Ask the insurer for its denial in writing, identify the exact reason, and compare it with your policy. Then gather evidence that answers that reason and request reconsideration in writing. If the insurer does not resolve the dispute, you can contact your state insurance department—but check arbitration and court deadlines separately. A complaint to a regulator should not be assumed to pause or extend them.

First, identify what the insurer actually denied

“Denied” can mean several different things, and each calls for different evidence. New Jersey’s Department of Banking and Insurance distinguishes a denial based on lack of coverage from one based on lack of liability. Other disputes may concern whether you qualify as an insured, whether the other driver was uninsured, whether the evidence proves the loss, or whether the amount claimed is supported. New Jersey’s uninsured/underinsured motorist guidance explains the distinction between coverage and liability disputes.

Read the denial letter and the policy together. If the letter is vague, ask the insurer in writing to identify the specific policy language and facts it relied on. Review the UM/UIM insuring agreement, definitions, exclusions, conditions, notice requirements, arbitration clause, and any limitation language. The policy and state law—not a general nationwide rule—determine which procedures apply.

Build a focused record for reconsideration

Make a dated timeline from the accident through the claim submission and denial. Keep a copy of the full policy, including endorsements, the denial letter, and all messages and letters with the insurer. A clear record helps you respond to the reason actually given rather than sending unrelated documents.

Gather records that address the insurer’s stated grounds. Depending on the dispute, these may include:

  • Police or accident reports, photographs, witness names and contact details, and other evidence about how the collision happened.
  • Records relevant to the other driver’s insurance status and your own eligibility for UM/UIM coverage.
  • Medical records and bills, repair estimates or other damage records, and receipts for expenses.
  • Wage-loss documentation if you are claiming lost income.
  • A log of calls, submissions, and responses, with dates and copies of what you sent.

The NAIC recommends assembling policy information, supporting documents, bills, and records of communications when preparing an insurance complaint. California’s Department of Insurance also advises documenting injuries, medical expenses, and lost wages for a UM claim. Those are useful recordkeeping examples; the California guidance applies to California claims. See the NAIC complaint guidance and California’s accident and UM guidance.

Request reconsideration in writing

Send a concise response organized around each reason in the denial. State what decision or payment you are requesting, point to the policy language you believe applies, explain the relevant facts, and attach the records that support your position. Keep copies and proof of delivery. The insurer’s internal review route and any required form or deadline depend on your policy and state.

If the denial does not explain its basis clearly, request the specific policy provision and factual basis before or alongside your response. Keep the exchange in writing where possible so there is a dated record of what you asked and what the insurer said.

Choose an escalation route that fits the dispute

Different channels address different issues. A regulator can review aspects of claim handling, while arbitration or court may be needed to resolve entitlement to benefits or the amount owed. The applicable policy and state law control whether arbitration is available or required and what a particular process can decide.

Route Useful for What to check
Insurer reconsideration Giving the insurer a chance to correct a decision based on its stated policy or factual grounds. Internal procedures, required documents, and any policy or state deadline.
State insurance department complaint Asking the regulator to review concerns such as an unfair denial, delay, or failure to honor a policy. The correct state agency, its complaint form, required documents, and the limits of its authority.
Policy-based arbitration Potentially resolving certain disputes about legal entitlement to recover or the amount of damages. Whether the policy and state law provide for arbitration, which issues it covers, and the demand deadline.
Court Seeking a legal remedy when a dispute cannot be resolved through other applicable procedures. The relevant statute of limitations, policy language, notice conditions, and filing rules.

New Jersey’s regulator describes arbitration when the parties cannot agree whether the insured is legally entitled to recover or on the amount of damages. That does not establish that arbitration applies to every coverage denial or that it is mandatory in every state. Check the policy and governing law.

Contact your state insurance department

The NAIC advises consumers to try to resolve the issue with the insurer first and contact the state department if they remain dissatisfied. The department may investigate complaints about matters such as unfair claim denials, delays, or failure to honor policy terms; the available process and agency authority vary by state. Use the NAIC directory of state insurance departments to find the appropriate agency and follow its instructions. A regulator complaint is a review channel, not a guarantee that the insurer will pay or a substitute for a required arbitration or court filing.

Check deadlines immediately

There is no single nationwide deadline for challenging a UM/UIM denial. The relevant time limit may depend on state law, policy wording, the type of claim, the issue in dispute, and whether the required next step is a lawsuit or arbitration. The New Jersey regulator tells claimants to preserve the applicable statute of limitations. Arizona Revised Statutes § 12-555 sets written-notice and arbitration-or-suit timing rules for UM/UIM benefits; it is an Arizona example, not a rule for other states. Read the Arizona statute only if Arizona law applies to your claim.

California provides a separate example: its Department of Insurance describes written notice of applicable time periods that may be relied on to deny a claim and a particular notice period for first-party UM claimants. That California-specific guidance should not be applied elsewhere. See the department’s 2026 California claims guide.

Check the policy’s arbitration and limitation provisions now, then confirm the current rules with your state insurance department or a local attorney. If a deadline may be close, seek local legal advice promptly. Do not wait for a regulator’s response before protecting a filing deadline; the sources cited here do not establish a universal rule that a complaint pauses or extends one.
