If you discover that a medical visit was recorded or transcribed without your knowledge, first find out exactly what data was captured and how it was used. Write down what you observed, ask the provider for a written account, state that you object to using the tool at future visits, and review the clinical note for errors. An undisclosed recording does not automatically prove a legal violation: the rules depend on where you are, the purpose, the technology, and what happened to the information.
What to do first

Record what you observed
Write down the appointment date, what made you think recording or transcription occurred, what the clinician told you, and any wording in the visit note that suggests you agreed. Keep relevant messages and screenshots. A visible recording indicator or timer does not by itself establish that an audio file was saved.

Ask the provider for a written account
Contact the clinic’s privacy contact or medical-records office. Ask whether the visit involved audio recording, speech capture for transcription, an ambient scribe, a generated summary, or only a clinical note. Request the purpose, the vendor or service involved, who could access the information, whether it was shared beyond the care team, and how long each audio file, transcript, draft, and final note is kept. Ask for the relevant privacy notice and the procedure for access, correction, objection, deletion where applicable, and a formal complaint.

Object to future use
Tell the provider plainly that you do not want an ambient scribe or recording used at future appointments, and ask for the visit to proceed without it. NHS England’s patient guidance says a patient can ask for an ambient scribe not to be used and that the professional should respect the choice. Ask the clinic to note your preference in the appropriate place.

Get and review the resulting record
Ask for the clinical note and, where accessible under applicable law and provider policy, any transcript or recording. Check whether the note accurately reflects what happened and whether it wrongly says you consented. Do not assume an underlying audio file is always part of the accessible medical record.
Was your visit recorded, transcribed, or processed by an AI scribe?
These terms describe different stages of handling a conversation. A conventional recording creates an audio or video file. An ambient scribe may listen during a consultation, produce a transcript or summary, and prepare a draft letter or clinical note; it may process speech without leaving a persistent audio file. Ask about each stage rather than treating “recorded” and “transcribed” as interchangeable.

NHS England warns that ambient-scribe outputs can contain errors and says staff must check notes or letters produced by the tool before adding information to the record. Ask separately about access and retention for source audio, transcripts, drafts, and the final note: they may be treated differently.

Does recording or transcription without consent mean the provider broke the law?
Not necessarily. The answer depends on jurisdiction, purpose, notice, the technology used, and whether the information was retained, used, or disclosed. Professional standards and local recording or privacy laws may also apply. The guidance below concerns NHS England and UK professional standards, plus US HIPAA; it does not settle every UK purpose, every US state’s law, or rules in other countries.

NHS England: ambient scribing for individual care
NHS England’s guidance says explicit consent is not required for ambient-scribe use to support individual care under its described framework, but the patient must be informed and given an opportunity to object or dissent. Its patient guidance says the professional should explain the use at the beginning of the appointment and respect a request not to use the scribe. This is specific to the described health and care setting in England; it is not a universal rule for every recording technology or purpose.
UK doctors: professional recording standards
The General Medical Council’s standards say doctors must make recordings with appropriate consent or other valid authority, respect privacy and dignity, store recordings securely, and not record against a patient’s wishes or where doing so may cause harm. The guidance contains exceptions and distinguishes recordings made as part of care from some secondary purposes. A speech-to-text tool should not automatically be assumed to be governed identically to every other kind of recording.

United States: HIPAA is not a general recording-consent law
HHS explains that the HIPAA Privacy Rule does not require covered entities to tape or digitally record oral communications, or to keep recordings after transcription. HIPAA permits, but does not require, covered entities to obtain patient consent for uses and disclosures for treatment, payment, and healthcare operations; some other purposes may require a HIPAA authorization. Separate federal or state recording laws, professional rules, contracts, and privacy laws may matter. So discovering a recording, by itself, is not enough to establish a HIPAA violation.
What to ask the clinic
- Was the conversation recorded as audio, or was speech captured for transcription without a retained audio file?
- Was an ambient scribe used? Which vendor or service processed the information?
- What was the care purpose? Was the information also used for another purpose, such as product development or model training?
- Which parts of the visit became part of my clinical record? Can I access the transcript or source file under the rules that apply to me?
- Who could access the audio, transcript, and draft note? Was any data shared outside the care organization?
- How long is each type of data retained? Can a separate audio file or draft be deleted, and what policy governs that?
- Does my chart or visit note say I agreed? If so, what is the basis for that entry, and how can I request a correction?
- How do I register an objection for future appointments and submit a formal privacy complaint?
Whether you have a legal right to each item or to deletion depends on your jurisdiction and the type of record. Ask the provider to explain the policy and the basis for its answer rather than assuming that every file is subject to the same access or deletion rules.

What if my medical note says I consented?
Identify the record containing the statement and request a correction or amendment through the provider’s records procedure. Explain specifically what is inaccurate and what wording you believe should replace it. Keep a copy of your request and the provider’s response.
In the United States, HIPAA gives a patient a process to request amendment of information in the designated record set. The provider must respond; if it denies the request, the patient may submit a statement of disagreement for inclusion in the record. This is a right to request an amendment, not a guarantee that the provider must delete or replace the original entry.
Can you ask for the recording to be deleted?
You can ask whether a separate audio file, transcript, or draft exists and request deletion, but do not assume the provider must delete it. Retention and deletion rights vary with the kind of data, local law, the provider’s policy, and whether information has become part of the clinical record. Ask the clinic to identify the policy or rule it relies on and distinguish source files from the final note.
How to make a formal complaint
United States: HHS Office for Civil Rights
You may submit a written complaint to the HHS Office for Civil Rights (OCR) about a suspected HIPAA or 42 CFR Part 2 privacy, security, or breach-notification violation. Identify the provider, health plan, business associate, or other regulated entity and describe what happened and when. The usual filing window is 180 days from when you knew the event occurred; OCR may extend the deadline for good cause. OCR’s authority is limited to entities and allegations covered by those rules, and not every organization handling health-related information is a HIPAA covered entity or business associate.
Elsewhere: use the regulator with authority where you are
For an event outside the United States, or a complaint about local recording law, contact the privacy regulator, health ombudsman, or professional regulator responsible for your location. The right body and any filing deadline depend on jurisdiction; a single non-US complaint route cannot be specified for every reader.
