There is no single U.S. rule for AI-generated or manipulated campaign media. Before publishing or distributing it, campaign staff should check the rules for every jurisdiction where it will appear, whether the content falls within a law’s definition of synthetic or deceptive media, the timing of the communication, and its sponsor and format. A state AI disclosure or restriction is separate from any ordinary political-ad sponsor disclaimer.
Start by separating two different compliance questions
An AI-related disclosure tells an audience that political media was generated or materially altered using synthetic media. A sponsor disclaimer identifies who paid for or authorized a covered political communication. One requirement does not automatically satisfy the other: a campaign may need both, depending on the law and the communication.
AI or deepfake rules
State laws take different approaches. Some require disclosures on certain synthetic or manipulated political media; others prohibit specified deceptive content during a defined period around an election. Statutory definitions, covered content, exceptions, remedies, and timing can vary. The word “deepfake” alone does not establish whether a particular video, image, or audio clip is covered.
Ordinary sponsor disclaimers
Federal Election Commission guidance says covered public communications by political committees must display a disclaimer, and state political-ad disclaimer rules may also apply. These rules turn on factors such as sponsor, communication type, and medium, rather than only whether AI was used. National Conference of State Legislatures (NCSL) reported on September 11, 2026, that nearly every state regulates political-ad disclaimers, with requirements that vary across those factors.

What the current state-law landscape tells campaigns
NCSL’s summary, updated June 23, 2026, reported that 31 states had enacted laws regulating deepfakes in political messaging. It groups state approaches broadly into prohibitions and disclosures. That is an enactment count as of the summary’s update date—not confirmation that every law remains in effect or is enforceable today.
The summary describes Minnesota and Texas as examples of time-limited prohibitions and Maryland as an example of a prohibition on deceptive election-related deepfakes without a time limit in the summary. Those descriptions are not enough to decide whether a particular communication is covered. Check the current statutory text and court status for the specific jurisdiction before relying on a rule or exception.

Do AI-generated political ads need a disclaimer?
Possibly, and the answer may be yes to two distinct disclosures. For a communication covered by federal campaign-finance rules, the FEC’s advertising and disclaimer guidance describes sponsor-identification requirements for political committee public communications. State law may impose additional political-ad disclaimers or a separate AI/deepfake label. Whether a particular ad triggers each requirement depends on its sponsor, content, medium, distribution, and jurisdiction.

The FEC says a disclaimer is not clear and conspicuous if it is “difficult to read or hear, or if its placement is easily overlooked.” In practice, staff should check legibility, audibility, and placement against current medium-specific guidance rather than assuming that including the right words somewhere is sufficient.
FEC guidance on electioneering communications also addresses timing and distribution thresholds and certain non-candidate-paid communications, including identifying the payer and whether a candidate authorized the communication. The definitions and thresholds are technical; consult the current FEC guidance and governing rules for the communication at issue instead of applying a simplified cutoff.

Use this pre-publication review for each communication
- Map distribution. List every state or territory where the content will be distributed, including planned audience targeting and other distribution channels. Identify the relevant election dates in each place; the campaign’s home jurisdiction does not necessarily control an audience elsewhere.
- Classify the media. Record whether the piece is wholly AI-generated, materially altered, or neither, and whether it depicts or imitates a real person’s appearance or voice. Check the governing law’s specific definitions; ordinary editing and legally defined synthetic media may not be treated alike.
- Check for a state disclosure or restriction. For each relevant jurisdiction, verify the current law’s covered media, prohibited conduct or required label, timing window, exceptions, remedies, and court status. Do not infer coverage from a general description or from the term “deepfake.”
- Assess sponsor disclaimers separately. Identify who paid for and authorized the communication, whether federal requirements apply, and which state disclaimer rules govern. Then check the rules for its actual format—such as print, broadcast, internet, or audio—rather than reusing wording or placement from a different medium without review.
- Approve and preserve the version. Keep an internal record of the final media file, distribution jurisdictions and dates, disclosures used, and reviewer approval. This is a practical risk-control measure, not a claim that every cited law requires such a record.
- Recheck before launch. Confirm statutory text, effective dates, injunctions or other court rulings, and agency guidance close to publication. Laws and litigation can change, and a general landscape summary cannot establish the result for an individual ad.
Federal guidance has a specific update caveat
The FEC’s advertising and disclaimer page says it has not yet incorporated the Supreme Court’s June 30, 2026 decision concerning coordinated expenditure limits. The page describes this as an issue awaiting updated guidance once the Commission regains a quorum. That caveat concerns the guidance’s treatment of coordinated expenditure limits; it should not be read as removing all political-ad disclaimer requirements. Check current FEC materials and the governing rules for the particular communication.

Seek election-law counsel or qualified campaign-compliance review when an ad reaches multiple jurisdictions, uses a realistic depiction or voice of a candidate or public figure, is scheduled near an election, or may fall within an electioneering-communication rule. These features can make the definitions, timing, exceptions, and disclaimer rules especially consequential. NCSL’s summaries are useful for surveying state approaches, but the controlling statute, current court orders, and applicable agency guidance determine what a campaign must do.
