The UK would have to make a fresh application under Article 49 of the Treaty on European Union (TEU), then negotiate admission terms and secure the required EU and national approvals. It could not simply restore its former membership: Article 50(5) explicitly directs a former member seeking to rejoin to the Article 49 process.
What is the legal route for the UK to rejoin?
Article 50(5) TEU says that a state that has withdrawn from the EU and asks to rejoin is subject to the procedure in Article 49. That makes re-accession a new application and negotiation, not an automatic reversal of withdrawal. The consolidated Treaty text, including Articles 49 and 50, sets out that route.
Article 49 says: “Any European State which respects the values referred to in Article 2 and is committed to promoting them may apply to become a member of the Union.” The UK would address its application to the Council of the European Union.

What approvals would an application require?
The application would need to clear several distinct stages. Article 49 sets out the formal legal requirements:

- The Council consults the European Commission and acts unanimously on the application.
- The European Parliament must consent, acting by a majority of its component members. The European Parliament and national parliaments are notified of the application.
- The UK and the Member States agree the conditions of admission and any treaty adjustments needed for accession.
- The accession agreement is ratified by every contracting state in accordance with its own constitutional requirements.
The European Parliament Research Service describes a broader, general accession path that can include a questionnaire, Commission opinion, candidate status, screening, negotiations and closure of clusters, followed by Council action, signature of an accession treaty, ratification and membership. This is a high-level map of accession, not a guaranteed timetable or a UK-specific schedule; the Treaty requirements remain controlling. What criteria would the UK have to meet?
Article 49 requires an applicant to respect the values in Article 2 TEU and be committed to promoting them. The European Commission has also identified the Copenhagen criteria and the EU’s capacity to integrate a new member as relevant enlargement considerations. These are conditions to be assessed; they do not establish in advance whether a future UK application would pass or fail. The criteria are discussed in the Commission’s 2011 enlargement document.

Would the UK get its old opt-outs and budget arrangements back?
Not automatically. The House of Commons Library identifies the UK’s former arrangements on the euro, Schengen, justice and home affairs, and the EU budget rebate as issues that could arise in discussions about possible terms. But the existence of former arrangements does not establish that the EU would offer them again. Admission conditions and treaty adjustments would have to be agreed between the UK and Member States under Article 49. The Commons Library discusses these questions in its briefing, “Debate on the UK applying to join the European Union”.
How does the current UK position affect the question?
In a written answer published on 23 June 2026, the UK Government said it would not return to the Single Market, Customs Union or freedom of movement. It also described work to reduce trade barriers and red tape, including on food and drink, electricity and linking emissions trading schemes. These are the Government’s stated political positions on that date, not permanent treaty rules binding a future government. The answer is available on the UK Parliament website.

The European Parliament’s UK fact sheet describes the 19 May 2025 UK-EU Summit as establishing a new strategic partnership in a post-2024-election reset, while also noting the Government’s opposition to returning to the Single Market, Customs Union or free movement. Closer cooperation through that partnership is distinct from EU membership; the fact sheet is available from the European Parliament.
The Withdrawal Agreement, concluded under Article 50 TEU, entered into force on 1 February 2020. It set the framework for the UK’s withdrawal; it does not provide a shortcut to rejoin. The European Commission’s overview of the EU-UK Withdrawal Agreement records its entry into force.

How long would rejoining take?
There is no established timetable for a hypothetical UK application in these sources. The duration would depend on the application, assessment, negotiations, agreement on terms and ratification requirements. A specific completion date cannot be inferred from the general accession process.
