A host country can seek to change the terms of a U.S. military presence, deny permission for a particular operation, limit where or how forces may operate, or end basing rights through an applicable withdrawal or termination process. Which route is lawful—and what notice or procedure it requires—depends on the agreements in force and the host country’s own law. There is no single rule that lets every host country cancel every U.S. basing arrangement immediately.
Start with the agreements that authorize the presence
Foreign bases generally remain under the sovereignty of the host country, but the legal framework for U.S. presence is often spread across several instruments rather than a single “base agreement.” A country may have an alliance treaty or compact, a status-of-forces agreement (SOFA) or visiting-forces agreement, a basing or defense-cooperation agreement, and separate implementing arrangements such as exchange of notes or committee decisions. Some terms may not be public.
These instruments can address different questions: whether forces may be present, what activities they may conduct, how facilities are used, and how personnel or disputes are treated. A SOFA, for example, is not necessarily the document that grants the underlying right to use a particular site. To determine the available legal route, a government must identify the instruments that apply to the force, facility, activity, and time period at issue.

| Option | Typical scope | What determines the process |
|---|---|---|
| Negotiate an amendment or implementing arrangement | Any terms the parties agree to change | The agreement’s amendment mechanism and the parties’ consent |
| Set or negotiate conditions on consent | Force size, location, duration, or other specified terms | The applicable consent framework and agreement language |
| Refuse a requested operation or use | A particular mission or activity | Whether that use requires host permission and what the governing instruments provide |
| Terminate, withdraw from, or decline to renew | Some or all basing rights, depending on the instrument | Notice, timing, renewal, and termination provisions, plus applicable law |
| Use domestic political or administrative authority | Access permissions or implementation in practice | The host country’s constitutional and statutory rules, as well as its international commitments |
These are not interchangeable. Restricting one operation may leave the rest of a basing relationship intact; ending an agreement may affect a much broader set of rights and obligations.

Negotiate narrower or changed terms
If both governments agree, they can amend an existing instrument or adopt a supplementary arrangement. The details matter: the parties might revise which facilities are available, what missions are permitted, force levels, duration, procedures for approval, or environmental safeguards.
The Federated States of Micronesia–U.S. Military Use and Operating Rights Agreement illustrates how specific such terms can be. The 2003 agreement defines defense sites and U.S. rights, provides for unresolved disputes to go to a Joint Committee, allows amendment by mutual consent, and ties its duration—except for Annex A—to the Compact’s period of effectiveness. It also provides for a site or portion of a site to revert to FSM control when the United States no longer needs it. Those are terms of that agreement, not a standard package for other host countries.
Japan’s Foreign Ministry publishes its SOFA materials alongside related agreements and Joint Committee records. That illustrates why a country-specific review may need to account for implementing arrangements as well as the framework agreement.

Condition consent or limit a particular use
A host government may seek to make its consent conditional—for example, by limiting a deployment’s size, duration, location, or permitted activities. Whether a particular condition is legally effective depends on the applicable agreement and law; a general statement about consent is not a substitute for examining the operative text.
In a March 9, 1999 statement concerning the Conventional Armed Forces in Europe (CFE) Treaty, U.S. Ambassador Greg Govan described the U.S. government’s view that host consent could be conditional. He listed limits on force size or composition, duration, locations, compliance with CFE obligations, certain costs, and environmental measures. Govan also said that, in that context, abuse or circumvention of consent would violate the CFE Treaty and international law. These were U.S. government positions in a specific historical treaty context—not a court ruling or a universal clause governing every U.S. base.
A narrower option is to refuse a particular requested operation while continuing to permit other uses of a facility. The Congressional Research Service (CRS) reports that Turkey blocked U.S. use of Incirlik Air Base for combat operations against Iraq in 2003. That example demonstrates a mission-specific restriction; it does not establish that every host has the same procedure or that denying one operation ends all basing rights.

Terminate, withdraw from, or decline to renew
A host government may be able to end an arrangement by using a termination or withdrawal clause, allowing it to expire, or declining renewal. The relevant instrument may specify who can act, the required form of notice, a notice period, consultation or dispute procedures, and the effective date. If the text does not settle the issue, the answer may also depend on applicable international law and domestic rules. A general claim of sovereignty alone does not establish an immediate, consequence-free right to terminate any agreement.

CRS describes several distinct examples of major changes to access:
- France, mid-1960s: CRS reports that Charles de Gaulle informed the United States that existing basing agreements no longer obtained, ending two decades of U.S. military presence. This episode formed part of a wider change in the France–NATO relationship and should not be reduced to a simple example of a standard notice clause.
- Niger, 2023–2024: After the 2023 coup, Niger’s junta cancelled the existing SOFA; CRS reports that this compelled U.S. forces to withdraw and abandon two bases. The episode occurred in a politically changed setting and does not, by itself, establish a universal unilateral-termination rule.
The examples show that access can change through host-government action, but they do not supply a single legal precedent applicable to every country or agreement.

Distinguish political action from legal authority
Public announcements, government decisions, access permissions, and administrative implementation can change what forces can do in practice. Whether the action complied with the governing agreement is a separate question. A country-specific assessment must check who had authority to act under the host country’s constitution and statutes, whether required domestic procedures were followed, and how the action fits with the country’s international obligations.
U.S. law is another separate layer. CRS identifies 10 U.S.C. §§ 2675 and 2687a as provisions concerning U.S. acquisition, use, or disposal of overseas real property and related congressional reporting or oversight. Those provisions concern U.S. authorities; they do not, by themselves, define a host country’s right to terminate a bilateral basing arrangement.
Account for exit and transition consequences
Ending rights can trigger more than a departure date. CRS explains that after relevant agreements are terminated, continued use is prohibited and financial settlement is negotiated. The parties may need to address investments in facilities, property, handover, personnel, and potential environmental cleanup. The applicable agreement and facts determine which costs or obligations arise; they should not be assumed to be identical from one base to another.

What to check for a specific country or base
A reliable answer requires the current operative texts and the facts about the proposed restriction. The review should identify:
- The alliance treaty, compact, SOFA or visiting-forces agreement, and basing or defense-cooperation agreement.
- Related exchange of notes, side letters, implementing arrangements, and joint-commission or committee decisions.
- Which instrument authorizes the particular presence, facility access, or activity—and whether the restriction concerns one mission, one site, a time period, or the entire presence.
- Amendment, consent, dispute, notice, termination, expiration, and renewal provisions, including any required consultation or domestic approval.
- The host country’s constitutional and statutory decision rules and any applicable international-law requirements.
- Handover, financial settlement, capital investment, environmental, and personnel provisions that may apply if access is reduced or ended.
CRS cautions that the scope of these arrangements varies and that some agreements or terms may not be public. Without the current instruments and relevant domestic law, a general account can describe the available pathways but cannot determine which one a named country may lawfully use.
