A coast guard typically enforces maritime laws, protects resources, and handles safety and rescue; a navy is chiefly organized for national defense and military operations at sea. In a dispute, a coast guard may enforce a state’s laws or signal its claim to jurisdiction, while a navy may provide military presence or deterrence. The distinction is functional, not universal: some coast guards are armed, have military duties, or can be placed under wartime defense command. Whether a particular action is lawful depends on the location, the vessel and its conduct, and the applicable national and international law—not simply on which service carried it out.
What each service typically does

The U.S. Coast Guard, for example, describes itself as the lead federal maritime law-enforcement agency, with responsibilities that include enforcing laws concerning contraband, immigration, fisheries, and maritime resources (U.S. Coast Guard: Maritime Law Enforcement). U.S. law also assigns the service duties involving safety, search and rescue, aids to navigation, environmental protection, law enforcement, and defense readiness (14 U.S.C. § 102).
Why the line is not the same in every country
“Coast guard” does not reliably mean “civilian service,” just as the name alone does not settle which agency has authority in a particular incident. The service’s legal status, chain of command, and powers depend on that country’s laws. The U.S. Coast Guard describes work spanning military operations, border and port functions, law enforcement, and humanitarian missions; its defense program says forces may operate under Coast Guard control or under a Department of Defense combatant commander (U.S. Coast Guard: What We Do; U.S. Coast Guard: Defense Operations Program).

Philippine law establishes the Philippine Coast Guard as an armed and uniformed service attached to the transportation department, with provision for attachment to the defense department in declared wartime (Republic Act No. 9993, Philippine Coast Guard Law of 2009).

India
The Indian Coast Guard’s official mission statement includes supporting the navy during war (Indian Coast Guard: Mission and Motto).
These examples show why it is safer to compare a service’s actual statutory duties and command arrangements than to assume that every country uses the same coast-guard/navy model.

What matters when judging an action in a maritime dispute
A service’s role and the legal merits of a state’s claim are separate questions. The United Nations Convention on the Law of the Sea (UNCLOS) sets out a framework for maritime zones, passage, and coastal-state jurisdiction, but an incident still has to be assessed against the rules and facts that apply to it (UNCLOS, Part II). Do not treat a uniform, ship type, or agency label as proof that a state has jurisdiction or that an action was lawful.
For a specific incident, establish the following before drawing a legal conclusion:

- Location: Was the vessel in internal waters, the territorial sea, an exclusive economic zone (EEZ), or on the high seas? Different rules apply in different zones.
- Claim: Which state asserts jurisdiction, and what maritime or sovereignty claim is at issue? The presence of an enforcement vessel does not resolve a competing claim.
- Vessel and conduct: Identify the vessel’s status and what happened—such as a boarding, inspection, detention, escort, or military maneuver.
- Authority: Check the relevant country’s law and the international rules applicable to that location and conduct. The agency’s name alone does not establish its power to act.
- Command and posture: Determine which service controlled the operation and whether it was carrying out an enforcement mission, a defense task, or another assignment.
UNCLOS Part II is a starting point for questions concerning zones and passage, not a substitute for applying the relevant treaty provisions and facts to an individual incident. A description of an event as “coast guard enforcement” or “naval activity” identifies the apparent service and posture; it does not settle the underlying dispute.
