An uncrewed combat aircraft is not automatically an autonomous weapon. The key question is what happens after activation: does a human make the attack decisions, or can the system select and engage targets without further human intervention? That distinction shapes the safety assessment, but it does not remove human obligations under international humanitarian law (IHL).
What makes a combat aircraft autonomous?
“Drone” describes a range of aircraft and operating arrangements; it does not, by itself, tell you how much decision-making is automated. The International Committee of the Red Cross (ICRC) defines an autonomous weapon system (AWS) by its function: once activated, it can select and engage one or more targets without further human intervention.
Such a system responds to environmental information from sensors according to a generalized target profile. The person who activates it may not choose or know the precise target, timing, or location of the resulting use of force. By contrast, an aircraft can be remotely piloted while a human makes the decisions to attack.

Three functions that should not be conflated
- Remotely piloted aircraft: A person controls the aircraft remotely and makes the relevant attack decisions. Remote operation alone does not make it an AWS.
- Aircraft carrying a munition: The aircraft delivers a weapon, but the aircraft’s status as uncrewed does not establish whether target selection or engagement is autonomous.
- One-way aircraft or autonomous weapon: A one-way drone is itself the munition. If it can select and engage a target after activation without further human intervention, it may qualify as an AWS.
The legal analysis therefore turns on the weapon’s functions and use, not simply whether a pilot is aboard.

What safety questions should be answered?
The central safety concern is whether the system’s effects can be anticipated and constrained in the conditions where it will operate. The ICRC identifies difficulty anticipating or limiting effects, civilian and combatant harm, and escalation among the humanitarian concerns raised by autonomous weapons. These questions need to be assessed together rather than treated as a single test of whether the aircraft can identify a target.
Can its behavior be predicted in the intended environment?
Operators need to understand what the system is likely to recognize and engage across the conditions in which it will be used. Sensor inputs, changing surroundings, and the system’s target profile affect what it may do after activation. If its behavior cannot be predicted or its effects limited, it becomes harder to control foreseeable harm.
Can it distinguish lawful targets in practice?
A safety assessment must ask whether the system can differentiate military objectives from civilians and civilian objects in the actual operating environment. This is not merely a question of whether a system detects a category in a controlled test: the relevant issue is what it will identify and engage under the conditions of use. The ICRC materials do not establish an aircraft-specific performance threshold that would settle this question.

Can a human supervise and intervene in time?
Meaningful supervision depends on more than leaving an operator nominally “in the loop.” The operator needs information about the system’s behavior, enough understanding to judge its likely effects, and a practical opportunity to intervene or deactivate it before harm occurs. The ICRC identifies human understanding, supervision, intervention, and deactivation as central control considerations.
Are the system’s operating limits narrow enough?
Assessment should specify the target types the system may engage, where and for how long it may operate, the scale of its use, and the conditions under which activation is permitted. Limits matter when they make the likely effects more predictable and leave humans able to exercise judgment. Broad or poorly defined limits can undermine that control.
Could use cause civilian harm or escalation?
Potential consequences include harm to civilians and combatants, as well as effects that contribute to escalation. A safety case should therefore consider the interaction between system behavior, the environment, and the way the weapon is deployed—not only whether the aircraft completes its assigned flight or mission.

The ICRC sources provide legal and human-control questions, not a complete engineering test protocol. They also do not establish an aircraft-specific accident rate, performance record, or safety-certification regime, so generic aviation statistics should not be treated as evidence about autonomous combat aircraft.

How does international humanitarian law apply?
IHL applies to attacks regardless of whether the weapon is launched from a crewed aircraft, a remotely piloted aircraft, or an autonomous system. The ICRC’s drone guidance says armed drones are not expressly prohibited as a category under treaty or customary IHL and are legally comparable to weapons launched from crewed aircraft. That does not mean every attack or weapon used by an aircraft is lawful.
In the conduct of hostilities, the central requirements include distinction, proportionality, and feasible precautions to avoid or reduce civilian harm:

- Distinction: Attacks must be directed at combatants and military objectives, not civilians or civilian objects.
- Proportionality: Indiscriminate and disproportionate attacks are prohibited.
- Precautions: All feasible precautions must be taken to avoid or minimize civilian harm.
These duties apply to attacks by drones as well as crewed aircraft. A platform’s general legality does not make every use lawful; an otherwise lawful aircraft or drone may also be prohibited if it deploys a weapon that is banned outright.
The ICRC’s 2025 position paper emphasizes that humans using weapon systems must fulfill IHL obligations. It also notes that states differ on what requirements existing IHL entails for AWS, and that current rules do not fully answer every humanitarian, legal, and ethical question raised by these systems. The basic rules apply, but their application to particular autonomous functions remains contested and fact-dependent.

Autonomy does not transfer IHL obligations to the machine. As the ICRC puts it: “It is not the weapon system that must comply with IHL, but the humans using it.” People remain responsible for compliance when they use weapon systems.

That principle does not, on its own, determine who would face a particular legal consequence after an unlawful attack. Questions of individual criminal liability, command responsibility, state responsibility, procurement decisions, and remedies are distinct accountability issues. The ICRC’s 2025 paper identifies accountability challenges but does not resolve every form of liability or responsibility for a specific incident.
What controls does the ICRC recommend?
The ICRC advocates new, legally binding international rules for autonomous weapons. It recommends prohibiting systems that are unpredictable and systems designed or used to apply force against persons. For other systems, it proposes restrictions intended to reduce risks and preserve human control. These are the ICRC’s recommendations; they should not be mistaken for prohibitions and restrictions already universally in force.

- Restricting the duration, geographic area, and scale of use.
- Limiting use to situations where civilians or civilian objects are absent.
- Requiring effective human supervision and the ability to intervene or deactivate the system in time.
A 2020 ICRC–SIPRI analysis groups practical human-control measures around three areas: weapon parameters, including target types; the environment in which the weapon is used; and human supervision. These are ways to reduce or compensate for unpredictability and civilian risk, not a binding treaty or an aircraft airworthiness standard.
How to evaluate a particular system or proposal
When comparing aircraft, weapons, or regulatory proposals, use the same questions for each. The ICRC materials support these assessment dimensions, but do not supply a complete technical test protocol:
- Autonomy: Can the system select and engage targets after activation without further human intervention?
- Target limits: Which target categories can it engage, and how narrowly is its target profile defined?
- Predictability: How predictable and testable is its behavior in the intended operating environment?
- Human control: What does the operator know and understand, what supervision is available, and how much time is there to intervene or deactivate the system?
- Operating limits: Are geography, duration, and scale constrained?
- IHL support: How do the system’s design and use enable distinction, proportionality, and feasible precautions?
A label such as “uncrewed,” “AI-enabled,” or “human-supervised” cannot answer these questions by itself. The relevant assessment is what the system can do, how it is bounded, and whether people can make and carry out the judgments required for lawful use.
