A virtual assistant can often handle factual intake, records requests, document preparation, and routine processing under clear instructions and appropriate supervision. Coverage advice, recommendations, and actions that bind or otherwise effect insurance should stay with staff licensed for the applicable line and jurisdiction. The dividing line depends on the task and the law where it is performed—not the assistant’s job title.

Start with the activity, not the job title

The National Association of Insurance Commissioners (NAIC) describes an insurance producer as an individual who sells, solicits, or negotiates insurance. Its producer licensing overview explains that state regulators license producers and set rules for their activities.

The NAIC’s 2020 State Licensing Handbook explains the licensing test in terms of those activities. It describes negotiating as directly conferring with or advising a purchaser about substantive policy benefits, terms, or conditions in the circumstances covered by the model. The handbook says the relevant state is determined by where the activity requiring a license takes place.

These are national model-guidance examples, not a universal authorization list. The handbook is based on the Producer Licensing Model Act, uniform licensing standards, and adopted guidance; it also discusses state exceptions. Before assigning a task, check the applicable state law and insurance department guidance for the state, line of authority, and actual workflow. The NAIC’s handbook page identifies the 2020 edition as the current version presented there.

Which tasks can a virtual assistant handle?

The NAIC’s Appendix B on licensable and non-licensable activities distinguishes clerical support from conduct that sells, solicits, negotiates, or effects insurance. Use the table as a routing aid, then verify each task against the rules that apply to your operation.

Task or customer request Potential clerical role Licensed-staff boundary
“I’d like to get a quote” or a new application Capture factual information, receive and route the coverage request to a producer, or prepare an application under that producer’s instructions for review. Do not advise what coverage to buy, recommend a policy or company, or discuss substantive policy benefits, terms, or conditions as part of the sale.
Underwriting information Retrieve information from credit agencies, motor-vehicle departments, or other insurance entities, as directed. Escalate if the conversation turns into evaluating the risk or advising the prospective purchaser about insurance.
Binders, certificates, endorsements, identification cards, or policies Prepare materials under a producer’s instructions for that producer’s review and signature. Keep with licensed staff any act that effects insurance or represents that requested coverage is or will be bound. Physical delivery alone is different from issuance that effects a policy.
A request to change an existing policy Receive and record a request, prepare the relevant endorsement, or process a change under the established workflow. Escalate questions requiring interpretation or advice, and any action that effects the policy. The NAIC examples allow a rate quote only for the requested change; treat that allowance narrowly and confirm applicable state rules.
Questions about an existing policy Report what the policy records show, receive and record requests about additions or deletions, and route requests as directed. Do not interpret exclusions, judge whether limits are adequate, or recommend a change. Those go to appropriately licensed staff.
Routine office processing Open mail, file records, mail billings, and carry out other documented clerical processing. Escalate if the task moves beyond processing into coverage judgment, a recommendation, or effectuation of insurance.

Use a separate boundary for existing-policy service

A current policyholder’s request is not automatically a clerical task: the substance of the response still matters. Receiving a request and recording it, or reporting a fact shown in policy records, is different from explaining what the contract means or advising whether the customer should change coverage. Route the latter conversations to a producer licensed for the relevant line and jurisdiction.

Build a workflow that catches the boundary

  1. Define work as actions. List the specific tasks and sample customer requests; do not assign authority based on labels such as “assistant” or “account manager.”
  2. Write factual-intake scripts. Give the assistant approved prompts for collecting information, making records requests, preparing documents, and handing off questions. A script should not turn into a recommendation or coverage interpretation.
  3. Name escalation triggers. Route questions about what a policy means, what coverage a person needs, which company to choose, or whether a change is advisable to licensed staff.
  4. Set review points. Require producer review before materials are signed, coverage is represented as bound, or a step may effect the policy. Automated request routing should be developed and maintained under insurer or licensed-producer supervision, as described in the NAIC activity examples.
  5. Record the operating context. For each workflow, document the state, line of authority, supervisor, review point, and person responsible for escalation.
  6. Check special rules before rollout. Verify applicable state law and department guidance, particularly for multi-state service, sales-related messaging, policy issuance, compensation, health-marketplace assistance, and claims-related roles. The NAIC Producer Licensing Task Force’s 2026 charges include discussion of state perspectives on marketplace enrollment assisters and producers helping consumers and businesses purchase health coverage; that agenda signals a context to check, but does not itself define an assistant’s authority.

A quick test for a proposed task

  • Purpose: Is the assistant capturing facts or processing a request, or selling, soliciting, or advising?
  • Judgment: Does the task interpret terms, assess risk, or recommend coverage or a carrier?
  • Policy effect: Does the assistant only prepare or deliver a document, or does the action bind or otherwise effect coverage?
  • Context: Is this a prospective sale or a narrowly defined change to an existing policy?
  • Authority and oversight: Which state and line apply, and are written instructions, producer review, signature, or supervised automation built into the task?

If an answer indicates advice, a recommendation, negotiation, or policy effect, pause the task and route it to appropriately licensed staff. The NAIC examples help identify the distinction; the controlling answer for a real workflow comes from the law and regulator guidance that apply to that activity.
