A transportation network company (TNC) uses a digital network to connect passengers with drivers for prearranged rides. The company, driver and vehicle are distinct roles, and the legal definition and rules depend on the jurisdiction. This article describes the common U.S. pattern, not a nationwide legal definition.
What does transportation network company mean?
In general, a TNC is an entity that uses an app or other online platform to connect passengers with drivers who provide prearranged transportation. The defining idea is the digital match for a requested ride—not simply that a passenger travels in a car.
North Carolina law describes a TNC as a person that “uses an online-enabled application or platform to connect passengers with TNC drivers who provide prearranged transportation services.” California’s Public Utilities Commission similarly describes compensated, prearranged rides arranged through an online-enabled platform, with drivers using personal vehicles. Which parts of the ride are the company’s, and which are the driver’s?
A TNC is the network intermediary: it connects a passenger’s request with a driver. The driver provides the trip, and the vehicle is a separate part of the arrangement. Laws may define the company, driver and service separately; the term “TNC” does not by itself establish who owns a car, how a driver is classified for employment purposes, or who bears a particular legal responsibility.

For example, Illinois says a TNC is not deemed to own, control, operate or manage a driver’s vehicle. That is a rule in Illinois law, not a universal statement about every company or jurisdiction. The Illinois statute also distinguishes TNC service from taxicab, for-hire and street-hail service.
How is a TNC different from a taxi?
The main distinction is commonly how the ride is arranged: TNC trips are requested and matched through a digital network, while taxis and other for-hire services may be arranged through different dispatch or street-hail systems. Laws may also distinguish the services by licensing category, vehicle type and other requirements.

- Ride arrangement: a TNC typically matches a passenger and driver through a digital platform for a prearranged trip.
- Service category: a state may expressly exclude taxicabs, street-hail trips or other for-hire services from its TNC category.
- Vehicles and licensing: local law determines which vehicles and operating arrangements qualify.
These are common points of comparison, not tests every jurisdiction applies in the same way. New York’s law, for instance, lists taxicabs, livery vehicles, black cars, limousines, for-hire vehicles and buses among categories excluded from its definition of a TNC vehicle. Check the New York statute for that state’s terms.
Does the TNC definition vary by state?
Yes. States share the digital-network and prearranged-ride concept, but they write the boundaries differently. New York defines a TNC as an entity licensed under the relevant article and operating exclusively through a digital network. Illinois defines the company through its use of a digital network or software application to connect passengers to services from TNC drivers. Delaware, Kansas and Maine also define TNC-related terms in their statutes, with jurisdiction-specific qualifications.

When does a TNC trip legally begin and end?
The relevant trip period can matter for regulation and insurance, but there is no single boundary that applies nationwide. North Carolina’s TNC-service period begins when a driver accepts a request and ends at the later of completion of the in-app transaction or passenger unloading. New York treats a driver as using a TNC vehicle when logged onto the digital network or engaged in a prearranged trip. Those rules illustrate why the applicable statute and regulator guidance matter for a specific ride.

What to check for a particular service or state
If you need to know whether a company or ride falls under TNC rules, consult the law and regulator guidance for the relevant state or locality. Look for how they define the company, driver and prearranged trip; whether the service or vehicle is excluded; any licensing and insurance requirements; and the events that mark the start and end of the regulated period.
