need to account for the jurisdictions connected with its recipients and operations.
There is no basis here for a blanket national quiet-hours rule or a complete state-by-state list of registration, consent, timing, or other requirements. Check the current law in the relevant jurisdictions before launching a campaign, and avoid assuming that meeting the federal baseline resolves every state-law issue.

What should a business check before launching a text campaign?
- Message and purpose: Determine whether the text is advertising or telemarketing, rather than assuming all texts are treated alike.
- Sending method: Identify whether the campaign uses an automatic telephone dialing system or an artificial or prerecorded voice, because the federal written-consent requirement described above turns on the message and method.
- Consent records: For covered marketing texts, retain records that show the written agreement, the signature, and the identified seller authorized to send messages.
- Opt-out handling: Make clear how customers can revoke consent, recognize reasonable requests beyond a fixed keyword, and apply suppression across sending systems.
- Jurisdictions: Check applicable state requirements instead of relying on a federal-only checklist.
A business messaging or consent-management platform may help organize consent records and suppression, but using a tool does not itself establish legal compliance. Evaluate whether it captures the information the business needs and applies revocations across its campaigns and vendors.
