If you received a notice about downloading a ROM, first identify who sent it and what kind of document it is. A platform takedown, an internet provider’s warning, a private demand, a subpoena, and court papers require different attention. In the United States, a DMCA takedown notice by itself does not mean you are being sued; a subpoena or court papers are a separate matter. This guide explains the U.S. process, not whether a particular ROM download or use was lawful.
First, identify the notice and verify it
Do not act on the subject line alone. Read the full notice and note the sender, what it says happened, what action it requests, whether content was actually removed, and any deadline. Keep the complete message and related emails, including attachments and headers if available. Do not delete or alter related records.
If the notice appears to come from a platform or internet provider, verify it through that service’s official website or support channel. Do not send personal information or a legal response to contact details found only in an unverified message. For platform takedowns, the U.S. Copyright Office maintains a DMCA Designated Agent Directory; use it alongside the provider’s own published instructions.

A U.S. DMCA notice has specified elements, including identification of the copyrighted work and the allegedly infringing material, its location, contact details, and statements about good-faith belief and accuracy under penalty of perjury. The Copyright Office explains the notice-and-takedown process in its Section 512 overview and FAQ and the statute appears in 17 U.S.C. § 512. A notice that is incomplete, unexpected, or suspicious should be verified rather than treated as automatically genuine or automatically invalid.

Does a takedown notice mean you are being sued?
No. The U.S. Copyright Office answers directly: “No, a takedown notice does not mean you are being sued. If you are being sued, you will be served with court papers.” A takedown notice is part of a process for removing or disabling access to material hosted by a service. It is not a ruling that a court has found you liable.
That distinction does not mean every other kind of notice can be ignored. A subpoena, summons, complaint, or other court document can carry formal obligations and deadlines. Get prompt legal advice if you receive one.

If a platform removed material, decide whether a counter-notice fits
A counter-notice is a specific U.S. DMCA procedure for someone whose hosted material was removed or disabled and who genuinely believes that happened because of a mistake or misidentification. It is not a general-purpose appeal, and simply disagreeing with a copyright owner’s position does not establish that a counter-notice is appropriate. You may also leave the material offline.

- Your physical or electronic signature.
- Identification of the material that was removed or disabled, and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification.
- Your name, address, and telephone number.
- Your consent to the jurisdiction of the relevant federal district court, with the applicable court depending on your address and the provider’s location.
- Your agreement to accept service of process from the person who submitted the takedown notice or that person’s agent.
These requirements involve sworn statements, disclosure of identifying information, jurisdiction, and acceptance of service. The Copyright Office warns that knowingly making a material misrepresentation in a counter-notice can make the sender liable for resulting damages, costs, and attorneys’ fees. Read the statutory requirements in 17 U.S.C. § 512 and the Copyright Office’s Section 512 guidance before deciding. Consider advice from a licensed attorney, especially if the consequences could be significant.
What happens after a compliant counter-notice
Under the U.S. statutory process, a provider generally may restore access between 10 and 14 business days after receiving a compliant counter-notice, unless it receives notice that the rightsholder has filed a court action seeking to restrain the user. This is a statutory procedural window, not a guarantee that every platform will handle every notice identically or that the underlying dispute is over.

What a ROM notice does—and does not—establish
The procedures above explain how to sort and respond to certain U.S. notices. They do not determine whether a particular ROM download, possession, backup, or use is lawful, and they do not resolve possible defenses or the authenticity of an individual message. Do not infer from a takedown or warning alone that a court has decided the issue.
The cited guidance is U.S.-specific. It does not establish the rules in other countries, nor does it supply a universal response for ISP warnings or private demands. If your notice involves threatened litigation, a subpoena, court papers, or a consequential demand, consult a licensed attorney in the relevant jurisdiction promptly.
