A police drone privacy policy is meaningful only if it sets clear limits on what is collected, how long it is kept, who can access or share it, and how the program is reviewed. When reading one, look for specific rules and accountable roles—not just a general promise to respect privacy. Here, “UAS” means unmanned aircraft system, the aircraft and related equipment commonly called a drone.
Start with the scope of collection
The policy should explain what a drone may collect, where it may operate, who could be affected, and why the information is needed. Look for limits tying collection, use, retention, and disclosure to a properly authorized purpose. A statement that the agency will use drones lawfully is less informative than a description of permitted missions and the information those missions may gather.

The U.S. Department of Justice (DOJ) policy says UAS sensor information is collected, used, retained, or disseminated only for a properly authorized purpose. DOJ COPS Office guidance recommends specifying where, what, how much, and from whom data is collected. These are useful review criteria, but the DOJ policy applies to the federal department, not automatically to local police agencies. DOJ Justice Manual, § 9-95.000; DOJ COPS Office guidance
Check the retention clock and its exceptions
A policy should give a normal retention period for routine footage and other sensor data, say when that period starts, and explain how deletion is carried out and documented. It should distinguish routine, non-evidentiary material from information kept for a case, authorized mission, complaint, or records obligation. Exceptions are easier to assess when the policy identifies who can approve them, what justification is required, and how long the exception lasts.

- 38kph (Level 5) Wind Resistant and 3-Axis Gimbal for Stable - With its Level 5 wind resistant and 3-axis mechanical gimbal, Mini 3 can capture consistently smooth 4K imagery. Brushless motors enhance power and allow takeoff at altitudes up to 4,000 meters.
DOJ’s federal policy says information collected using UAS that may contain personally identifiable information (PII) generally will not be retained for more than 180 days, unless retention is necessary for an authorized purpose or the information is maintained in a Privacy Act system of records. DOJ also requires appropriate Federal Records Act schedules. The 180-day rule is a federal DOJ example, not a universal deadline for police departments; local retention periods and legal duties depend on the agency and jurisdiction. DOJ Justice Manual, § 9-95.000; DOJ’s 2019 policy announcement
While data is retained, look for rules on secure storage and safeguards. A retention period alone does not tell you who can see footage during that time or whether a deletion actually occurred.
Find out who can access the data
The policy should name the roles permitted to view, copy, export, or delete footage and associated metadata, and connect each type of access to an allowed purpose. Ask whether access is limited to an operating unit or whether personnel elsewhere in the agency can retrieve data with approval. A policy is more accountable when it describes authentication, access logs, monitoring, and audits rather than relying solely on staff discretion.

- Which roles can view, copy, export, or delete records?
- What purposes justify access, such as an authorized investigation or emergency response?
- Are access events logged, monitored, and audited?
- Are vendor access, credentials, cybersecurity, and sensitive information addressed?
- Can staff outside the operating unit retrieve data, and what approval is required?
DOJ says retained data must be safeguarded and that department information systems may be monitored, recorded, and audited under department policy. Its 2019 announcement also says acquisitions are evaluated for cybersecurity risks. COPS guidance specifically calls for identifying who may access retained data and for what purposes. DOJ Justice Manual, § 9-95.000; DOJ’s 2019 policy announcement; DOJ COPS Office guidance
Read the sharing and secondary-use rules
Check whether the policy says when drone data may be disclosed to another agency or person, which purposes permit disclosure, and whether an agreement or approval is required. It should also address management of records after they are shared. Restrictions should cover secondary use, not only the original mission: information collected for one authorized purpose should not become available for unrelated uses without a stated basis.
COPS guidance recommends that data be used and disclosed exclusively for law-enforcement purposes unless exigent circumstances warrant otherwise. DOJ’s federal policy also ties handling to a properly authorized purpose and applicable records controls. These sources are guidance and federal policy, respectively; they do not establish a single rule for every local agency. DOJ COPS Office guidance; DOJ Justice Manual, § 9-95.000

Look for oversight that leaves a record
Operational and privacy limits are more credible when someone is responsible for applying and reviewing them. Look for deployment approvals, trained operators and supervisors, mission records, and a process for complaints. Stronger transparency includes a public policy, periodic review, and reporting that lets the public see how the program is being used.
- Who approves deployments, and what mission records are kept?
- Are operators and supervisors trained on the policy and applicable law?
- Is there a privacy impact assessment before a new technology or materially changed use?
- Are annual reviews, audits, complaint intake and investigation, and public reports described?
- Is the policy publicly available, periodically reviewed, and open to public comment?
DOJ policy requires component privacy assessments and annual reviews, and identifies mission tracking, reporting, and approvals among minimum policy areas. COPS guidance recommends a privacy impact assessment, public comment, and published information about what happens to collected data. The FAA library points to voluntary privacy, transparency, and accountability best practices. The 2018 FAA Reauthorization Act says privacy policies for covered UAS activities should address collection, use, retention, dissemination, and deletion, be periodically reviewed, and be public. DOJ Justice Manual, § 9-95.000; DOJ COPS Office guidance; FAA UAS community engagement library; FAA Reauthorization Act of 2018

If you are comparing two or more departments, use the same criteria for each. A short retention period may be less protective than it appears if exceptions are broad; a detailed access rule matters less if access is not logged or audited.

What a policy can—and cannot—tell you
A published policy can show the agency’s stated rules and oversight commitments. It does not, by itself, establish how well the rules are followed. Nor do the federal sources above settle the law for a particular city or state. To assess an individual department, check its applicable state and local retention schedules, public-records obligations, warrant rules, and controlling court decisions alongside the policy.

DOJ’s 2019 announcement described the federal policy as a possible model for state, local, tribal, and territorial public-safety partners; it did not make the policy binding on them. The announcement quoted Assistant Attorney General Beth A. Williams describing it as something that “can serve as a model” as other agencies develop their programs. DOJ’s 2019 policy announcement
